HomeMy WebLinkAbout10247 ." -, 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ~ . . . 1 RESOLUTION NO.lo.-2 <-j::; A RESOLUTION OF THE MAYOR AND COMMol COUNCIL OF THE CITY OF SAN BERNARDINO DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF SAN BERNARDINO TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED ANNEXATION DISTRICT NO. 247 (LAFC 873), AND GIVING NOTICE OF THE PROPOSED ANNEXATION. 2 :3 4 5 6 7 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION ONE: That pursuant to the provisions of the Annexation of 8 Uninhabited Territory Act of 1939, proceedings have been initiated by the 9 Council of the City of San Bernardino, on its own motion, to annex to the City of San Bernardino all that uninhabited territory situate in the County of San Bernardino, State of California, hereby designated as Annexation District No. 247 (LAFC 873), and described as follows: Those portions of Blocks 64, 68, 69, 74, 75, 81 and 86 Irvington Land and Water Company's Subdivision, as per plat thereof recorded in Book 1, page 32, Records of Survey on file in the office of the County Recorder of San Bernardino County, State of California, and that portion of Section 1, Township 1 North, Range 5 West, San Bernardino Meridian which includes Blocks 59, 63 and 67 as delineated on said map of Irvington Land and Water Company's Subdivision, and those portions of adjoining streets, described as follows: Beginning at a point on the Present Corporate Limits of the City of San Bernardino, said point being the intersection of the center lines of Palm Ayenue, 60.00 feet wide and Belmont Avenue 60.00 feet wide; thence Northwesterly along said City Limit Line and the center line of said Belmont Avenue a distance of 4910.00 feet, more or less to the most Westerly terminus of the center line of said Belmont Avenue, said point also being on the South line of Lot "H" of the Meyer and Barclay Resubdivision as per plat thereof recorded in Book 12 of Maps, page 18, records of said County; thence leaving said City Limit Line Easterly along the South line of said Lot "H" a distance of 335.00 feet, more or less, to the West line of said Block 81 of said Irvington Land and Water Company Subdivision; thence Northerly along the West line of said Irvington Land and Water Company Subdivision a distance of 1515.00 feet, more or less to the center line of Ohio Avenue, 60.00 feet wide; thence Southeasterly along the centerTIine of said Ohio Avenue a distance of 1250.00 feet, more or less, to the center line of Cypress Avenue, 60.00 feet wide; thence Northeasterly along the center line of said Cypress Avenue a distance of 1025.00 feet, more or less, to a point on the North line of the Rancho Muscupiabe as per plat recorded in Book 7 of Maps, page 23, records of said County; thence Southeasterly along said Rancho Muscupiabe line, a distance of 1765.00 feet, more or less, to a point on the North line of Section 1, Township 1 North, Range 5 West, San Bernardino Meridian; thence East along the North line of said Section 1, a distance of 2,740.00 feet, more or less to the Northeast corner of Government Lot 1 of said Section 1, and said City Limit Line; thence along said City Limit Line the following courses and distances; thence South- westerly along the West line of the property conveyed to John -1- , . . 1 P. Fauls Sr. by Deed recorded January 8, 1957 in Book 4126, page 84, Official Records of said County, a distance of 1,335.00 2 feet, more or less, to a point on the Southerly line of said Government Lot 1, which point is 900.00 feet Southeasterly 3 thereon from the Southwest corner of said Government Lot 1; thence Northwesterly along said Southerly line of Government 4 Lot 1, a distance of 70.00 feet, more or less to the center line of said Palm Avenue; thence Southwesterly along said center 5 line of said Palm Avenue a distance of 2,570.00 feet, more or less to the point of beginning. 6 Containing 294 acres, more or less. 7 That there are less than twelve qualified electors residing in said 8 territory, and that said territory is uninhabited as defined by said Act. 9 SECTION TWO: That the said council of the City of San Bernardino 10 desires to annex said uninhabited territory to the City of San Bernardino for 11 the following reasons: Said territory is contiguous to the City of San 12 Bernardino and its proposed annexation will contribute and facilitate the 13 orderly growth and development of both the City of San Bernardino and the 14 territory proposed to be annexed, and will provide and facilitate proper 15 over-all planning and zoning of lands in said City and said uninhabited 16 territory in a manner most conducive to the welfare of said city and said 17 uninhab ited territory. 