HomeMy WebLinkAbout10292 I. , . . 1 RESOLUTION NO. /'?r2;?...2 .-/ 2 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNAR- DINO REQUESTING THE STATE OF CALIFORNIA, DEPARTMENT OF PUBLIC WORKS, ACTING BY 3 AND THROUGH THE DIVISION OF HIGHWAYS, TO PROVIDE ADDITIONAL STORM DRAINAGE FACILITIES ON PUMALO STREET AS A PART OF THE ROUTE 30 FREEWAY CONSTRUCTION PROJEC 4 WHEREAS, the State is presently constructing the Route 30 Freeway on 5 the new alignment, between Waterman Avenue and Arden Avenue; and 6 WHEREAS, the State and City do mutually desire to participate in the 7 construction of a 30" storm drain along the south side of Pumalo Street, between 8 Sterling Avenue and the Del Rosa Channel; and 9 WHEREAS, the City and State will mutually benefit from the aforesaid 10 construction of drainage facilities through improved conditions on reconstructed 11 and existing local streets; and 12 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 13 CITY OF SAN BERNARDINO AS FOLLOWS: 14 SECTION ONE: The City hereby respectfully requests the State of 15 California, Department of Public Works, acting by and through the Division of 16 Highways, to provide that portion of the storm drain between Sterling Avenue and 17 a point just easterly of Osbun Road. 18 SECTION TWO: City agrees to provide, that portion of the s~brm drain, 19 from a point just easterly of Osbun Road to the Del Rosa Channel, within approx- 20 imately one year from the date construction is completed on that. portion of the 21 drain between Sterling Avenue and a point just easterly of Osbun Road. 22 SECTION THREE: City further agrees to provide all necessary rights of 23 way for construction of the entire storm drain, and to negotiate for relocation 24 of all utilities interfering with construction of the storm drain. 25 26 27 28 29 30 31 SECTION FOUR: City also agrees to accept the storm drain and appur- tenant facilities upon relinquishment, by State, and to hold State harmless from all claims for damages alleged to have resulted from alterations in the pre- viously existing drainage patterns due to construction of the aforesaid storm drain and any other damages alleged to have resulted from work performed by or on behalf of the State in connection with construction of the aforesaid storm drain. 32 , .
