Synopsis of Previous Council Action:
10/04/2004—Resolution No. 2004-322 was adopted, approving an Agreement with the San Manuel
Band of Mission Indians for public improvement projects for tribal project impacts.
01/10/2005 - Resolution No. 2005-08 was adopted approving an Agreement for Professional
Services with Engineering Resources of Southern California to provide civil and traffic engineering
services relative to the widening, realignment and beautification of Victoria Avenue, from Highland
Avenue to Lynwood Drive.
04/17/006 — Mitigated Negative Declaration and the Mitigated Monitoring/Reporting Program
for Victoria Avenue Street Improvement and Beautification Project was approved.
08/07/2006 - Resolution 2006-284 was adopted, approving FY 2006/2007 through FY 2010/2011
Capital Improvement Program.

Staff Report
SUBJECT:
Resolution accepting fair market value and authorizing payment for the acquisition of an
easement across San Bernardino County Flood Control property relative to the widening of
Victoria Avenue, north of Highland Avenue.
BACKGROUND:
In October of 2004, approval was given for an Agreement with San Manuel Band of Mission
Indians for public improvement projects for tribal project impacts. Pursuant to this Agreement,
the Tribe contributed $5,500,000 to the City to address traffic impacts on Victoria Avenue
between Highland Avenue and Lynwood Drive.
In January of 2005, an Agreement for Professional Services with Engineering Resources of
Southern California to provide civil and traffic engineering services relative to the widening,
realignment, beautification, and appurtenant improvements of Victoria Avenue, from Highland
Avenue to Lynwood Drive was approved.
In April of 2006, the Mitigated Negative Declaration and the Mitigated Monitoring/Reporting
Program for Victoria Avenue Street Improvement and Beautification Project was approved.
In August of 2006, the City's Capital Improvement Program for FY 2006/2007 through
2010/2011 was approved, which includes the Victoria Avenue improvements (CEP No. SS05-
25).
A portion of the widening of Victoria Avenue requires the acquisition of a 16 foot wide right
of way easement across San Bernardino County Flood Control District Property, located along
the west side of Victoria Avenue. The County has prepared a narrative valuation of the
property and determined the value of this easement to be $18,200.00. Staff has reviewed the
appraisal and based on comparative data included in the appraisal, concurs with the valuation.
The attached resolution determines the fair market value as submitted in the appraisal, and
authorizes the payment of$18,200.00 for the acquisition of the easement. A summary of the
appraisal and plat map is attached.
INANCIAL IMPACT:
$18,200.00 to be paid from 246-366-5504-7552 (Public Improvement Fund—CIP No. SS05-25).

SUBJECT: APPRAISAL OF THE PATTON BASIN FOR A PARTIAL ACQUISITION IN
EASEMENT FOR THE VICTORIA AVENUE STREET WIDENING PROJECT, CITY OF SAN
BERNARDINO - FILE NO. F00852
As requested, I have prepared a summary appraisal report of the estimated fair market
value of the Patton Basin land owned and operated by the San Bernardino County Flood
Control District. The subject property is composed of three contiguous parcels that have
been largely excavated to create a flood retention basin for the purpose of draining the San
Bernardino National Forest foothills and provide flood protection to the surrounding
residential and commercial properties in this location. Two of these three parcels are
affected by the proposed acquisition and are identified as Assessor Parcel Numbers 0285-
164-01 and 0285-742-05. Parcel Number 0285-742-12, though identified as part of the
legal larger parcel, is not affected by the acquisition proposed.
The legal larger parcel contains a total of 23.76 acres. The City of San Bernardino
requested 23,829 square feet in easement, which amounts to a 16-foot wide strip of land
along the Victoria Avenue frontage, for purposes of widening Victoria Avenue. The
documents are in the body of this report.
The purpose of this appraisal is to estimate the fair market value of the area to be acquired
in easement from the Flood Control District for the purpose widening Victoria Avenue.
The City of San Bernardino requested the right-of-way as the street is in the city's
jurisdiction.
The client of this report is the San Bernardino County Board of Supervisors. Intended
users include, along with the Board of Supervisors, the County Flood Control District, the
Real Estate Services Department, and the County Counsel. Assignees, as directed by the
Board of Supervisors, may be users of this report.
This appraisal analyzes the value of the 23.76-acres known as the Patton Basin, and goes
on to value the easement area to be acquired. I personally inspected the subject property,
and have gathered all the data I considered necessary to arrive at the value conclusions.
The effective date of value is the last date of inspection of the subject site, which is July
13, 2006. The date of the report is July 21, 2006.
MThe fair market value estimate of the County Flood Control Land to be acquired in
easement is summarized as follows:
$0.80/sq. ft. x 23,829 square feet x 95% interest= $18,110*

WHEREAS, the City of San Bernardino desires to acquire an easement for road

purposes across approximately 23,829 square feet of that certain real property located along the

10 west side of Victoria Avenue, north of Highland Avenue, being a portion of two contiguous
11 parcels of real property referenced as Assessor's Parcel Numbers 0285-164-01 and 0285- 742-05,
12 and more fully described in Exhibit "A" and as shown on a plat map marked Exhibit "B", both
13 attached hereto and made a part hereof, relative to the widening of Victoria Avenue; and
14 WHEREAS. the San Bernardino County Flood Control District is the record owner of
15
said real property to be acquired: and

WHEREAS, an appraisal has been prepared by the County of San Bernardino Real
17
18 Estate Services Department, by a California certified general appraiser; and
19 WHEREAS. City has reviewed the appraiser's determination of the fair market value
20 of the land and the report thereon; and
21 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
22 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
23 SECTION 1. That said real property owned by the San Bernardino County Flood
24 Control District, more fully described in said Exhibit "A" and as shown on said Exhibit "B", is
25 hereby determined to have a fair market value of$18,200.00 as determined by said appraiser.

SECTION 2. Payment to the San Bernardino County Flood Control District in the
27
amount of 518,200.00 for the acquisition of said easement for road purposes is hereby
28
authorized.
