BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: I I I SECTION 1. Brenton Lee Rhoades is determined to be the lowest responsible bidder for construction of a public project, to- wit: Corrective Grading and Drainage for Tract Nos. 9995 and 10304, in accordance with Plan No. 6429, for the total amount of $46,536.00; a contract is awarded to said bidder accordingly, but such award shall be effective only upon the contract being fully executed by the parties; all other bids therefor are hereby rejected; and the Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2. The City of San Bernardino shall not be obligated by making this award unless and until the contract is fully executed and no oral agreement relating thereto is intended or authorized and should not be implied. " \N +0- r IT' M.J J:>, 0 $ 0 0') 0 " W -; r . m 'IU J:>, r ? )> ~ t-' m --J :D ~ I ~ I\) (J1 Ul ;;; \N N I N co \N SPECIAL PROVISIONS SECTION I SPECIFICATIONS AND PLANS 1-1.01 GENERAL -- The work embodied herein shall be done in accordance with the Standard Specifications for Public Works Construction, 19 Edition, and City of San Bernardino Standard Drawings, insofar as the same may apply and in accordance with the following special provisions. 1-1.02 DEFINITIONS -- Whenever in the Standard Specifications the following terms are used, they shall be understood to mean and refer to the following: Agency - The City of San Bernardino. Board - The Mayor and Common Council for the City of San Bernardino. Engineer - The Director of Public Works/City Engineer for the City of San Bernardino. Labora tory The laboratory to be designated by the City of San Bernardino to test materials and work involved in the contract. Notice Advertising for Bids Notice Inviting Bids. Standard Specifications Standard Specifications for Public Works Construction. Other terms appearing in the Standard Specifications, and these Special Provisions, shall have the intent and meaning specified in Section 1-2, "Definitions," in the Standard Specifications. In case of conflict between the Standard Specifications and these Special Provisions, the Special Provisions shall take precedence over and be used in lieu of such conflicting portions. SP-l I I SECTION 2 2-1 PROPOSAL REQUIRErlENTS ANO CONDITIONS 2-1.01 GENERAL -- Bids must be submitted on the proposal form contained herein. All bids or proposals shall be signed, sealed and accompanied by cash, cashier's check, certified check or bid bond made payable to the City of San Bernardino, in the amount of ten percent (10%) of the bid. Such cash, check or bond shall be given as a guarantee that the bidder will enter into the contract, if awarded to him. In the event the bidder, to whom the contract is awarded, refuses to execute said contract, the use by the public of the improvements will be delayed and the public will suffer great damage. From the nature of the case, it would be extremely difficult and impractical to fix said amount of damage. Therefore, the City and the bidder agree that the proposal guarantee of 10% of the bid shall be paid to the City upon the con- ditions set forth above as liquidated damages and not as a forfeiture. Bid bonds shall be underwritten by a surety company having a rating in Best's most recent Insurance Guide of "A" or better. SECTION 3 3-1 AWARD AND EXECUTION OF CONTRACT 3-1.01GENERAL -- Award of the contract will normally be made by the Mayor and Common Council at the subsequent Council Meeting after opening of the bids. The bidder, to whom the contract is awarded, shall file with the Engineer all required bonds and insurance policies, and execute the contract, within 10 calendar days after receiving notification of the award. Failure to file the stipulated documents and execute the contract within the prescribed time shall constitute good and sufficient grounds for recession of the award and payment of 10% of the bid to the City as liquidated damages. 3-1.02 CONTRACT BONDS -- The Payment and Faithful Performance Bonds shall be filed with the Engi neer before the contract is executed by the City in accordance with Section 2-4, "CONTRACT BONDS," of the Standard Specifications. SECTION 4 4-1, CONSTRUCTION SCHEDULE AND COMMENCEMENT OF WORK, TIME OF COMPLETION AND LIQUIDATED DAMAGES 4-1.01 -- Attention is directed to the provisions in Section 6-1, "Construction Schedule and Commencement of \~ork," in Section 6-7.1, "Time of Completion," and in Section 6-9, "Liquidated Damages," of the Standard Specifications and these special provisions. The Contractor shall dil igently prosecute the work to completion before the expiration of .3ll WORKING DAYS from the date of the "NOTICE TO PROCEED." The Contractor shall pay to the City of San Bernardino the sum of $100.00 per day, for each calendar days delay in finishing the work in excess of the number of working days prescribed above. SP-2 I SECTION 5 5-1 LEGAL REQUIREMENTS 5-1.01 LIABILITY INSURANCE -- The Contractor's attention is directed to Section 7-3, "liability Insurance," of the Standard Specifications, providing that the Contractor shall furnish the City with a policy or certificate of liability insurance as prescribed therein, prior to execution of the contract. 