Recommended Motion:

Account No. 126-369-5504-7362 (SS-I) "Residential Street Repairs" and $80,000 from Account No.
248-368-5504-7167 (SO-A) "Cross Gutter and Drainage Inlet Repairs" to Account No. 126-369-
5504-7166 (SO-B) "Box Culvert Repairs."

STAFF REPORT
Subject:
Resolution awarding a contract to Roadway Engineering & Contracting, Inc. for Storm Drain and
Street Improvements on Belmont Avenue, west of Little League Drive (SD-B), per Project Plan No.
11528, and authorization for the Director of Finance to amend the FY 2006/07 Budget.
Background:
On August 7, 2006, the Mayor and Common Council allocated funds, as part of the FY 2006/07
Capital Improvement Program (CIP) for box culvert repairs (SD-B).
This project consists of the following:
I. Removal of existing CMP drain and asphalt pavement.
2. Installation of RCP storm drains.
3. Construction of concrete wing walls, stem walls and pads.
4. Construction of new A.C. pavement.
5. Replacement of signs and delineators.
The purpose of the project is to provide an improved crossing of Belmont Avenue and Myers Creek.
The existing road crossing is substandard and subject to erosion during heavy storm events. This
project provides a safer roadway crossing and improved storm water flow under Belmont Avenue.
The plans and specifications for this project were completed and the project was opened to public
bidding on February 2, 2006. The project was advertised locally in the San Bernardino County Sun
Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego Daily
Transcript, Sub-Hub Online Plan Room, Reed Construction Data, Bid America Online, Construction
Bid Source, Bid Ocean, the City's web sites, and with the San Bernardino Area Chamber of
Commerce.

Based on review of the sealed competitive bids received, staff has determined Roadway Engineering &
Contracting, Inc. of Riverside, the apparent low bidder, has met the minimum requirements of the
specifications and bid guidelines; and, therefore, recommends that the Mayor and Common Council
award the referenced contract to determined Roadway Engineering & Contracting, Inc.
The estimated project costs are as follows:
$ 163,404.00
$ 39,510.00
$ 27,086.00
$ 230,000.00
If approved, this project is expected to begin construction in late January of 2007 and be completed by
May of2007.
Financial Impact:
Approximately $100,000 is available in Account No. 248-368-5504-7166 (SO-B) "Box Culvert
Repair" and $50,000 is available in Account No. 126-369-5504-7362 (SS-I) "Residential Street
Repairs" and $90,500 is available in Account No. 248-368-5504-7167 (SO-A) "Cross Gutter and
Drainage Inlet Repairs."
Public Services Department has verified that $50,000 in project SS-I has not been used and is available
to use for this project. Development Services Department staff believes that this is an appropriate use
of the Gas Tax Funds.
Recommendation:
1. Authorize the Director of Finance to amend the FY 2006/07 Budget by transferring $50,000 from
Account No. 126-369-5504-7362 (SS-I) "Residential Street Repairs" and $80,000 from Account
No. 248-368-5504-7167 (SO-A) "Cross Gutter and Drainage Inlet Repairs" to Account No. 248-
368-5504-7166 (SO-B) "Box Culvert Repairs."

RESOLUTION NO.
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO A WARDING A CONTRACT TO ROADWAY ENGINEERING &
CONTRACTING, INC. FOR STORM DRAIN AND STREET IMPROVEMENTS ON
BELMONT A VENUE, WEST OF LITTLE LEAGUE DRIVE, PER PROJECT PLAN
NO. 11528, AND AUTHORIZATION FOR THE DIRECTOR OF FINANCE TO
AMEND THE FY 2006/07 BUDGET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Roadway Engineering & Contracting, Inc., 8861-A Jurupa Road,
Riverside, CA 92509, is the lowest responsible bidder for Storm Drain and Street Improvements on
Belmont A venue, West of Little League Drive (SD-B), per Project Plan No. 11528. A contract is
awarded accordingly to said bidder in a total amount of $163,404.00, with a contingency
14 amount of $27,086.00, but such award shall be effective only upon being fully executed by
both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized
and directed to execute said contract on behalf of the City; a copy of the contract is on file in
the office of the City Clerk and incorporated herein by reference as fully as though set forth at
length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of passage of the resolution.
