CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
Subiect:
Resolution of the Mayor and Common Council in Opposition to the Proposed
Expansion of a Social Care Facility at 1302 East Marshall Blvd.
Backaround:
This proposed project is described as a reVISion to a previously approved
Conditional Use Permit to expand an existing residential social care facility for
women suffering from chemical dependency and their children. The project
description specifies that the proposal would increase the capacity of the facility
from 24 to 80 beds; that a variance is required to provide 17 parking spaces in
lieu of the required 32 spaces; and that the women served may be on parole
from prison.
The project site is located in the sphere of influence of the City of San
Bernardino, within an "island" area that the City has committed to annex in the
near future.
The proposed project does not conform to the City of San Bernardino General
Plan or Development Code. The variance request would be unacceptable to the
City. With insufficient on-site parking, residents, staff, and guests would be
forced to park on the streets, impacting the surrounding neighborhoods. The
parking impacts and the intensification of incompatible land use would also
increase the demand for future police and code compliance services.
Recommendation:
Adopt resolution.

WHEREAS, this project is described as a revision to a previously approved

WHEREAS, the project site is located in the sphere of influence of the City

WHEREAS, the proposed project does not conform to the City of San
Bernardino General Plan or Development Code. City pre-zoning for the site is RS,
Residential Suburban. Social Care facilities are not permitted in the City's RS land
use district, and parolee group housing facilities are not permitted anywhere in
the City; and
WHEREAS, the variance request would be unacceptable to the City. With
insufficient on-site parking residents, staff, and guests would be forced to park on
the street, impacting the surrounding neighborhoods; and
WHEREAS, if this project is approved the parking impacts and the
intensification of this incompatible land use would increase the future demand for
City police and code enforcement services.
NOW, THEREFORE be it resolved by the Mayor and Common Council of
the City of San Bernardino as follows:

Section I. The Mayor and Common Council hereby opposes the proposed
expansion of a social care facility at 1302 Marshall Blvd. and urges that the
County of San Bernardino exercise its discretion to require conformance to City
land use policies and zoning regulations, in order to maintain land use
compatibility pursuant to the current County General Plan Policy LV-9.

Dear Ms. Mathieu:
Please be advised that the City of San Bernardino will oppose approval of the above-
referenced project, described as a revision to a previously approved Conditional Use Permit
to expand an existing residential social care facility for women suffering from chemical
dependency and their children. The project description specifies that the proposal would
increase the capacity of the facility from 24 to 80 beds; that a variance is required to
provide 17 parking spaces in lieu of the required 32 spaces; and that the women served may
be on parole from prison.
The project site is located in the sphere of influence of the City of San Bernardino, within
an "island" area that the City has committed to annex in the near future. In the interim, it is
imperative that the County exercise its discretion to require conformance to City land use
policies and zoning regulations, in order to maintain land use compatibility pursuant to the
currenl County General Plan Policy LU-9.
The proposed project does not conform to the City of San Bernardino General Plan or
Development Code. City pre-zoning for the site is RS, Residential Suburban. Social care
facilities are not 'permitted in the City's RS land use district, and parolee group housing
facilities are not permitted anywhere in the City. The variance request is a secondary
consideration, but would also be unacceptable to the City. There is nothing extraordinary or
unique about the site that would warrant a variance from parking standards. With
insufficient on-site parking, residents, staff and guests would be forced to park on the
streets, impacting the surrounding neighborhood. Should this project be approved, the

increase the future demand for City police and code enforcement services in the area. The
impacts of inadequate parking capacity, conflict with the City general plan and land use
regulations and the impacts on public services should be addressed in the environmental
analysis of the project.
Please keep the City apprised of any Development Review Committee meetings or public
hearings scheduled to consider this project. City staff will attend to oppose the project, and
may bring the item before the Mayor and Council for a fonnal resolution declaring the
City's opposition. If you have any questions, or when you have updates on the status of the
