'(CoIll1'1erce Pl'aza) 60,009-18-2 1 RESOLUTION NO. 83-425 2 RESOLUTION OF THE MAYOR AND COMMON 3 COUNCIL OF THE CITY OF SAN BERNARDINO, 4 APPROVING THE ISSUANCE BY THE CITY OF 5 ITS "CITY OF SAN BERNARDINO INDUS- 6 TRIAL DEVELOPMENT REVENUE BONDS, SERIES 7 1983A (TRI-CITIES INVESTMENT COMPANY 8 COMMERCE PLAZA PROJECT)" AND MAKING 9 CERTAIN DETERMINATIONS RELATING THERE- 10 TO (TEFRA) 11 (TRI-CITIES INVESTMENT COMPANY 12 COMMERCE PLAZA PROJECT) 13 WHEREAS, pursuant to Ordinance No. 3815 (the 14 "Law") the City intends to finance a multi-tenant office/ 15 warehouse complex located at 155 Hospitality Lane and 165 16 Hospitality Lane in San Bernardino, California (the 17 "Project"); and 18 WHEREAS, the City has taken proceedings leading 19 toward the issuance and sale of its "City of San Bernardino 20 Industrial Development Revenue Bonds, Series 1983A (Tri- 21 Cities Investment Company Commerce Plaza Project)", to 22 obtain moneys to finance the Project, all under and in 23 accordance with said Ordinance No. 3815, and the Constitution 24 and laws of the State ,of California; and #346.5(bs) 11/19/83 ) ., San Bern. ,( Comn\~rceP laza) 60,0',)9-18-2 1 WHEREAS, pursuant to the Tax Equity and Fiscal 2 Responsibility Act of 1982, the issuance of the Bonds must 3 be approved by an elected representative of the City after 4 a public hearing; and 5 WHEREAS, the City Clerk has caused notice of such 6 public hearing to be published once a week for two weeks 7 (giving at least fourteen days' notice) in The Sun and has 8 reported to the Mayor and Common Council that such notice 9 has been duly and regularly given; and 10 WHEREAS, the subject matter of the Hearing was the 11. proposed financing by the City of the Project in an amount 12 of not to exceed $3,200,000; and 13 WHEREAS, at the time and place stated in said 14 Notice, the financing of the Project was presented, and any 15 and all persons who so desired appeared and were heard, and 16 the Mayor and Common Council are fully informed in the 17 premises. 18 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF 19 THE CITY OF SAN BERNARDINO, CALIFORNIA, DO HEREBY RESOLVE, 20 DETERMINE AND ORDER AS FOLLOWS: 2 #346.5(bs) 11/19/83 ~ San Bern. {Co~erce Plaza) 60,009-18-2 1 Section 1. The above recitals are true and correct 2 in all respects; and all actions heretofore taken by or at 3 the direction of the City and its officers directed toward 4 the sale and issuance of the Bonds therefor are hereby 5 approved and ratified. 6 Section 2. The issuance by the City of its "City 7 of San Bernardino Industrial Development Revenue Bonds, 8 Series 1983A (Tri-Cities Investment Company Commerce Plaza 9 Project)" in an amount not to exceed $3,200,000 is hereby 10 approved and the Mayor is hereby authorized and directed to 11 execute this Resolution pursuant to said Tax Equity and 12 Fiscal Responsibility Act of 1982. 13 Section 3.