5-1.02 WORKMEN'S COMPENSATION INSURANCE -- The Contractor's attention is directed to Section 7-4, "Workmen's Compensation Insurance," of the Standard Specifications, providing that the Contractor shall file a signed certification Certificate of Workmen's Compensation Insurance before execution of the contract. 5-1.03 PAYMENT OF PREVAILING WAGE RATE -- The Contractor and all sub- contractors shall pay each craft or workmen employed on this project not less than the prevailing wage rates specified in Resolution No. 12846 of the Mayor and Common Council of the City of San Bernardino. The Engineer shall have the right to interview any craft or workman on the project site in order to verify payment of prevailing wage rates in accordance with Resolution No. 12846. 5-1.04 PAYROLL RECORDS -- The Contractor's attention is directed to the following provisions of Labor Code Section 1776 (Stats. 1978, Ch. 1249). The Contractor shall be responsible for the compliance with these provisions by his subcontractors. (a). The contractor and all subcontractors shall keep an accurate payroll record, showing the name address, social security number, work classification, straight time and overtime hours worked each day and week, and the actual per deim wages paid to each journeyman, apprentice, worker, or other employee employed by him or her in connection with the public work. (b). The payroll records enumerated under subdivision (a) shall be certified and shall be available for inspection at all reasorable hours at the principal office of the contractor on the following basis: (1). A certified copy of an employee's payroll record shall be made available for inspection or furnished to such employee or his or her authorized representative on request. (c). Each contractor shall file a certified copy of the records enumerated in subdivision (a) with the Engineer on a weekly basis. It will be the Contractor's responsibility to submit the records enumerated in subdivision (a) for all of his subcontractors, in addition to his own employees. Failure to submit the records enumerated in subdivision (a) on a timely basis shall constitute good and sufficient reason for withholding the partial payments for work accomplished. SP-3 SECTION 6 6-1 GENERAL 6-1.01 INCREASED DR DECREASED QUANTITIES If the total pay quantity of any item of work, subject to the provisions in Section 3-2.2.1, "Increased Or Decreased Quantiti es," of the Standard Specifi cations varies by more than 25 percent, compensation payable to the Contractor will be determined in accordance with said Section 3-2.2.1 and these special provisions. \~hen the compensation payable for the number of units of an item of work performed in excess of 125 percent of the Engineer's Estimate is less than $1,500 at the applicable contract unit price, the Engineer reserves the right to make no adjustment in said price if he so elects, except that an adjustment will be made if requested in writing by the Contractor. Such Contractor's request shall be accompanied by adequate, detailed data to support costs of the item. Should the total pay quantity of any item of work required under the contract be less than 75 percent of the Engineer's Estimate therefore, the Engineer reserves the right to make no adjustment in said price if he so elects, except that an adjustment will be made if requested in writing by the Contractor. Such contractor's request shall be accompanied by adequate, detailed data to support costs of the item. 6-1.02 SOUND CONTROL REQUIREMENTS The Contractor shall comply with Chapter 8.54 of the City of San Bernardino Municipal Code regulating and pro- hibiting loud, unnecessary and excessive .noises. Each internal combustion engine, used for any purpose on the jOb or related to the job, shall be equipped with a muffler of a type recommended by the manu- facturer. No internal combustion engine shall be operated on the project without said muffler. No equipment, machinery, or apparatus that permits loud and excessive noise shall be operated during the hours of 10:00 p.m. and 7:00 a.m., unless approval has first been secured from the Mayor and Common Council of the City of San Bernardino. Said noise level requirement shall apply to all equipment on the job or related to the job, including but not limited to trucks, transit mixers or transit equipment that mayor may not be owned by the Contractor. The use of loud sound signals shall be avoided in favor of light warnings except those required by safety laws for the protection of personnel. 