RESOLUTION NO. /,.d.;> 02 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF A FIRST AMENDMENT TO AGREEMENT WITH RUHNAU, EVANS, RUHNAU ASSOCIATES RELATING TO ARCHITECTURAL SERVICES IN CONNECTION WITH THE MULTI-PURPOSE CENTER FOR INDIVIDUALS WITH DISABILITIES. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is authorized and directed to execute on behalf of said City a First Amendment to Agreement with Ruhnau, Evans, Ruhnau Associates relating to the performance of architectural services in connec- tion with the Multi-Purpose Center for Individuals with Dis- abi1i ties, a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. FIRST AMENDMENT TO AGREEMENT (Architectural Services) THIS FIRST AMENDMENT TO AGREEMENT is made and entered into this J~ day of '-l~d~ ,1978, by and between the . CITY OF SAN BERNARDINO, a municipal corporation, hereinafter referred to as "Owner", and RUHNAU, EVANS, RUHNAU ASSOCIATES, hereinafter referred to as "Architect". WIT N E SSE T H: WHEREAS, Owner and Architect entered into an Agreement on November 16, 1977, whereby Architect agreed to perform certain architectural services pertaining to the development of the Center for Individuals with Disabilities for Owner; and WHEREAS, since the execution of that Agreement the scope of the project has been altered by agreement by the County of San Bernardino, and the San Bernardino Unified School District to join with the Owner in the development of the project; and WHEREAS, Owner now desires to amend the Agreement in order to bring the existing agreement into line with the terms of the Joint Power Authority Document by including the North Norton Park and Community Building; NOW, THEREFORE, it is mutually agreed between the parties as follows: 1. The project description on page 1 is amended to read as follows: "The Multi-purpose Center for Individuals with Disabilities, North Norton Park and Community Building, are to be located north of 4th Street at Palm Lane on parcel 279-042-09, County of San I Bernardino. I Exhibi t "A" -----------,---~;? -..-.-.~",-,,~ "^t i. oj. .._.,,' 1 2 3 The architectural services to be performed in two phases, are as follows: PHASE I - A Master Plan including site and floor plans, 4 exterior, and such other details as necessary to depict the total 5 projected project. 6 PHASE II - Complete Design Development Construction Docu- 7 ments, Bidding or Negotiation Phase and Construction Phase for the g total projected project to be constructed under the terms and con- 9 ditions of the Joint Power Authority Agreement between the City of 10 San Bernardino and the County of San Bernardino establishing the I. . AuthorJ.ty for the HandJ.capped of San Bernardino County." 11 12 2. Article 14, paragraph 14.2.1 on page 9 is amended to 13 read as follows: 14 "PHASE I - A fixed fee of thirty-five thousand dollars 15 ($35,000.00) payable upon completion of services performed under 16 this phase. 17 PHASE II - Eight percent (8%) of the actual construction 18 costs or of the latest detailed estimate of construction cost, 19 whichever is the lesser. 20 The proportional share of the fee paid under Phase I shall 2] be credited to the fee paid under Phase II based on a ratio of the 22 total estimated cost of the master planned project to the esti- 23 mated or actual cost of the project which is constructed. 24 In the event California Energy Conservation standards for 25 non-residential building require systems engineering, completion 26 of forms, and calculations prior to start of construction, the 27 Architect will be reimbursed for cost incurred not to exceed two thousand dollars ($2,000.00)." 28 v' -2- " , . -. - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 """'-" '---- '.: ,. -,"'(''1'1' . ,',^ '~, {';:" .,,,~:~n,,._: ,'.i:'2<"l ~ " 3. All other terms, conditions and covenants of said Agreement shall remain the same and be in full force and effect. IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to Agreement on the date first hereinabove written.
