Synopsis of Previous Council Action:
8-21-00 - Authorization to proceed with the proposed vacation of portions of Piedmont Drive,
north of Marshall Boulevard, and Marshall Boulevard between Piedmont Drive and Victoria
Avenue and approval of Plan No. 10122 was given.
Recommended Motion:
1. That the Director of Development Services and the City Clerk be authorized to proceed with
the amended vacation of portions of Piedmont Drive, north of Marshall Boulevard, Marshall
Boulevard, between Blythe Street and Victoria A venue, and Victoria A venue, north of
Piedmont Drive;
AND
2. That Plan No. 10122A showing the proposed amended vacation of portions of Piedmont
Drive, north of Marshall Boulevard, Marshall Boulevard, between Blythe Street and Victoria
Avenue, and Victoria A venue, north of Piedmont Driv , be approved.

SUBJECT:
Amendment of Authorization to Proceed - proposed vacation of portions of Piedmont Drive,
north of Marshall Boulevard, Marshall Boulevard, between Blythe Street and Victoria Avenue,
and Victoria Avenue, north of Piedmont Drive and plan approval.
BACKGROUND:
On June 28, 2000, this office received a petition to vacate portions of Piedmont Drive, north of
Marshall Boulevard. The petition was received from the San Manuel Band of Mission Indians to
construct a four-building tribal complex. San Manuel currently owns the adjoining parcels,
which should eliminate any conflicts or opposition to the proposed vacation.
On August 21, 2000, staff was authorized to proceed with the proposed vacation and Plan No.
10122 was approved. City departments, utility companies and abutting property owners were
mailed notification of the proposal, and were given the opportunity to submit cornments on any
conflicts or to reserve easements. At that time, the Real Property Division was notified by the
Planning Division that a General Plan Amendment and zone change were submitted, and that the
two applications were to be combined for processing purposes.
On June 1, 2001, the San Manuel Band of Mission Indians submitted a letter to request that the
two applications be separated and acted on independently. The time constraints in processing
both the General Plan Amendment application and the vacation application were also addressed.
On September 5, 2001, a second letter was received requesting that the petition be amended to
include a portion of Victoria Avenue, north of the northern boundary of Piedmont Avenue and
expand the vacation of a portion Marshall Boulevard westerly, to Blythe Street.
It was the City's understanding that the General Plan Amendment was desired for the
development of a tribal government center, a church, day care center, recreation center, medical
clinic and a parking lot. The General Plan Amendment application included approximately 22.7
acres and included a request to change the land use from Residential Suburban to Public
Facilities for approximately 22.7 acres. During the time the application was processed, the
property was accepted by the Federal government in trust for San Manuel. Now that the
property has been federalized, the City no longer has land use authority and the application for
the General Plan Amendment was tabled indefinitely. The proposed land uses identified in the
federalization requests were essentially the same as those proposed with the General Plan
Amendment. The San Manuel Band wishes to proceed with the street vacation.
A number of conditions were also identified by staff to mitigate the impacts associated with the
proposed development. The project now being proposed includes a 1 ,300-space parking lot on
the site. The expansion of the parking lot will increase the hours of operation beyond the
original proposal, with an increase in traffic and noise. The City is requesting that a new traffic
study and a noise study be completed for the expansion of the project and that any additional
mitigation measures identified by the studies be incorporated into the projects. The San Manuel
Band of Mission Indians has amended their original request to include portions of Marshall
Boulevard from Victoria Avenue west to Rockford Avenue, and Victoria Avenue, north of

Piedmont Drive, to provide for a landscape buffer area between the parking lot and the homes to
the south of that area.
If authorization to proceed is given, City departments, utilities and affected property owners will
be given an amended mailed notice of the proposal and asked to comment on any conflicts or to
reserve easements. The petitioner has paid $500, which represents the first half of the vacation
processing fee. The second half will be due after the investigative proceedings and prior to the
legal proceedings. As a condition of this vacation, the San Manuel Band of Mission Indians
would be required to install improvements adequate to accommodate parking and normal truck
movement at the intersection of Marshall Boulevard and Rockford Avenue. They would also be
required to show that an adequate turnaround exists at the terminus of Victoria A venue from the
public street to the reservation for emergency vehicle access.
FINANCIAL IMP ACT:
None. The petitioner has paid the first half of the processing fee and will pay the second half
after the investigative proceedings and prior to the legal proceedings.
RECOMMENDATION:
Staff recommends that an amended authorization to proceed with the proposed vacation be
given, and that Plan No. 10122A be approved.
