FOR THE IMPROVEMENT OF ARROWHEAD AVENUE BETWEEN FOURTH ST. AND FIFTH ST., WEST SIDE, WITH THE EXCEPTION OF ITEM 7, RELOCATION OF TRAFFIC SIGNAL AND STREET LIGHTING EQUIPMENT, IN ACCORDANCE WITH SPECIAL PROVISIONS NO. 40500 RESOLVED, that the bid of Riverside Construction Co., for the improvement of Arrowhead Avenue between Fourth sto and Fifth St., West Side, with the exception of Item 7, relocation of traffic signal and street lighting equipment, in accordance with Special provisions No. 4050, is the lowest responsible bidder therefor, and that the same be and is hereby accepted and all other bids are hereby rejected. That the contract, a copy of which is attached hereto, marked Exhibit "A" and referred to and made a part hereof as fully as though set forth at length herein, be and the same is hereby awarded to Riverside Construction Co. BETWEEN 4TH ST. AND 5TH ST. WEST SIDE IN ACCORDANCE WITH SPECIAL PROVISIONS NO. 4050, ON FILE IN THE CITY ADMINISTRATOR'S OFFICE, ROOM 201, 363 N. "E" STREET, SAN BERNARDINO, CA. Deliver all bids to the City Administrator's Office, Room 201, City Hall, 363 North "E" Street, San Bernardino, California, with the specification title and number clearly marked on the outside of the envelope. Said bids or proposals will be received up to the hour of 2:00 p.m., L Tuesday, April 14, 1970 , at which time all of said bids or proposals will be publiclv opened, examined and declared in the Council Chambers, 392 Court Street, San Bernardino, California. No bid will be received unless it is made on a proposal form furnished by the City. All bids or proposals shall be sianed, sealed and .accomDanied bv cash, cashier's check, certified check .or bid bond made payable to the City of San Bernardino, in the amount of ten per cent (10%) of the bid. Such cash, check or bond shall be given as a guarantee that the bidder will enter into the contract if awarded to him. In the event the bidder refuses to execute said contract, the use bv the public of the improvements will be delaved, and the public will suffer great damage. Prom the nature of the case, it would be extremely difficult and impractical to fix said amount of damage. Therefore, the City and the bidder aaree that the aboye sum of 10% shall be pain to the Citv upon the connition above set forth as liquidated damages and not as a forfeiture. All bonds furnished pursuant to this notice must be under- written by a surety company having a rating in Best's most recent Insurance Guide of "A" or better. Pursuant to law, the Mavor and Common Council. of the City of San Bernardino, by Resolution No. 5718 and anv and all amendments thereto which are herebv referred to and made a part hereof by reference as fully as though set forth at length herein, have ascertained and determined the aeneral prevailina rate of Der diem waaes, and of per diem waaes for legal ~olidays and overtime work for each craft or tvpe of workman needed in the execution of contracts under jurisdiction of said Mayor and Common Council. It shall be mandatory upon the contractor to whom the contract is awarded and 'upon any sub-contractor under him, to pay not less than said specified rates to all laborers, workmen, and mechanics employed by them in the execution of the contract, and to prevent discrimination in the employment of persons because of race, creed, color, or national oriain, as set forth in the provisions of Resolution No. 7414 of the Mayor and Common Council of the City of San Bernaroino. No bid will be accepted from a contractor who is not licensed in accordance with the provisions of Chanter 9, _ Division III of the Business and Professional Code. The City of San Bernardino reserves the right to reject any and all bids. CITY OF SAN BERNARDINO BY: LUCILLE GOPORTH City Clerk , . ---~ / / / . / < SPECIAL PROVISIONS SECTION I GENERAL 1.01 General -- The work embodied herein shall be done in accordance with the Standard Specifications No. 2271, revised October 1966, of the City of San Bernardino, Department of Engineering insofar as the same may apply, and as modified and in accordance with the following special provisions. -- 1.02 Pl ace of Producti on/tlanufacture -- In the performance of thi s contract, Contractor agrees to use or supply only such unmanufactured materials, articles and supplies as have been produced in the United States, and only such manufactured materials, articles and supplies as have been manufactured in the United States substanti ally all from materi a ls produced in the United States, un less exempted from this requirement by article 1, Chapter 4, Division 5, Title 1 of < the Govern- ment Code of California or by treaties or general trade agreements of the United States. 