RESOLVED, that the bid of Riverside Construction Co.,
for the improvement of Thirteenth Street between "D" Selteet and
6 Arrowhead Avenue, in accordance with Special provisions No. 4096,

is the lowest responsible bidder therefor, and that the same be

and is hereby accepted and all other bid~hereby rejected.

That the contract, a copy of which is attached hereto,
marked Exhibit "A" and referred to and made a part hereof as fully

12 as though set forth at length herein, be and the same is hereby
13 awarded to Riverside Construction Co.
14 Thst the Mayor and City Administrator of the city of San

contract on behalf of said city.

NOTICE INVITING BIDS
NOTICE IS HEREBY GIVEN that the City of San Bernardino will
receive bids or proposals for:
THE IMPROVEMENT OF THIRTEENTH STREET BETWEEN "D"
STREET AND ARROWHEAD AVENUE, IN ACCORDANCE WITH
SPECIAL PROVISIONS NO. 4096, ON FILE IN THE OFFICE
OF -THE CITY ADMINISTRATOR, ROOM 201, CITY HALL.
Deliver all bids to the City Administrator's Office, Room 2()1,
City Hall, 363 North "E" Street, San Bernardino, California,
with the specification title and number clearly marked on the
outside of the envelope.
Said bids or proposals will be received up to the hour of
2:00 p.m., Tuesday, May 26, 1970 , at which time all
of said bids or proposals will be publiclv opened, examined
and declared in the Council Chambers, 392 Court Street, San
Bernardino, California.
No bid will be received unless it is made on a proposal form
furnished by the City. All bids or proposals- shall be sianed,
sealed and accompanied bv cash, cashier's check, certified check
'or bid bond made payable to the City of San Bernardino, in
the amount of ten per cent (10%) of the bid. Such cash,
check or bond shall be given as a guarantee that the bidder
will enter into the contract if awarded to him. 'In the event
the bidder re~uses to execute said contract, the use hv the
public of the improvements will be delaved, and the public
will suffer great damage. ~rom the nature of the case, it
would be extremely difficult and impractical to fix said amount
of damage, Therefore, the City and the bidder aaree that the
above sum of 10% shall be paid to the Citv uPon the condition
above set forth as liquidated damages and not as a forfeiture.
All bonds furnished pursuant to this notice must be under-
written bv a surety company having a rating in Best's most
recent Insurance Guide of "A" or better.
Pursuant to law, the Mavor and Common Council o~ the City of
San Bernardino, bv Resolution No, 5718 and anv and all
amendments thereto which are herebv referred to and made a
part hereof bv reference as fully as though set ~orth at
length herein, have ascertained and determined the aeneral
prevailina rate of per diem waaes, and of per diem waaes for
legal holidavs and overtime _work for each craft or tvpe of
workman needed in the execution of contracts under jurisdiction
of said Mayor and Common Council.

Said prevailing rates of wages shall conform to "Nage Scales
for the Six Basic Trades", filed in the Office of the City
Clerk, 'and "Sub-Trades Hourly Wage - Rates of Buildina and
Construction Trade Council of San Bernardino and Riverside.

Counties", filed in the Office of the City Clerk, which are
made a part of said Resolution No. 5718 and amennments there-
to.
It shall be mandatory upon the contractor to whom the contract
is awarded and'upon any sub-contractor under him, to pay not
less than said specified rates to all laborers, workmen, and
mechanics employed by them in the execution of the contract,
and to prevent discrimination in the employment of persons
because of race, creed, color, or national oriQin, as set
forth in the provisions of Resolution No. 7414 of the Mayor
and Common Council of the City of San Bernardino.
No bid will be accepted from a contractor who is not
licensed in accordance with the provisions of Chapter 9,
Division III of the Business and Professional Code.
The City of San Bernardino reserves the right to reject any
and all bids.
Plans and specifications may be obtained from the City Admin-
istrator's Office, Room 201, City Hall, 363 North "E" Street,
'San Bernardino, Caiifornia 92401, upon a non-refundable payment of
$5.00 for each set. .

SPECIAL PROVISIONS
SECTION I
GENERAL

1.01 General --'The worl( embodied herein shall be done in accordance with
'- the Standard Specifications No. 2?11, revised October 1966, of the City of San
Bernardino, Department of Engineering insofar as the same may apply, and as
modified and in accordance with. the following special provisions.
1.02 Place of Production/Manufacture -- In the performance of this contract,
Contractor agrees to use or supply only such unmanufactured materials, articles
and supplies as have been produced in the United States, and only such manufactured
materials, articles and supplies as have been manufactured in the United States
substantially all from materials produced in the United States, unless exempted
from this requirement by.. Article I, Chapter "4, Divisi"n 5, Title I of tne Govern-
ment Code of Cali forniaor bv ..treati I;:S or. genera 1 trade agreements of thp United
S.dtes.
1.03 Conflicts --'- In case of conflict between the . Standard Specifications
and these special provisions..the special provisions shall :ake precedence over
and be used in lieu of such conflicting portions.

