LiJ;J..~1 _ A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ADOPTING AND APPROVING THE PLAN OF DEVELOPMENT FOR THE CITY HALL--EXHIBIT HALL FACILITIES. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 2' 31 SECTION 1. The Plan of Development for the City Hall-- Exhioit Hall Facilities, a copy of which is attached hereto, marked Exhibit "A", and referred to and made a part hereof as fully as though set forth at length, is hereby adopted and approved. City A t-torney (p) FILED MAY {) 1970 GOFORTH, City Clerk ';;, . .' 512170 / CITY OF SAN BERNARDINO CITY HALL - EXHIBIT HALL r' PLAN OF DEVELOPMENT Pursuant to that certain agreement entitled "JOINT EXERCISE OF POWERS AGREEMENT BETWEEN THE CITY OF SAN BERNARDINO, THE COUNTY OF SAN BERNARDINO, AND THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO CREATING AN AGENCY TO BE KNOWN AS THE SAN BERNARDINO CIVIC CENTER AUTHORITY" ("Agree- ment"), the City of San Bernardino ("City") hereby files with the Commission of the San Bernardino Civic Center Authority ("Authority") this Plan of Development. The City desires to develop a particular parcel of land ("Site") under its jurisdiction within the Central City Area, said parcel being described on Exhibit A attached hereto and made a part hereof. The City intends that Authority proceed under the Bond Act referred to in the Agreement; and it is initiating the proceedings under said Bond Act by filing this Plan of Development which will make the City an "Initiating Party" under said Agreement. The land to be used for the development with relation to the Central City Area is shown on a map entitled "Central City Area, Civic Center - Illustrative Site Plan" which is attached to that certain report entitled "The Joint Powers Agreement Concept for the Civic Center Complex, San Bernardino, November 19, 1969, Report Prepared by: Jerome T. Winstead, City Administrator", which report has already been approved by the Redevelopment Agency of the City of San Bernardino ("Redevelopment Agency") as part of its proceedings for entering into the Agreement, and such Report is filed with the Commission concurrently with the filing of this Plan of Development. The land described in Exhibit A has been acquired by the City from the Redevelopment Agency and is now owned by the City. The City has prepared plans and specifications for the construction of the City Hall-Exhibit Hall. Copies of all of said plans and specifications are filed with the Commission concurrently with the filing of this Plan of Development. The Redevelopment Agency will utilize space in the City Hall and, as required by the Agreement, the Redevelopment Agency has approved the plans and specifications for the City Hall and said approval is filed with the Commission concurrently with the filing of this Plan of Development. The Facilities to be constructed (City Hall-Exhibit Hall) are described in said plans and specifi- cations. The financing arrangements necessary to accomplish the Plan of Development are as follows: (a) The City shall lease the Site to the Authority. For further description, see that certain document entitled "City Hall-Exhibit Hall Ground Lease", a copy of which is filed with the Authority concurrently with the filing of this Plan of Development. (b) The Authority will sublease the Site back to the City and lease the Facilities constructed thereon to the City. For further description, see that certain document entitled "City Hall-Exhibit Hall Facilities Sublease", a copy of which is filed with the Authority concurrently with the filing of this Plan of Development. (c) The construction of the Facilities shall be financed with the proceeds received from the issuance of bonds under the Bond Act and to accomplish this result the Authority shall adopt a resolution authorizing the issuance of such bonds. For further description, see that certain docu- ment entitled "Resolution of the San Bernardino Civic Center Authority Constituting its Indenture -' 5/2170 I " Providing the Terms and Conditions for the Issuance of $6,000.000 Revenue Bonds. First Issue of 1970". a copy of which is filed with the Authority concurrently with the filing of this Plan of Development. ", The documents referred to in (a). (b) and (c) above have been drafted as a method of proceeding under the Agreement. It is recognized that they are still in the drafting stage and that they have been used in this Plan of Development in order to describe the lease and financing arrangements in general terms and do not necessarily commit the Authority or the City to any particular provisions thereof. The City hereby requests that the Commission of the Authority take the following action: 1. Approve this Plan of Development. 2. Approve the plans and specifications for the construction of the Facilities (City Hall- Exhibit Hall). Thereafter. the City intends to proceed in accordance with the Plan of Development as outlined herein.
