This is the time and place heretofore set for an Adjourned
Regular Meeting of the Mayor and Common Council of the City of
San Bernardino at their Regular Meeting held Monday, September
19, 1983, at 9:01 a.m., in the Council Chambers of City Hall,
300 North "0" Street, San Bernardino, California.
The City Clerk has caused to be posted the Order of Adjourn-
ment of said meeting held Monday, September 19, 1983, at 9:01
a.m., and has on file in the Office of the City Clerk an affidavit
of said posting together with a copy of said Order which was
posted on Monday, September 19, 1983, at 3:30 p.m., in the Council
Chambers of City Hall, 300 North "0" Street, San Bernardino,
California.
The Adjourned Regular Meeting of the Mayor and Common Council
of the City of San Bernardino was called to order by Mayor Holcomb
at 9:07 a.m., on Friday, September 23, 1983, in the Council Cham-
bers of City Hall, 300 North "0" Street, San Bernardino, Califor-
nia.
INVOCATION
The Invocation was given by Reverend R. L. MCDonald, Pastor
of Little Zion Missionary Baptist Church.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Council Member Reilly.
ROLL CALL
Roll Call was taken by the City Clerk with the following be-
ing present: Mayor Holcomb; Council Members Castaneda, Reilly,
Hernandez, Marks, Quiel, Frazier, Strickler; City Attorney Prince,
City Clerk Clark, City Administrator Matzer. Absent: None.
BUDWEISER PRESENTATION - MAYOR HOLCOMB
Joe Baca of Budweiser presented a plaque to Mayor Holcomb by
the San Bernardino Budweiser Stars and also acknowledged Fire
Captain Chuck Ransom for assistance during the recent floods.
RECESS MEETING - CLOSED SESSION - REDEVELOPMENT AGENCY
At 9:18 a.m., the Adjourned Regular Meeting of the Mayor and
Common Council of the City of San Bernardino recessed for a
Closed Session.
CLOSED SESSION
The Closed Session of the Mayor and Common Council of the
City of San Bernardino was called to order by Chairman Holcomb
in the Conference Room of the Council Chambers of City Hall, 300
North "0" Street, San Bernardino, California.
ROLL CALL
Roll Call was taken with the following being present: Chair-
man Holcomb; Council Members Castaneda, Reilly, Hernandez, Marks,
Quiel, Frazier, Strickler; City Attorney Prince, City Clerk Clark,
City Administrator Matzer. Absent: None.
Also present were Glenda Saul, Acting Executive Director of
the Redevelopment Agency, and Bill Flory, Agency Counsel.
ADJOURN CLOSED SESSION
At 9:42 a.m., the Closed Session of the Mayor and Common
Council of the City of San Bernardino adjourned to the Adjourned
Regular Meeting in the Council Chambers of City Hall, 300 North
"0" Street, San Bernardino, California.
RECONVENE MEETING
At 9:42 a.m., the Adjourned Regular Meeting of the Mayor and
Common Council of the City of San Bernardino reconvened in the
Council Chambers of City Hall, 300 North "D" Street, San Bernar-
dino, California.
ROLL CALL
Roll Call was taken by the City Clerk with the following be-
ing present: Mayor Holcomb, Council Members Castaneda, Reilly,
Hernandez, Marks, Quiel, Frazier, Strickler, City Attorney Prince,
City Clerk Clark, City Administrator Matzer. Absent: None.
RES. 83-321 - RESOLUTION OF THE CITY OF SAN BERNAR-
DINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH
MOHLE, GROVER AND ASSOCIATES RELATING TO THE PROVI-
SION OF TRAFFIC ENGINEERING SERVICES BY MR. ROBERT
R. WIRTS. (4)
The City Clerk read the title of the resolution.
Council Member Quiel made a motion, seconded by Council Mem-
ber Castaneda and unanimously carried, that further reading of
the resolution be waived and said resolution be adopted.
Resolution No. 83-321 was adopted by the following vote:
Ayes: Council Members Castaneda, Reilly, Hernandez, Marks, Quiel,
Frazier, Strickler. Noes: None. Absent: None.
Council Member Olliel made a motion, seconded by Council Mem-
ber Castaneda and unanimously carried, that the transfer of
$10,285.00 from Account No. 01-295-001 (Salaries-Regular), to
Account No. 01-295-252 (Professional Contractural Services), be
approved.
COUNCIL MEMBER STRICKLER EXCUSED
Council Member Strickler was excused from the Council Meeting.
APPOINTMENT - MARSHALL - BUILDING COMMISSION
Pursuant to the recommendation of Council Member Frazier,
Mayor Holcomb appointed James Marshall of 1360 Colorado Street to
serve as a member on the Building Commission.
Council Member Frazier made a motion, seconded by Council
Member Reilly and unanimously carried, that the appointment be
confirmed.
APPOINTMENT - THOMPSON - CEMETERY COMMISSION
Pursuant to the recommendation of Council Member Frazier,
Mayor Holcomb appointed Alonza L. Thompson of 1807 Cleveland
Street to serve as a member on the Cemetery Commission.
Council Member Frazier made a motion, seconded by Council
Member Reilly and unanimously carried, that the appointment be
confirmed.
APPOINTMENT - SIMPSON - COMMUNITY TELEVISION COMMISSION
Pursuant to the recommendation of Council Member Frazier,
Mayor Holcomb appointed Alvin Simpson of 1740 West 19th Street
to serve as a member on the Community Television Commission.
Council Member Frazier made a motion, seconded by Council
Member Reilly and unanimously carried, that the appointment be
confirmed.
APPOINTMENT - MASSEY - COMMUNITY DEVELOPMENT CITIZEN
ADVISORY COMMITTEE
Pursuant to the recommendation of Council Member Frazier,
Mayor Holcomb appointed Mary Massey of 1506 West Gilbert Street,
to serve as a member on the Community Development Citizen Ad-
visory Committee.

