Recommended Motion:
1.) Adopt Resolution.
2.) That the Director of Finance be directed to amend the adopted FY 2006/07 Development
Impact Fee (DIF) Budget and appropriate $117,900 from the Law Enforcement DIF
unappropriated fund balance to accou/nt number 261-481-570~4-miscellaneous equipment.

SUBJECT
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
Purchasing Manager to issue a Purchase Order to Adamson Industries of Orange, CA, to provide
Second Chance Summit threat level IIIA ballistic vests in an amount not to exceed $231,927.57.
BACKGROUND
During the February 20, 2007 Council Meeting, the Mayor and Common Council approved the
usage of $114,000 in Measure Z funding for police safety equipment, including upgrading police
ballistic vests to threat level IIIA.
Councilman Neil Derry had previously submitted an agenda item for the Ways and Means
Committee to discuss upgrading police ballistic vests. During the February 21, 2007 Ways and
Means Committee meeting, the committee unanimously directed the Police Department to
explore potential finding sources and costs associated with purchasing threat level IIIA ballistic
vests.
The Police Department currently issues Second Chance Summit threat level II vests to public
• safety employees. The core difference between a threat level II and threat level IIIA ballistic
vest is the general maximum bullet (round) stopping capacity. Testing by the National Institute
of Justice (NIJ), a branch of the U.S. Department of Justice, has determined that a Second
Chance Summit threat level II vest will stop up to a .357 caliber bullet. In prepazation of
soliciting written bid quotations, the Police Department researched the stopping capacity of
threat level IIIA ballistic vests and determined the bid specifications would be revised to require
the selected vest stop a Winchester Ranger SXT 9 mm +P+ 127 grain bullet. This round is
currently on the market, and due to its weight and velocity it is capable of defeating many types
of ballistic vests.
The Police Department will need to purchase 383 threat level IIIA ballistic vests to completely
replace all threat level II vests that have been currently issued to public safety employees or will
be issued before the end of FY 2006/07 to newly hired public safety employees.
According to the City Attorney's Office, the normal procedure to acquire materials and
equipment by formal contract is set forth in section 3.04.070 of the Municipal Code. This
procedure is time consuming in that it requires a formal Notice Inviting Bids and publication and
mailing of the Notice Inviting Bids.
In the event of an emergency, the City may acquire materials, supplies or equipment pursuant to
section 3.04.075 of the Municipal Code. This section may be utilized when the need of the City
for supplies, materials or equipment is so urgent as to preclude advance action by the Mayor and
• Common Council. In that case, the City Manager has the authority to authorize the Purchasing

Agent to secure on the open market at the lowest obtainable price such supplies, materials or
• equipment as required by the emergency circumstances.
In this case an emergency existed requiring the City to not delay, and immediately procure the
police vests to protect the City's police officers against attacks by lawless individuals that have
no regard for human life.

When the Mayor and Common Council voted to place Measure Z and YY on the ballot, they also
declared a crime emergency existed in the City. That emergency declaration has not been
rescinded and still is in effect. The subsequent adoption of Measures Z and YY by the voters
supports the determination to acquire the vests as an emergency purchase. Although Measure Z
was adopted in the form of a general tax, Measure YY supports the use of Measure Z taxes to
fund more police officers and personnel. Implied in this authorization is the recognition that
there is an immediate need to place more officers on the street, properly outfitted and ready to
meet the tasks at hand. By the very nature of police work, one important piece of protective gear
is essential: a vest to protect the officer in carrying out his or her duties. A delay in acquiring
such vests puts the officers' lives and members of the public's lives at risk. These facts clearly
justify the use of the emergency purchase procedure of section 3.04.075 of the Municipal Code.
The Police Department, in order to get the best possible price, contacted several vendors utilizing
the previously drafted bid specifications and received the following bid quotes:

A bid selection committee inspected and evaluated each of the proposed vests to ascertain if they
met the minimum bid specifications. The ABA Xtreme HP proposed by Adamson Industries
was disqualified as they could not provide a contoured vest for female officers and was
constructed of heavier ballistic materials that would decrease flexibility and increase the
retention of heat. The First Choice proposed by Greenwood's Uniforms was disqualified as the
vest was not rated to stop a Winchester Ranger SXT 9 mm +P+ 127 grain bullet, the brand is not
well known, and the vest is constructed of heavier ballistic materials that would reduce flexibility
and retain heat. The Police Department recommends that a Purchase Order for threat level III
ballistic vests be awarded to Adamson Industries as their Second Chance Summit vest was the
lowest responsive bid that met or exceeded the bid specifications.
FINANCIAL IMPACT
The total cost of purchasing 383 Second Chance Summit threat level IIIA ballistic vests is
$231,927.57. The Police Department recommends that this purchase be funded by the following

At the February 20`h, 2007 Council Meeting, the Mayor and Council approved the use of
$114,000 in Measure Z funds toward the purchase of police equipment. Budgets for the
Development Impact Fee Funds (DIF's) were approved by the Mayor and Common Council at
the February 5'h, 2007 Council Meeting. At that time it was estimated that approximately
$139,161 would be remaining in the unappropriated Law Enforcement Development Impact Fee
Fund. A budget amendment will be needed to appropriate $117,900 from the Law Enforcement
DIF fund to account number 261-481-5704 -miscellaneous equipment.
Replacing all threat level II vests with threat level IIIA will reduce annual vest replacement costs
for the next four fiscal years. Since ballistic vests have a service life of five years, every fifth
fiscal year the Police Department will need to budget for a minimum of $231,927.57.
RECOMMENDATION
1. Adopt Resolution.
2. That the Director of Finance be directed to amend the adopted FY 2006/07 Development
• Impact Fee (DIF) budget and appropriate $117,900 from the Law Enforcement DIF
unappropriated fund balance to account number 261-481-5704 - miscellaneous
equipment.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1: That the Mayor and Common Council authorize the Purchasing
Manager to issue a purchase order to Adamson Industries of Orange, CA, to provide Second
Chance Summit threat level IlIA ballistic vests in an amount not to exceed $231,927.57.
SECTION 2: Pursuant to Section 3.04.075 of the San Bernardino Municipal Code, the
Mayor and Common Council authorize an exemption to the formal bid requirement for ballistic
vests due to the immediate need to upgrade ballistic vests worn by public safety employees to
protect public safety.
SECTION 3: The authorization to execute the above referenced purchase order is
rescinded ifit is not issued within sixty (60) days of the passage of this resolution.