6-1.03 PERMITS & LICENSE -- The Contractos shall not be required to ob- tain a "Street Cut Permit" from the City of San Bernardino, Department of Public Works, Public Services Division. The Contractor shall obtain a City Business License, prior to execution of the contract. SP-4 6-1.04 EXTRA WORK -- Any extra work done shall conform to the prOV1Slons in Section 3-3, "Extra Work," of the Standard Specifications. However, equip- ment rental rates shall conform to State of California Business and Transpor- tation Agency, Department of Transportation, Division of Construction, "LABOR SURCHARGE AND EQUIPMENT RENTAL RATES," latest edition, unless the extra work is done for a negotiated price. 6-1.05 HOURS OF LABOR -- In the event that the Engineer is required by the Contractor's operations to work more than eight (8) hours in any given day, or more than forty (40) hours in any given week, or on any Saturday, Sunday or Holiday, in the setting of Lines and Grades or performing inspections, the Contractor shall pay an amount to the City equal to one and a half (l~) times the Engineer's normal wages and fringe benefits. Such amount shall be deducted from the next following progress payments. 6-1.06 PAYMENTS -- Attention is directed to Section 9-3, "Payments," and 9-3.2, "Partial and Final Payment," of the Standard Specifications and these special provisions. No partial payment will be made for any materials on hand which are furnished but not incorporated in the work. 6-1.07 PROJECT APPEARANCE -- The Contractor shall maintain a neat appearance to the work. In any area visible to the public, the following shall apply: When practicable, broken concrete and debris developed during clearing and grubbing shall be disposed of concurrently with its removal. If stock- piling is necessary, the material shall be removed or disposed of weekly. Full compensation for conforming to the requirements of Section 6 shall be considered as included in the prices paid for the various contract items of work involved and no additional compensation will be allowed therefor. SECTION 7 7-1 DESCRIPTION OF WORK 7-1.01 GENERAL -- The work to be done consists, in general, of regrading existing lots to drain; installing yard drainage inlets; installing drainage pipes and curb outlets; constructing concrete block walls; removing and re- placing existing concrete curb, gutter, sidewalks and driveway; and such other items or details, not mentioned above, that are required by the plans, the standard specifications, and these special provisions. 7-1.02 EXAMINATION OF THE SITES -- A pre-bid field review will be held, for all prospective bidders that wish to attend, on Nov..mh"T 1 7, 1983, starting at 2:00 p.m. at the intersection of Wilderness Way and Indian Trail. While attendance is not mandatory, all prospective bidders are encouraged to attend. SECTION 8 8-1 TECHNICAL SPECIFICATIONS 8-1.01 DUST CONTROL -- Dust control shall conform to the prOV1Slons in Section 7-8.1, "Cleanup and Dust Control," of the Standard Specifications. SP-5 8-1.02 CLEARING AND GRUBBING -- Clearing and grubbing shall consist of clearing natural ground surfaces of all vegetable growth and objectionable materials within the limits of construction in accordance with the provisions of Section 300-1, "Clearing and Grubbing," of Standard Specifications and in accordance with the Plans and these Special Provisions and as directed by the Engineer. Clearing and grubbing shall also include the removal and disposal of all miscellaneous concrete, asphalt paving, timber, rubble or any other objectionable material encountered beneath the ground surface as a result of grading or trenching operations connected with the construction of the project improvements. In addition, clearing and grubbing shall include, but not be limited to, the following items as shown on the Plans or specified in the Special Provisions: a. Removal of concrete curb, driveway aprons, sidewalks, concrete block wall, trash and debris, whether or not specifically indicated on the Plans or otherwise shown. b. Deleterious materials resulting from clearing and grubbing operations shall be hauled away and disposed of at a site obtained by the Contrac- tor. c. Minor grading for swales and drainage control shall be performed as shown on the Plans and as directed by the Engineer. Final grades shall be smooth, even and uniform with nonabrupt changes in the surface. d. Sawcutting to a mlnlmum depth of 1 inch, of concrete curb, gutter, driveway apron as directed by the Engineer. Payment for clearing and grubbing shall be at the contract lump sum prices paid for "Corrective Work for Grading and Drainage," on the various lots and no additional compensation will be allowed therefor. 