HomeMy WebLinkAbout10256 , . , I I I : '~ . . ~ RESOLUTION NO~/.U'~""t 2 A RESOLUTION OF TIlE MAYOR AND COMMON COUNCIL OF T1IE CITY OF SAN BERNARDINO DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY TIlE COUNCIL OF :3 TIlE CITY OF SAN BERNARDINO TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED ANNEXATION DISTRICT NO. 249 (LAFC 879), AND 4 GIVING NOTICE OF THE PROPOSED ANNEXATION. 5 BE IT RESOLVED BY TIlE MAYOR AND COMMON COUNCIL OF TIlE CITY OF SAN 6, BERNARD INO AS FOLLOWS: 7 SECTION ONE: That pursuant to the provisions of the Annexation of 8 Uninhabited Territory Act of 1939, proceedings have been initiated by the 9, Council of the City of San Bernardino, on its own motion, to annex to the City 10 of San Bernardino all that uninhabited territory situate in the County of San 11; Bernardino, State of California, hereby designated as Annexation District No. 12 249 (LAFC 879), and described as follows: 13" That portion of Block A of the Cooley Tract as per plat thereof recorded in Book 5 of Maps, page 62, records of the County 14 Recorder of San Bernardino County, State of California and those portions of the adjoining streets, described as follows: 15 Beginning at a point on the Present Corporate Limits of the City 16 of San Bernardino, said point being the intersection of the center line of Fourth Street and the center line of Waterman Avenue; 17 thence North along the center line of said Waterman Avenue and said City Limit Line a distance of 341.25 feet to the cen.2r line 18 ' of Monterey Street; thence East along said City Limit Line, the center line of said Monterey Street and leaving said City Limit 19 Line a distance of 441.25 feet to the Northerly prolongation of the East line of Lot 11 of said Block A; thence South along said 20 Northerly prolongation, the East line of Lots 11 and 34 and the Southerly prolongation thereof a distance of 341.25 feet to the 21 center line of said Fourth Street; thence West along the center line of said Fourth Street a distance of 441.25 feet to the point 22 of beginning. Containing 3.46 acres, more or less. 23 That there are less than twelve qualified electors residing in said 24 territory, and that said territory is uninhabited as defined by said Act. 25 SECTION TWO: That the said council of the City of San Bernardino 26 desires to annex said uninhabited territory to the City of San Bernardino_for 27 the following reasons: Said territory is contiguous to the City of San 28 Bernardino and its proposed annexation will contribute and facilitate the 29 orderly growth and development of both the City of San Bernardino and the 30 31 territory proposed to be annexed, and will provide and facilitate proper over-all planning and zoning of lands in said City and said uninhabited 32 territory in a manner most conducive to the welfare of said city and said -1- , . v' . . 1 uninhabited territory. 2 SECTION THREE: That upon the completion of said annexation of said 3 territory, all of the property included in said Annexation District No. 249 4 (LAFC 879) shall be taxed equally with the other property within the City of 5 San Bernardino to pay the bonded indebtedness and any and all general indebted- 6 ness of the City of San Bernardino contracted prior to or existing or outstanding 7 at the time of the aforesaid proposed annexation of said described property as 8 provided in said Act. 9 SECTION FOUR: That Monday, the 22nd day of June, 1970, at the hour 10 of 9:30 o'clock A. M., of said day in the Council Chambers located in the 11 Garner Building, 392 Court Street, San Bernardino, California, is hereby fixed 12 as the time and place when and where any person owning real property within the 131 141 uninhabited territory, above described and proposed to be annexed to the City of San Bernardino, and having any objections to the proposed annexation may 15 appear before the Council of the City of San Bernardino and show cause why such 16 uninhabited territory should not be so annexed to the City of San Bernardino. 17 Such protest must be in writing, may be filed with the City Clerk at any time 181 191 20 before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected, and the description of such property in general terms. 21 SECTION FIVE: The City Clerk of the City of San Bernardino is hereby 22 authorized and directed to cause a copy of this resolution to be published at 23 least twice but not oftener than once a week in the San Bernardino Free Press, 24 a newspaper of general circulation published in the City of San Bernardino, 25 the city to which it is proposed to annex the aforesaid territory, and also in 26 the Highland Messenger, a newspaper of general circulation published outside 27 the City of San Bernardino but in the County of San Bernardino, California, the 29 San Bernardino, said publication to be complete at least twenty (20) days prior 28 county in which is located the territory proposed to be annexed to the City of 30 to the date set for hearing; 31 The said City Clerk is further authorized and directed to cause 32 written notice of such proposed annexation to be mailed to each person to whom -2- J - . . - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 lands within the territory proposed to be annexed is assessed in the last equalized county assessment roll available to said clerk on the date the above said proceedings were initiated, at the addresses shown on said assessment roll, or known to said Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with said Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation; And in the event that any land within the territory proposed to be annexed is owned by a county, the said City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such county, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation; And in the event there is upon the land proposed to be annexed a structural improvement owned, being acquired or leased by a county fire protec- tion district, the said City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent" not less than ten (10) days before the first public hearing upon such proposed annexation; And the City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