1.03 Conflicts -- In case of conflict between the Standard Specifications and these special provisions, the special provisions shall take precedence over and be used in lieu of such conflicting portions. SECTION II DESCRIPTION OF WORK 2.01 General -- The work to be done consists, in general, of removing existing concrete, performing earthwork for widened roadway, placing asphalt concrete, constructing concrete curbs, gutters, sidewalks, driveways, relocating traffic signal and street lighting equipment, all as shown on plans. P.C.C. driveways, sidewalk, curb, gutter, reinforced concrete box, A.C. pavement, are to be removed and disposed of; asphalt concrete pavement is to be placed; embankment is to be constructed; concrete curbs, gutters, sidewalk, driveways are to be constructed; portion of street lighting system is to be relocated; traffic signal equipment is to be relocated; the roadway is to be finished; and such other items or details not mentioned above which are required by the plans, the STANDARD SPECIFICATIONS or these Special Provisions are to be constructed or furnished and installed, all as shown on the plans, as specified herein and as directed by the Engineer. 2.02 Maintaining Traffic -- Traffic shall be allowed to pass through the construction area at all times. A minimum of one-twelve foot lane southbound and two-twelve foot lanes Northbound must be maintained at all times. SP-l SECTION II I CONSTRUCTION DETAILS 3.01 Concrete and Asnhalt Pavement Removal shall be performed as shown on the plans in conformance I'li tl1 the Standard Specifi cati ons. Asphalt concrete removal shall include A.C. drivel'lays. Removed material shall become the property of the contractor and be disposed of outside the street right of way in accordance with Sub-section 9.02 of the Standard Specifications. Saw cutting shall be included in this payment item. Concrete and Asphalt pavement removal shall be paid for at the lump sum price stated in the contract and no additional compensa- tion \~ill be all ol'led therefor. . 3.02 Earthwork -- Earthl'lork shall conform to the provisions of Section II of the Standard Specifications except as modified by these special pro~isions. Surplus excavated material if any shall become the property of the contractor and be disposed of outside the street right of way. Payment for Roadl'lay Excavati on sha 11 be on a 1 ump sum bas i s as provi ded in the contract which price shall include full compensation for furnishing all labor, materials, tQols, equipment and incidentals, and for doing all the work involved in'excavating, loading, hauling, depositing, spreading and compacting excavated material in place, including furnishing and applying water and disposing of surplus materials, all as shown on the plans. 3.03 Aqq~eqat~ Base -- Aggregate b~s~ sh~ll be broken stone or crushed gravel, complYlng I'llth the Standard Speclflcatlons. 3.04 Asphalt Concrete-- Type "B" asphalt concrete shall conform to the ~rovisions .of Section 15 of the Standard Specifications and these Special Provisions. Paving asphalt to be mixed with the mineral ~ggregate shall be steam-refined asphalt having a penetration of 60-70, 85-100, 120-150, or 200-300, the range of penetration to be designated by the Engineer. A prime coat and/or paint binder shall be furnished and applied as directed by the Engineer, and full compensation for furnishing and applying this material shall be considered as included in the prices paid per ton for asphalt concrete and no additional compensation will be allowed therefor. 3.05 Finishino Road'.'lav -- Finishing roadway shall conform to Section 16 of the Standard Specifications. Compensation for finishing roadway shall be considered as included in the prices paid for the various contract items of work and no additional compensation will be allowed therefor. . SP-2 --~.-...~---'--. / " 1" 3.06 Curbs, Gutters, Driveway Approaches, and Sidewalk -- This work shall conform to Section 18 of the Standard Specifications. Full compensation for excavation and backfill required in connection with curb and gutter, driveway approaches, and modified driveways construction shall be considered as included in contract price paid per cubic yard for Portland cement concrete (curbs, gutters, driveway approaches, and modified driveways) and no additional compensation will be allowed therefor. ~ . Article I - Witnesseth, That for and in consideration of payments and agreements hereinafter mentioned, to be made and performed by the said party of the first part, and under the conditions expressed in the two bonds, bearing even date with these presents, and hereunto annexed, said party of the second part agrees with the said party of the first part, at his own proper cost and expense to do all the work and furnish all the materials, except such as are mentioned in the Special Provisions to be furnished by said party of the first part, necessary to complete in good workmanlike and substantial manner the improvement of THE WEST SIDE OF ARROWHEAD AVENUE BETWEEN FOURTH STREET AND FIFTH STREET, in strict con- formity with the Plans and Special Provisions No. 4050, on file in the Office of the, City Engineer, and also in accordance with Standard Specifications No. 2271, City of San Bernardino, Department of Engineering, revised October 1966, which said Plans, Special Provisions and Standard Specifications are hereby specially referred to and by such reference made a part hereof.
