Pursuant to the attached memo which has been faxed to this office
by the County Registrar of Voters, the results of the November 5,
1996 election will not be certified until December 2, 1996. The
City of San Bernardino's Measure E, related to the Mayor's veto
power, was on the November 5, 1996 Presidential General Election
ballot.
Elections Code Division 15, Chapter 6 (Official Canvass),
requires that a certified statement of the results of an election
must be submitted to the governing body within 28 days of an
election. The Registrar of Voters had planned to issue the
certified statement on November 25, 1996, giving me time to
agendize the Resolution required pursuant to Elections Code
Section 9269.
I will agendize the matter for the December 2nd Council meeting;
however, if the Registrar's Certified Statement is not ready for
distribution that day, the matter should be continued to the
Council meeting of December 16, 1996.

Due to the complexity of the official canvass and the fact that we have a contingency of
observers and attorneys observing and challenging the process, canvass has been slowed
down.
By law we have 28 days to complete the process and at this point we anticipate certifYing
the election on December 2nd.
