The Mayor of the City of San Bernardino is 8 hereby authorized and directed to execute on behalf of said 9 City an Agreement with Sequoia Pacific Systems Corporation 10 relating to election supplies and services for the Primary 11 Municipal Election to be held on March 3, 1987, a copy of 12 which is attached hereto, marked Exhibit "A" and incorporated 13 herein by reference as fully as though set forth at length. 14 I HEREBY CERTIFY that the foregoing resolution was duly 15 adopted by the Mayor and Common Council of the City of San 16 Bernardino at an i'lrJ;jollrnprJ rPQll1i'lr meeting thereof, held on 17 the 22nd day of 18 wit: December , 1986, by the following vote, to 19 20 21 22 23 24 25 26 27 AYES: Council Members Estrada. The parties agree as follows: 9 1. Recitals. 10, (a) The Mayor and Common Council desire to enter 11 I into an agreement to procure election supplies and services 12: I for the Primary Municipal Election (hereafter the "election") I 13'1' to be held on March 3, 1987 in the City of San Bernardino. 14: I (b) Contractor is in the business of furnishing , I 15; election supplies and services and has offered to furnish ! 16 supplies and services upon the terms stated in this agreement. 17 2. city agrees to purchase certain election supplies and 18' services required for the election from the Contractor at the 19 prices and upon the terms stated in this agreement at a cost 20 not to exceed $40,000.00. Contractor agrees ~o prepare and 21 furnish necessary supplies and services in sufficient time to 22 enable City to comply with all requirements of the California 23 Elections Code, the California Government Code, the 24 Constitution of the State of California, the Charter of the I I ! city of San Bernardino, and the San Bernardino Municipal Code. 251 , 26: 27 28 IIII 3. Unit prices shall be as set forth in Contractor's attached proposal, marked Exhibit "I". Actual quantities required may vary from those estimated in the proposal. 4. In addition to the supplies and basic services set forth in Exhibit "I", Contractor will, at no additional charge, furnish the following special services, if and when requested by the City Clerk of City: (a) Provide a detailed calendar of election events, setting out dates and requirements of the California Elections Code. (b) Assist in the conduct of election officers' instruction classes as to proper use of DATAVOTE Voting System and general polling place procedures. (c) Provide a qualified computer operator on election day for ballot tabulation, and supervise all counting center procedures. (d) Provide all materials (logs, seals, procedures, etc.) necessary for the central counting center. (e) Make arrangement for delivery of sample ballot booklets to the U.S. Post Office in San Bernardino. (f) Package official ballots, precinct supplies, and other necessary materials, ready for delivery to inspectors. (g) Furnish general guidance throughout the election process. 5. The bill or claim shall show the quantity and 3 character of each supply and service furnished and the sum 4 payable computed at the appropriate unit price. Contractor is not required to provide or pay for i 91 indexes to the Great Register, precinct maps, postage expense tol for mailing of election officer's forms, compensation of II! election officers, sums payable for use of polling places or 12i costs of publication of notices. 13i 7. Contractor agrees that it will place on file with the 14! city Clerk of City, within ten days after the execution of , 151 this agreement, a corporation surety bond or an irrevocable I 1 161 instrument of credit in a form satisfactory to the City I 17!