8-1.03 CURBS, GUTTERS, DRIVEWAY AND SIDEWALK -- All portland cement concrete materials and work shall comply with the requirements of Section 201-1, "Portland Cement Concrete," and Section 303-5, "Concrete Curb, Walk, Gutters, and Driveways", of the Standard Specifications, City Standard Drawings, and these Special Provisions. Portland cement concrete shall be Class 520-C-2500, with a maximum slump of 4 inches. Wire Mesh Reinforcement shall comply with the requirements of Section 201-2.4, "Wire Mesh Reinforcement", of the Standard Specifications. Payment for concrete curbs, gutters, driveway and sidewalks including wire mesh reinforcement, shall be at the contract lump sum prices paid for "Corrective Work for Grading and Drainage," on the various lots and no SP-6 addtional compensation will be allowed therefor. 8-1.04 CONCRETE BLOCK WALL -- Concrete block walls shall comply with the requirements of Section 202-2, "Concrete Block," and Section 303-4, "Masonry Construction," of the Standard Specifications and these Special Provisions. Mortar used in concrete block wall construction shall be Class "E" to which \ to ~ part lime putty has been added. Concrete for wall foundation shall comply with the requirements of Section 201-1, "Portland Cement Concrete,: of the Standard Specifications. Blocks for the wall shall be as shown on the Plan. Payment for concrete block wall including reinforcing steel and concrete foundation, shall be at the contract lump sum prices paid for "Corrective Work for Grading and Drainage," on the various lots and no additional compen- sation will be allowed therefor. 8-1.05 POLYVINYL CHLORIDE PLASTIC PIPE -- Polyvinyl chloride plastic (PVC) piDe shall comply with the requirements of Section 207-17, "Polyvinyl Chloride Plastic Pipe," of the Standard Specifications and these Special Provisions. P.V.C. drain pipe shall be schedule 40 with solvent cement joints. The A.B.S. grate inlet and basin shall be installed in accordance with the plans and as directed by the Engineer. The grate inlet and basin shall be as manufactured by (NDS) National Diversified Sales...._lnf.-'. or approved equal. Inlet basins and drains shall be located in the field as directed by the Engineer. Contractor shall verify or ascertain that the drain lines will drain to the outlets at the curb. Payment for Polyvinyl Chloride plastic pipe, including A.B.S. grate inlet and basin, shall be at the contract lump sum prices paid for "Cor- rective Work for Grading and Drainage," on the various lots and no additional compensation will be allowed therefor. SECTION 9 9-1 PROTECTION AND RESTORATION OF EXISTING IMPROVEMENTS 9-1.01 PROTECTION AND RESTORATION OF EXISTING IMPROVEMENTS -- The Contractor shall protect all existing structures and facilities which are adjacent to the limits of the work to be done under this contract, in ac- cordance with Section 7-9, "Protection and Restoration of Existing Improvements," of the Standard Specifications and these Special Provisions. In areas that are landscaped with grass that are shown on the plans for regrading and/or installation of drainage facilities, the Contractor shall replace grass with an approved sod. The landscaped area shall be restored to a condition equal to original. SP-7 Areas that are not landscaped shall be hand-raked to a smooth, clean surface. Trees and shrubbery shall be protected from damage. If damaged or removed because of the Contractor's operations, they shall be restored to a condition equal to the original. Any irrigation lines, valves or sprinklers that are damaged or removed because of the Contractor's operations, shall be restored to a condition equal to the original. Existing fences and/or concrete block walls that have to be removed to obtain access to the rear yards, shall be restored to a condition equal to or better than original. If a concrete driveway is damaged and is a single monolithic structure, it shall be removed in its entirety and replaced. If a concrete driveway is damaged and is monolithic with the sidewalk, it shall be set off from the sidewalk by a saw-cut along the edge of the sidewalk. The driveway shall be removed in its entirety and replaced. Existing decorative rock shall be removed as required, to install pipe drain and rock shall be replaced to a condition equal to or better than the original. Asphalt concrete paving shall be Constructed as shown on the plans and as directed by the Engineer. Asphalt concrete paving shall comply with the requirements of Section 203-6, "Asphalt Concrete," and Section 302-5, "Asphalt Concrete Pavement," of the Standard Specifications and these Special Provisions. Asphalt concrete shall be Type 1, Class "B", Grade of Asphalt AR-4000. A prime or tack coat shall be applied in accordance with subsection 302-5.2 and 302-5.3 of the Standard Specifications and as directed by the Engineer.