Council Member Frazier made a motion, seconded by Council
Member Reilly and unanimously carried, that the appointment be
confirmed.
APPOINTMENT - JOHNSON - COMMISSION FOR DISABLED PERSONS
Pursuant to the recommendation of Council Member Frazier,
Mayor Holcomb appointed Albert Johnson of 1589 West 16th Street,
to serve as a member on the Commission for Disabled Persons.
Council Member Frazier made a motion, seconded by Council
Member Reilly and unanimously carried, that the appointment be
confirmed.
APPOINTMENT - SCOTT - BUREAU OF FRANCHISES
Pursuant to the recommendation of Council Member Frazier,
Mayor Holcomb appointed Juanita Scott of 1595 Massaro Lane to
serve as a member on the Bureau of Franchises.
Council Member Frazier made a motion, seconded by Council
Member Reilly and unanimously carried, that the appointment be
confirmed.
APPOINTMENT - PEREZ - HUMAN SERVICES COMMISSION
Pursuant to the recommendation of Council Member Frazier,
Mayor Holcomb appointed John Perez, Sr. of 1159 West Magnolia
Avenue to serve as a member on the Human Services commission.
Council Member Frazier made a motion, seconded by Council
Member Reilly and unanimously carried, that the appointment be
confirmed.
APPOINTMENT - JACKSON - PARK AND RECREATION COMMISSION
Pursuant to the recommendation of Council Member Frazier,
Mayor Holcomb appointed Stanley Jackson of 1361 Colorado Street
to serve as a member on the Park and Recreation Commission.
Council Member Frazier made a motion, seconded by Council
Member Reilly and unanimously carried, that the appointment be
confirmed.
APPOINTMENT - WATSON - PLANNING COMMISSION
Pursuant to the recommendation of Council Member Frazier,
Mayor Holcomb appointed Warren G. Watson of 1465 Madison Street,
to serve as a member on the Planning Commission.
Council Member Frazier made a motion, seconded by Council
Member Reilly and unanimously carried, that the appointment be
confirmed.
APPOINTMENT - KING - POLICE COMMISSION
Pursuant to the recommendation of Council Member Frazier,
Mayor Holcomb appointed George H. King of 2976 Gardena Street to
serve as a member on the Police Commission.
Council Member Frazier made a motion, seconded by Council
Member Reilly and unanimously carried, that the appointment be
confirmed.
COUNCIL MEMBER STRICKLER RETURNED
Council Member Strickler returned to the Council Meeting and
took his place at the Council Table.
RECONSIDER PREVIOUS ACTION - STREET CLOSURE - ARROWHEAD
AVENUE, BETWEEN "D" STREET AND KENDALL DRIVE
Council Member Quiel made a motion, seconded by Council Mem-
ber Strickler, to reconsider the action of September 19, 1983
which continued the matter regarding the installation of a cul-
de-sac at the northern terminus of Arrowhead Avenue, between "D"
Street and Kendall Drive, to October 10, 1983.

