STAFF REPORT
SUBJECT
Resolution of the City of San Bernardino authorizing the Chief of the San Bernardino Police
Department to execute a Memorandum of Understanding with the California State University
San Bernardino Police Department.
BACKGROUND
The City of San Bernardino Police Department and the California State University San
Bernardino Police Department have participated in a mutual aid Memorandum of Understanding
for a number of years. Currently, the Police Department investigates certain felony crimes on
the University campus, as well as assists in riot and hostage incidents if requested. The majority
of police calls for service on campus are handled by California State University San Bernardino
Police Department. This updates the original MOU since each police agency has new Chiefs of
Police.
The only modification to this Memorandum of Understanding is Number 7, which reads: "The
University Police will respond, if available, to traffic accident scenes adjacent to the campus and
render assistance to accident victims until the arrival of San Bernardino Police Department units.
University Police will handle all TC's that occur on Northpark between Little Mountain/Campus
Parkway and at the intersection of Northpark/University Parkway unless TC is fatal."
FINANCIAL IMPACT
There is no financial impact incurred by either agency.

Memorandum of Understanding Between
The San Bernardino Police Department and
The California State University, San Bernardino
Mutual aid agreement between SBPD and CSUSB effective October 1, 2006.
1. The San Bernardino Police Department agrees to investigate incidents of homicide
and violent sexual assaults that occur on the property and campus of California
State University San Bernardino within the city limits of the City of San Bernardino.
The San Bernardino Police Department will also provide the crime scene'
processing and physical evidence collection at these crime scenes. When
University Police personnel respond to such a scene, they will immediately secure
the scene and protect it from contamination. When San Bernardino Police arrive,
they will assume primary responsibility. The University Police will at that time
assume a support role as directed by the ranking San Bernardino Police Officer on
site. In general, this supporting role shall include, but is not limited to, scene
containment and protection as well as traffic control. Except as noted, the
University Police will investigate and collect evidence on all other crimes occurring
on University property.
The San Bernardino Police Department will respond to any hostage and/or sniper
situations that occur on University property within the city limits of the City of San
Bernardino. The University will notify the San Bernardino Police Department
immediately upon learning of such an incident and take any actions needed to
prevent jeopardy or injury to innocent persons. Upon arrival, the San Bernardino
Police Department shall assume primary responsibility of operational command and
execution. University Police personnel shall provide any assistance deemed
appropriate by the San Bernardino Police Officer assigned as incident commander.

3. San Bernardino Police personnel will be available to respond to a riot or imminent
riotous conditions on the University campus. In the event a request for such
assistance is granted, all San Bernardino Police personnel who respond shall be
under operational control of a lead officer designated by the San Bernardino Police
Department. All assignments, orders, and directions or other instructions directed
to San Bernardino Police Officers may come only from the City's designated lead
officer.

If the University expects an event to develop into a situation requiring assistance
from personnel of the San Bernardino Police Department, that department shall be
notified of such circumstances at the earliest possible time. The San Bernardino
Police Department shall be included in any planning and contingency
considerations associated with the event. Further, if a commitment of San
Bernardino Police resources for a planned event will be required, compensation of
those resources will be discussed, identified, and agreed upon by both the San
Ber'nardino Police Department and the University prior to actual commitment of City
resources.

5.
At the request of the San Bernardino Police Department, the University Police will
continue to provide mutual assistance to the San Bemardino Police in the canyon
area adjacent to the campus, if available.
6. The University Police will respond, if available to, traffic accident scenes adjacent to
the campus and render assistance to accident victims until arrival of San
Bernardino Police Department Units. The University Police will notify the San
Bernardino Police of such a traffic accident immediately.
7. The University Police will respond, if available, to traffic accident scenes adjacent to
the campus and render assistance to accident victims until the arrival of San'
Bernardino Police Department units. University Police will handle all TC's that
occur on Northpark between Little Mountain/Campus Parkway and at the
intersection of NorthparklUniversity Parkway unless TC is fatal, San Bernardino
Police Department will follow up.
8. University Police will respond to any "999" "11-11" situation when the scene is
within a mile of the University Campus.
When San Bernardino Police personnel are expected to be unavailable for an
extended time, University Police may be requested by the city to respond to a
reported crime occurring in proximity to the campus not exceeding one mile. Such
a response shall generally be limited to preserving the publiC peace, performing an
initial investigation and taking a preliminary report. Requests for assistance shall
be at the discretion of a designated supervising officer of the San Bernardino Police
Department, and transmitted through the University Police dispatch center to the
University Police commander. University Police will be used for this purpose only
when San Bernardino Police resources are depleted and relief is not expected for
an exceptionally lengthy period of time.
10. University Police are not expected to volunteer their assistance to the San
Bernardino Police Department aside from what is identified herein.

11. Each party to this agreement shall provide, at its sole expense, the Workers'
Compensation insurance coverage necessary for its own employees. At no time
shall the employees of one party be considered to be employees of the other.
Each Party agrees to defend, indemnify and hold harmless the other party from all
loss, liability, or claim because of or arising out of any acts of omissions of the
indemnifying party, its officers, employees or agents in its performance under the
terms of this agreement.
12. This agreement shall remain in effect until terminated by either party giving written
notification of intent at least thirty (30) days in advance of the intended date of
termination.

13. In the event of a disaster situation at CSUSB, San Bernardino Police Department
will assist CSUSB during the event as long as resources are available.
