2 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BER-
NARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF AN EAST -WEST ALLEY
3 LOCATED NORTH OF HIGHLAND AVENUE, EAST OF VALENCIA AVENUE AND RESERVING
PUBLIC UTILITY EASEMENTS THEREIN.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the City of San
Bernardino hereby declares its intention to order the vacation of an east-
west alley located north of Highland Avenue, east of Valencia Avenue, in
said City, which said portion more particularly is describep as follows:
That portion of a certain 20 foot East-West 'alley:'located North
of Hi gh 1 and Avenue, East of Val enci a Avenue" <;lescri bed ,as follows:
Beginning at a point on the Southeast corner of Lot 14~ Tract No.
3464 as per pl at thereof recor.ded i nBook 46 of Mi!pS, ~age 5 re- .,
cords of the County Recorder of San Bernardi no County, state of
California; thence West along the North line of said alley, being
the South line of Lots 14, 15;~16, 1'7 and1gefsaid.Tract No. 3464,
a distance of 400 feet more or ress to'the Southwest corner of
said lot 19, said Southwest corner being on the ,East. line of"said
Valencia Avenue; thence South along said Eilst Jine 9f Valencia.
Avenue, a distance of 20 feet to the SOllt~ li1:ieof said ,alley;
thence East along said South line a distaneeof 402.65 feet more
or less to the most Northeasterly corner of lot 20 of said Tract
No. 3464; thence North il distance of 20 feet'moreor le$s to ;the
point of beginning. ' .
SECTION 2. That the Mayor and Common Council of the City of San
Bernardino, in vacating the above described portion of said Alley, elects
to proceed under and in accordance with the provisions of the "Street
Vacation Act of 1941", being Division 9, Part 3, of the Streets and Highways
Code of the State of California.
SECTION 3. That the hour of 9:30 A.M. on the 16th day of April, 1973,
in the Council Chamber of the City Hall, San Bernardino, California, be, and
the same hereby is fixed as the time and place when and where all persons
interested in or Objecting to the proposed vacation may appear before the
said Mayor and Common Council and offer evidence in relation thereto.

For further particulars as to the proposed vacation of the hereinbefore des-
cribed portion of said Alley, reference is made to that certain map marked
"Plan No. 4398" approved t1arch 5, 1973, on file in the office of the City
Clerk of said City.
SECTION 4. Nothing in this Resolution shall in any way affect or dis-
turb any existing easements for sanitary sewer and appurtenant facilities
and for public utility purposes belonging either to the City of San Bernardino
or to any public utility and there is hereby reserved for future general pub-
lic utility purposes and for this City an easement reasonably necessary to
locate such sanitary sewer and public utility facilities over, in, under,
or across a portion of the real property described hereinbefore and to use,
mai ntai n, repai r, replace or' renew such fad 1 i ti es.
SECTION 5., That thi! Ci ty€ngi neer of the City of San Bernardi no here-
by is directed to cause Notices, of Stre~t Vacation to be posted as required
by the Street Vaca~,ion Act of 1941.