The motion carried by the following vote: Ayes: Council
Members Castaneda, Reilly, Marks, Quiel, Frazier, Strickler.
Noes: None. Absent: None. Abstain: Council Member Hernandez.
A memorandum dated September 20, 1983 was received from Coun-
cil Member Strickler recommending that action be initiated for the
closure of Arrowhead Avenue and that a cul-de-sac be installed at
the northern terminus of Arrowhead Avenue, between "D" Street and
Kendall Drive. He stated in his memorandum that citizens in this
neighborhood presented a petition to the City requesting action
on implementing appropriate traffic controls designed to slow
vehicular traffic in this area as the residents have endured
speeding motorists, damage to their property and potential danger
to their lives.
Council Member Quiel made a motion, seconded by Council Mem-
ber Strickler, that the Director of Public Works/City Engineer be
directed to implement appropriate action for closure of Arrowhead
Avenue as recommended by California Department of Transportation
and install a cul-de-sac at the northern terminus of Arrowhead
Avenue, between "D" Street and Kendall Drive. Funding source to
be identified and approved by the City Administrator.
The motion carried by the following vote: Ayes: Council
Members Castaneda, Reilly, Marks, Quiel, Frazier, Strickler.
Noes: None. Absent: None. Abstain: Council Member Hernandez.
RES. 83-322 - RESOLUTION OF THE CITY OF SAN BERNAR-
DINO AUTHORIZING ACCEPTANCE OF EASEMENTS FROM CITY
OF RIVERSIDE FOR AMERICAN CENTER PROJECT, AND AUTHO-
RIZING THE CITY CLERK TO EXECUTE ACCEPTANCE.
(Gage Canal, Waterman Avenue/Hospitality Lane area)
The City Clerk read the title of the resolution.
Council Member Quiel made a motion, seconded by Council Mem-
ber Strickler and unanimously carried, that further reading of
the resolution be waived and said resolution be adopted.
Resolution No. 83-322 was adopted by the following vote:
Ayes: Council Members Castaneda, Reilly, Hernandez, Marks, Quiel,
Frazier, Strickler. Noes: None. Absent: None.
RECONSIDER PREVIOUS ACTION - CHANGE OF ZONE NO. 83-17
Council Member Frazier made a motion, seconded by Council
Member Quiel and unanimously carried, that the following Planning
item be reconsidered:
That the application for Change of Zone No. 83-17,
San Bernardino westside Community Development Cor-
poration, applicant, to change the land use zoning
district from C-3A Limited General Commercial, "T"
Transitional and R-1-7200 Single-Family Residential
to C-3A Limited General Commercial for an irregularly-
shaped parcel of land consisting of approximately 1.64
acres having a frontage of approximately 158 feet on
the south side of Base Line and being located approxi-
mately 550 feet east of the centerline of Pennsylvania
Avenue and further described as 1777 West Base Line, be
recommended for approval of "T" Transitional zoning.
On September 19, 1983, the Mayor and Common Council continued
this matter to October 24, 1983.
Council Member Frazier made a motion, seconded by Council
Member Quiel and unanimously carried, that the hearing be reset
to Monday, October 10, 1983, at 9:00 a.m., in the Council Chambers
of City Hall, 300 North "D" Street, San Bernardino, California.