18 SECTION THREE: That upon the completion of said annexation of said 19 territory, all of the property included in said Annexation District No. 247 20 (LAFC 873) shall be taxed equally with the other property within the City of 21 San Bernardino to pay the bonded indebtedness and any and all general indebted- 22 ness of the City of San Bernardino contracted prior to or existing or outstand- 23 ing at the time of the aforesaid proposed annexation of said described property 24 as provided in said Act. 25 SECTION FOUR: That Monday, the lbl:h day of June, 1970, at the hour 26 of 9:30 o'clock A. M. of said day, in the Council Chambers located in the 27 Garner Building, 392 Court Street, San Bernardino, California, is hereby fixed 28 as the time and place when and where any person owning real pr.perty within the 29 uninhabited territory, above described and proposed to be annexed to the City 30 of San Bernardino, and having any objections to the proposed annexation may 31 appear before the Council of the City of San Bernardino and show cause why 32 such uninhabited territory should not be so annexed to the City of San -2- .~ . . ~ Bernardino. Such protest must be in writing, may be filed with the City Clerk 2 I at any time before the hour set for hearing objections to the proposed annexa- 3 tion, and shall state the name or names of the owner or owners of property 4 affected, and the description of such property in general terms. 51 SECTION FIVE: The City Clerk of the City of San Bernardino is hereby 6 authorized and directed to cause a ~opy of this resolution to be published at 7 least twice but not oftener than once a week in the San Bernardino Free Press, 8 a newspaper of general circulation published in the City of San Bernardino, 9 the city to which it is proposed to annex the aforesaid territory, and also in 10 the Highland Messenger, a newspaper of general circulation published outside 11 the City of San Bernardino but in the County of San Bernardino, California, the 12 county in which is located the territory proposed to be annexed to the City of 13 San Bernardino, said publication to be complete at least twenty (20) days prior 14 to the date set for hearing; 15 The said City Clerk is further authorized and directed to cause 16 written notice of such proposed annexation to be mailed to each person to whom 17 lands within the territory proposed to be annexed is assessed in the last 18 equalized county assessment roll available to said clerk on the date the above 19 said proceedings were initiated, at the addresses shown on said assessment 20 roll, or known to said Clerk, and to any person who has filed his name and 21 address and the designation of the lands in which he has an interest, either 22 legal or equitable, with said Clerk, such notice to be given not less than 23 twenty (20) days before the first public hearing on the proposed annexation; 24 And in the event that any land within the territory proposed to be 25 annexed is owned by a county, the said City Clerk is directed to cause written 26 notice of such proposed annexation to be mailed to the Board of Supervisors of 27 such county, such notice to be given not less than twenty (20) days before the 28 first public hearing on the proposed annexation; 29 And in the event there is upon the land proposed to be annexed a 30 structural improvement owned, being acquired or leased by a county fire 31 protection district, the said City Clerk is directed to cause written notice 32 of such proposed annexation to be mailed to the governing body of such district, -~ .. ~ 8 9 10 11 12 13: I 141 I i 151 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 . . 1 such notice to be sent not less than ten (10) days before the first public 2 hearing upon such propesed annexation; 3 And the City Clerk is directed to cause written notice to be given to 4 such other persons as may be legally entitled thereto, in the manner required 5 by law. 6 I HEREBY CERTIFY that the foregoing resolution was adopted by the 7 Mayor and Common Council of the City of San Bernardino at a regular meeting thereof, held on the 4th day of May, 1970, by the following vote, to wit: councilmenc?'~~ /Ld/A./, i;::~_"A"7) - ~ ~~: > d.,rl-.~/~e;;8'/{ ~ 7~p) 2:i~, .//~dAL1'A._ .)
