HomeMy WebLinkAbout7557 ~ . . ~' . .. - RESOLUTION NO. 1/-;5 1/ A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER WOW:: IN PORTIONS OF THE NORTHERLY ,PORTION OF MARSHALL B$LEVAlID BETWEEN STODDAlID AVENUE AND -I- ST$ET; THESOUTHERLY AN.D SOUTHEASTERLY pORTION OF MARSHALL BOOLEVARD BETWEEN -I- STREET AND LADERA ROAD, IN THE CITY OF SAN BERNARDINO. WHEREAS, the Mayor and COllllllon Council of the City of San Ber- nardino, by Ordinance No. 2063, adopted May 16, 1955, established a procedure for finding and determining whether the public convenience and necessity require certain improvements or acquisition of property, and authorizing notices and hearings to be combined and held concurr- ently with the hearing required by the improvement act pursuant to which the improvement proceeding is proposed. NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO RESOLVE AS FOLLOWS: SECTION 1. That pursuant to Ordinance No. 2063, said )layor and Common Council hereby elect to combine the hearing required therein wi th the hearing required by Section 5132 of the Streets and Hiqh- waY8 Code of the ~ate of Californill. SECTION 2. That it is the intention of said Mayor and Common Council to order the'improvement'of the Northerly portion of Marshall Boulev4rd between stoddard. Avenue and -I- street; the southerly and southeaat.rlyportion ~f )larshall Boulevard between -I- Street and Ladera Ro.d, in did. City, in the following manner, to-wit: The construction of Portland cement concntesidewalks on the northerly portion of Marshall Boulevard between stoddard Avenue and -I- street.; the southerly and southeasterly, portion of Marshall Boulevard between -I- street and Laden Road. Reference is hereby made to Drawing 110. 28U and any supple- mentd drawings mentioned thereon, on file in the oftice of the City ~ .r . .. . ~' '.-- Engineer of said City, and to Specifications No. 2271, on file in the office of the City Clerk of said City, for a full and detailed description of the said proposed work and improvement, the particular locations thereof, and the lines upon which, and grades to which, it shall be done; provided that where lines or grades therefor, or for any portion thereof, are not shown by, or set forth upon, such draw- ings, said proposed work and improvement shall be done upon the official lines and to the official grades therefor. SECTION 3. That said contemplated work and improvement is of more than local or ordinary public benefit, and that said Mayor and Common Council do hereby make the expense of such work and improve- ment chargeable upon a district, which district is hereby declared to be the district benefited by said proposed work andillproyement, and to be assessed to pay the cost and expense thereof, and which district embraces all that real property situate in the City of San Bernardino, County of San Bernardino, State of California, as out- lined in red on District Map No. 2884 A.D., on file in the offioe of the City Engineer of said City. All public streets or alleys, or portions thereof, hereby are .excepted from said district. SECTION 4. That serial bonds extending over a period of nine years from the second day of January next succeeding the next September 1st following their date, and bearing interest at the rat. of six per cent per annum, payable Semi-annually, shall be issued as provided by the liaprovement Act of 1911 to represent asseuments of Fifty Dollars or over for the cost of said proposed work and improvement, remaining unpaid for thirty days after the date of the warrant. SECT!ON 5. That The San Bernardino ETening Telegram, a daily newspaper pdblished and circulated in 8aidCity~ is h!teby designated -2- ~ .- .' . . . .-' as the newspaper in which this Reselutien ef Intentien, and all fur- ther notices and reselutions relating to. said work and imprevement, shall be published. SECTION 6. That netice is hereby given that on March 8, 1965, at the heur ef 9:30 A.M., in the Council Chlllllber, in the City Hall, in said City, there shall be a public hearing befere said Maydi and Common Council for the purpose ef determining whether the public convenience and necessity require the above described improvement, and at which time and place any and all persons having any objectiens to. such detenainatien er to. the. proposed work er improvement .ay appear and shew cause why the Mayer and ColDlllen Ccuncil sheuld net find that the public ccnvenience and necessity require the above described improvement and why the' said wcrk cr improvement sheuld net be carried out in accerdance with this resolutien. SECTION 7.
