RESOLUTION NO. 83-422
2 RESOLUTION OF THE CITY OF SAN BERNARDINO IMPOSING LIENS ON
CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN
3 IBERNARDINO FOR THE COSTS OF THE ABATEMENT OF A PUBLIC NUISANCE.
(450 - 467 South Pear, 115 - 123 East 2nd Street, 795 East 40th
4 Street, 2816 West 6th Street).

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
BERNARDINO AS FOLLOWS:

SECTION 1. The City of San Bernardino, pursuant to its
8 authority under San Bernardino Municipal Code Section 3.68.020 and
9 San Bernardino Municipal Code Chapters 8.18, 8.27, 8.30, 8.33 and
10 15.28 and other laws, did lawfully cause public nuisance
11 abatements on projects on the real property described on Exhibit
12 "A", attached hereto and incorporated by reference as fully as
13 though set forth at length. The last known owners of record as to
14 each such parcel are also specified in Exhibit "A".
15 Due notice was given to the person or persons having an
16 interest in said property and a hearing was held by the Board of
17 Building Commissioners to hear protests and to assess the costs of
18 said abatements on said property. The Board of Building
19 Commissioners has entered its order determining the costs to be
20 reasonable and proper, and imposing a lien upon the land involved.
21 Notice of the right of appeal to the Mayor and Common Council has
22 been issued to all affected property holders. The Board of
23 Building Commissioners now requests that the Mayor and Common
24 Council confirm the imposition of the lien.

SECTION 2. The matter having now come before the Mayor and
26 Common Council for hearing on confirmation of the imposition of
27 the lien imposed, and a hearing thereon having been held, the
28 following costs are found to have been duly incurred by the City

1 pursuant to proceedings under said provisions of the San
2 Bernardino Municipal Code and the final statements of costs on
3 file with the City Clerk are hereby confirmed and adopted as
4 special assessments:

9 The legal description of each parcel is detailed on Exhibit "A".

SECTION 3. If said sum is not fully paid to the City Clerk,
11 City Hall, San Bernardino, within five (5) days after the adoption
12 of this resolution as to any such individual parcel, then said sum
13 shall be and become a lien on said property pursuant to said
14 Municipal Code provisions and applicable laws and shall be
15 collected as a special assessment thereon.

SECTION 4. In the event said sum is not paid as hereinabove
17 provided, the City Clerk is hereby directed to file a certified
18 copy of this resolution with the Auditor of the County of San
19 Bernardino, State of California, directing that said sum be
20 entered as lien charges against said property as it appears on the
21 current assessment rolls, to be collected at the same time and in
22 the same manner, subject to the same penalties and interest upon
23 delinquencies, as the general taxes for the City of San Bernardino
24 are collected. The City Clerk shall also present for recording
25 appropriate notices of the imposition of these liens with the
26 County Recorder.
27 I HEREBY CERTIFY that the foregoing resolution was duly
28 adopted by the Mayor and Common Council of the City of San