DESCRIPTIUN OF WOk
1.01 General. -- The work. 10 be done consists, in general, of removing
. llx;sting:concrete. performing earthwork for widened Toinlway, placing asphalt
concrete, cOflstructing concrete curbs, gutters. sidewalks, driveways, relocating
street lighting equipment, all as shown on plans.
P.C.C. driveways, sidewalk, curb, A.C. pavement, are to be removed and dis-
posed of; asphalt concrete pavement is to be placed; embankment is to be constructed;
concrete curbs ,gutters, si dewa I k, dri veways, spandri 1s and cross gutters, are to
be constructed; portion of street lighting system is to be relocated; the roadway
is to be finished; and such other items or details not mentioned above which are
r~quired by the plans, the STANDARD SPECIFICATIONS or these Special Provisions
are to be constructed or furnished and installed, all as shown on the plans, as
specified herein and as directed by the Engineer.
2.02 Maintaini~ Trafffc -- ~raffic shall be allowed to pass through the
construction ilrea at aU times. A. minimum"of one-t~lelve foot lane in each direction
must be maintained at all times.

3.03 Aqqreqate Base -- Aggregate base shall be broken stone or crushed
gravel, compTymg~lith the Standard Specifications.
3.04 Asphalt Concr.ete-- Type "B" asphalt concrete shall conform to the
pravisi ons of.SeetioT" l~ oT the Standard Speci fi cat ions and these Sped a 1 Provi s ions.
Paving asphalt to be mixed \'rith~the mineral aggl'egate shall be steam-refined
asphalt having a penetration of 60-70, 85-100, 120-150, or 200-300, the range of
penetration to be designated by the Engineer.
A prime coat and/or paint binder shall be furnished and applied as directed
by the Engineer, and full compensation for furnishing and applying this material
shall be considered as included in the prices paid per ton for asphalt concrete
and no additional compensation ,.lill be allo':led therefor.'

3.06 Curbs, Gutters, Driveway Approaches, Spandrils, Cross Gutters, and
Sidewalk -- This work shall conform to Section 18 of the Standard Specifications.
Full compensation for excavation and backfill required in connection with
curb and gutter, driveway approaches, and modified driveways construction shall
be considered as included in contract price paid ~er cubic yard and no additional
." nCOO1pensati on wi 11 be allowed therefor:
3.07 Miscellaneous Work -- Miscellaneous work shown on the plans (relocation
of street signs, removal of sprinkler heads and pipin~ etc.) shall be performed as
, directed by the Engineer. P1yrnent'for t~~is itp.m shall be considered as included
in the various bid items for this project and no additional compensation will be
allowed therefor.

Article I - Witnesseth, That for and in consideration of payments and
agreements hereinafter mentioned, to be made and performed by the said party of
the first part, and under the conditions expressed in the two bonds, bearing even
date with these presents, and hereunto annexed, said party of the second part agrees
with the said party of the first part, at his own proper cost and expense to do
all the work and furnish all the materials, except such as are mentioned in the
Special Provisions to be furnished by sain party of the first part, necessary to
complete in good workmanlike and substantial manner the improvement of THIRTEENTH
STREET BETWEEN "0" STREET AND ARROWHEAD AVENUE, in strict conformity with the
Plans and Special Provisions No. 4096, on file in the Office of the City Engineer,
and also in accordance with Standard Specifications No. 2271, City of San Ber-
nardino, Department of Engineering, revised October 1966, which said Plans, Special
Provisions and Standard Specifications are hereby specially referred to and by
such reference made a part hereof.
Article II - And the-5aid contractor agrees to receive and accept the follow-
ing prices as full compensation for furnishing all materials and doing all the work
contemplated and embraced in this agreement; also for all loss or damage arising
out of the nature of the work aforesaid, or from the acts of the elements, or from
any unforeseen difficulties or obstructions which may arise or be encountered in
the prosecution of the work until its acceptance by the City of San Bernardino and
for all risks of every description connected with the work; also for all expenses
incurred by or~in consequence of the suspension or discontinuance of work, and for
well and faithfully completing the work, and the whole thereof, in the manner and
accordi ng to the Pl ans and Sped a 1 Provi s ions, and requi rements of the Engi neer
