BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is
8 authorized and directed to execute on behalf of said City
9 an agreement between said City and the State of Calif-
10 ornia acting by and through the California Highway
11

AGREEMENT
THIS AGREEMENT, made and entered into this 1st day of March,
1973, by and between the State of California, acting by and through
the California Highway Patrol and the City of San Bernardino.
WHEREAS, the City of San Bernardino desires to send certain
officers of the San Bernardino Police Department to attend motorcycle
training classes conducted by the State of California, Department
of California Highway Patrol at the California Highway Patrol Academy;
and
WHEREAS, the State of California, Department of California
Highway patrol is willing to furnish such training services and to
allow certain officers of the San Bernardino Police Department to
use its Academy facilities while attending said motorcycle training
classes.
NOW, THEREFORE, the parties do hereby agree as follows:
1. The City of San Bernardino Police Department may utilize
the Academy facilities for attending motorcycle training classes subject
to training space available during the periods specified.
2. The City of San Bernardino police Department may use the
Academy at times mutually agreed upon during the periods April 16
through April 26, 1973; May 7 through May 17, 1973; May 28 through
June 7, 1973; June 18 through June 28, 1973; July 23 through August 2,
1973; August 13 through August 23, 1973; September 3.thro~gh"

3. The State of California, Department of California Highway
Patrol agrees to provide living, dining, and classroom facilities
at a daily rate of Ten Dollars ($10.00) per student for resident
students, and the Motorcycle Training program is provided by
California Highway Patrol instructors at a daily rate of Fifty Dollars
($50.00) per student, based on an eight-hour training day. Due to
the State requirement of establishing training costs as of July 1,
there is a possibility of a rate change for the classes scheduled
after July 1, 1973. This agreement will be amended if a rate change
occurs.
4. As consideration for the use of the Academy facilities, City
of San Bernardino agrees to pay to the State upon receipt of an invoice
an amount not to exceed Nine Thousand Dollars ($9,000.00).
5. The terms of this agreement can only be amended as may be
mutually agreed to in writing by both parties concerned.
6. The City of San Bernardino shall be responsible for paying
any cost incurred by the Department of California Highway Patrol for
facility damage caused by the willful or malicious misconduct of trainees.
7. The City of San Bernardino agrees to indemnify, defend, and
Save harmless the California Highway Patrol, its officers, agents, and
employees from any and all claims and losses accruing or resulting
to any and all contractors, subcontractors, materialmen, and any other
person, firm, or corporation furnishing or supplying work, services,

damaged by the contractor in the performance of this agreement.
8.
Notices and communications hereunder shall be sent to the

The California Highway Patrol has announced the availability of motor-
cycle training to all Law Enforcement Agencies through their motorcycle
training unit, at the C.H.P. Academy in Sacramento.
(See attached announcement)
The training program consists of 82 hours of instructions, over an 11
day period.
The program is fully re-imbursed through the California Commission on
Peace Officers Standard and Training. (Plan "B")
This Department has indicated a desire to send our Traffic Officers
through this training program and have received the necessary agreements
from the C.H.P. for signatures. (See attached agreement)
It is requested that this matter be placed on the next Council Agenda,
for approval and authorization, for the Mayor to execute the agreement.

** ANNOUNCEMENT **
Allied Agency Motorcycle Training
The California Highway Patrol Academy is pleased to announce
that the Motorcycle Training Unit will again be able to provide
training for allied agencies.
This Program consists of 82 hours of instruction over an II-day
period beginning on a Monday and terminating on a Thursday. We
are attaching a Syllabus of Instruction and a current schedule
of classes for your consideration. The training is conducted
on the 224-acre training facility of the California Highway
Patrol Academy in Sacramento.
This instruction is highly individualized with the class size
normally restricted to no more than 12 men. The Academy furnishes
both dirt and full dress motorcycles as well as helmets.
Reimbursement for California agencies is available through the
Commission on Peace Officer Standards and Training (Plan "B").
Please be advised that the facility use costs are currently being
reevaluated, and it is conceivable that a minor rate increase may
be in effect for classes beginning after June 30, 1973. Our
current tuition rates are listed below:
Daily rate for student participation in

include meals, lodging or classroom use

Resident student daily rate includes room,
three meals and use of classroom facilities. $10.00
Non-resident student daily rate includes

Attached is the agreement between the Department of California
Highway Patrol and the City of San Bernardino allowing the City
of San Bernardino Police Department to participate in motorcycle
training classes IV-73 through XIV-73.
This agreement is for your acceptance and signature. Please
secure a certified copy of the resolution authorizing the
signature and return it with all copies of the agreement in
order that we may submit the agreement to the Department of
General Services Legal Office for their approval. This approval
is required on all State agreements which exceed $3,000.
When the agreement has been fully approved, a copy will be
returned to your office for your records.