The Mayor and Common Council discussed street improvements
and cultural arts funding as opposed to social service funding.
Council Member Marks made a motion, seconded by Council
Member Quiel and unanimously carried, to indicate that the
specific allocation amount for 1983-84 arts funding be reduced
to $75,000 and set the $25,000 back into reserves and ask the
Ways and Means Committee to come back with a recommendation on
the social services funding for those agencies recommended by
the Human Services Commission but not funded. (Not necessarily
new agencies)

DINO APPROVING AND ADOPTING THE FINAL BUDGET OF
SAID CITY FOR THE FISCAL YEAR 1983-1984 (3)

SALARY NEGOTIATIONS, CONTRACT PROBLEMS - SAN BERNAR-
DINO AND RIALTO FIREFIGHTERS LOCAL 891 - CONTINUED
FROM SEPTEMBER 19, 1983
This is the time and place continued to for discussion
regarding salaries, etc. (1)
1. Report from City Administrator regarding health
insurance under present City Plan
2. Report from City Attorney regarding new informa-
tion from Firefighters concerning selected cities
under Section 186
An opinion dated September 22, 1983 was received from
Ralph H. Prince, City Attorney, which states that salaries are
to be fixed on August 1 each year. At that time, ten compari-
son cities are to be chosen from a specific publication, the
latest Annual Report of Financial Transactions of California
Cities, published by the State Controller.
The opinion also states that since the latest published
Annual Report which has been printed and deposited in an
official state depository for government documents is the Annual
Report issued in May, 1982, then that is the Annual Report which
must be used by the City and the firefighters, as well as the
police safety employees, in selecting comparison cities for
salary setting. Therefore, salaries for police and fire safety
employees for 1983-1984 are to be set on the basis of the
salaries in ten comparison cities selected from the Annual Report
of Financial Transactions of California Cities published by the
State Controller in May, 1982.

the Conference Room of the Council Chambers of City Hall, 300
North "D" Street, San Bernardino, California.

Roll Call was taken by the City Clerk with the following be-
ing present: Mayor Holcomb; Council Members Castaneda, Reilly,
Hernandez, Marks, Quiel, Frazier, Strickler, City Attorney Prince,
City Clerk Clark, City Administrator Matzer.
Also present were Ray Schweitzer, Deputy City Administrator,
and Manuel Moreno, Superintendent of Public Services.

At 11:10 a.m., Council Member Hernandez was excused from

DINO DESIGNATING THE COUNTY OF SAN BERNARDINO AS
CITY'S AGENT FOR SERVICE OR PROCESS FOR ANY AND ALL
ACTIONS BROUGHT AGAINST THE CITY UNDER THE PROVISIONS
OF REVENUE AND TAXATION CODE SECTION 5096, ET SEQ.,
AND REQUESTING SAN BERNARDINO COUNTY COUNSEL TO
PROVIDE DEFENSE FOR THE CITY OF SAN BERNARDINO IN
PENDING LAWSUIT AND SIMILAR LAWSUITS.

Member Castaneda and unanimously carried, that further reading

Council Member Castaneda made a motion, seconded by Council
Member Quiel and unanimously carried, that the following memo-
randum dated September 19, 1983 from Ralph H. Prince, City
Attorney, to the Mayor and Common Council and Community Develop-
ment Commission, be spread upon the minutes:

At the meeting of March 28, 1983, my 1% interest
in the San Bernardino Associates and University
Shopping Center partnership which own land in the
Northwest Redevelopment Project area was disclosed
as had been done on prior occasions.
A depiction of the area in Project Area "B" where
the land is generally located is shown on the map
marked "I" attached hereto.
Please make this memorandum a part of your minutes.
