City Council approved the formation of a Redistricting Task Force
City Council held a Public Hearing on the redistricting and considered the first
reading of an Ordinance Amending Chamber 1.16 and re-establishing the Ward
boundaries. The matter was continued to April 15, 2002.

04/15/02:
City Council approved three motions:
1. Tabled the Ordinance of the City of San Bernardino amending Chapter 1.16 in
the San Bernardino Municipal Code re-establishing the boundaries of the
seven wards of the City of San Bernardino (as presented at the March 18,
2002 Council meeting).
2. Laid over for final adoption an Ordinance of the City of San Bernardino
which amends Chapter 1.16 in the San Bernardino Municipal Code to re-
establish the boundaries of the seven council wards of the City of San
Bernardino (as presented at the April 15, 2002 Council meeting).
3. Continued the item to 7:00 p.m. on Monday, May 6,2002, for the purpose of
holding a second public hearing in compliance with Elections Code Section
21620.1.

Municipal Code to reestablish the boundaries of the seven council wards of the City of San
Bernardino (as presented at the April 15, 2002 Council meeting)
Backnound:
At the meeting of the Mayor and Common Council held on April 15, 2002, the following
motions were approved:
1. Tabled the Ordinance of the City of San Bernardino amending Chapter 1.16 in the San
Bernardino Municipal Code reestablishing the boundaries of the seven wards of the City of
San Bernardino (as presented at the March 18, 2002 Council meeting).
2. Laid over for final adoption an Ordinance of the City of San Bernardino which amends
Chapter 1.16 in the San Bernardino Municipal Code to reestablish the boundaries of the
seven council wards of the City of San Bernardino, as presented at the April 15, 2002
Council meeting.
3. Continued the item to 7:00 p.m. on Monday, May 6, 2002, for the purpose of holding a
second public hearing in compliance with Elections Code Section 21620.1.
The City Clerk's Office submitted, in a timely manner, a request to publish legal notice of the
second public hearing and requested that legal notice of the public hearing be published twice in
accordance with Government Code Section 6062. On Friday, April 26, California Newspaper
Service Bureau contacted the City Clerk's Office to notify us that as a result of an error on their
part they were not able to publish the first of two required publications within the legal
timeframe.
We have consulted with Sr. Asst. City Attorney Huston Carlyle on this matter. The City Clerk's
Office and the City Attorney's Office concur that since legal notice of the second public hearing
was not done within the required timeframe, it is now necessary to continue this item to allow
sufficient time for the required legal publication of the notice of a public hearing.
Financial Impact:
Unknown at this time; however, costs will include the preparation of new 8 II, x 11 maps and
large display maps in the various City Departments.
Recommendation:
Motion: That the public hearing concerning ward redistricting and the final reading of an
Ordinance of the City of San Bernardino which amends Chapter 1.16 in the San
Bernardino Municipal Code to reestablish the boundaries ofthe seven council
wards of the City of San Bernardino be continued to May 20, 2002.

Backl!round:
At the March 18, 2002 Council meeting, the Redistricting Task Force presented its report on the
proposed changes to the boundaries of the City's seven wards and also presented a draft
ordinance reflecting the proposed changes.
The City Council voted to continue the matter to April 15, 2002 and directed that the
Redistricting Task Force conduct an evening workshop designed to inform the public of the
redistricting process and get public input on the proposed ward boundary changes.
A redistricting workshop took place on Wednesday, March 27,2002, at 7 p.m. in the City
Council Chambers. Approximately 75 to 100 persons attended the workshop where Ruth Parish,
GIS Coordinator, explained why and how the redistricting process was accomplished. The
workshop was telecast live over KCSB Channel 3 and rebroadcast on two additional dates.
Citizens were encouraged to call or write the Mayor and Council, or e-mail their comments to
the Mayor and Council via the City's website.
Following the March 18 Council meeting and the March 27 workshop, Ms. Parish worked on
adjusting the ward boundaries taking into account concerns voiced by the elected officials. As a
result of these changes, the revised ward boundaries address comments expressed by members of
the public.
If the City Council approves of the newly revised changes to ward boundaries, as will be
verbally explained by Ms. Parish, then you will need to approve the motions outlined below.
Financial Impact:
Unknown at this time; however, costs will include the preparation of new 8 Y, x 11 ward maps
and large display maps in the various City departments.
Recommendation:
Motion # I: That the Ordinance of the City of San Bernardino amending Chapter 1.16 in the

Background: In anticipation that the City would be required to redraw its ward
boundaries as a result ofthe 2000 Census, on March 5, 2001, the City
Council approved the formation of a Redistricting Task Force consisting of
the following appointees:
City Administrator's Office: Teri Baker (representing Fred Wilson)
City Attorney: Huston Carlyle (representing James F. Penman)
City Clerk: Rachel Clark (represented by Lee Gagnon)
Council Office: Jorge Carlos
Development Services: Les Fogassy
Information Services: Ruth Parish
The Redistricting Task Force has met 13 times and is now ready to present
its proposed ward redistricting plan. Meetings were held on March 22, June
28, July 17, July 24, August 1, August 8, August 14, September 13,
September 24, October 29, October 31, November 1, 2001, and March 11,
2002.
Section Three of the City Charter states that: "The Mayor and Common
Council by ordinance shall divide the area of the City into seven (7) wards of
approximately equal population and thereafter shall periodically change the
boundaries of the wards to maintain them in compact form and as nearly
equal in population as possible, provided that such changes shall not be made
more than once in any two (2) year period nor within ninety (90) days of any
general municipal election."
General law cities are required to adjust boundaries of council districts
before the first day of November of the year following the year in which the
Federal census was taken. Although our City Charter specifies no time limit
within which the ward boundaries must be adjusted after a Federal census,
the City Attorney's Office, in a legal opinion dated August 12, 1981,
concluded in part that "The statute requiring general law cities to
reapportion by November 1 sl of the year following the year in which the

census is taken is not expressly binding upon the City of San Bernardino but
should be used as a guideline. ..."
The Redistricting Task Force worked on the redistricting process between
April 2001 and March 2002; however, no final action could be taken due to
the fact that the City had its municipal election on November 6, 2001 and our
City Charter prohibits ward boundary changes from being made within
ninety days of a general municipal election.
Based on the 2000 Federal census figures, the City's population stands at
185,272. The optimum population per ward should be 26,467 for each ofthe
seven wards. Attached Exhibit A shows the current population figures for
each ward and the deviations that now exist in each ward.
Exhibit B shows the proposed ward boundary map that has been developed
based on the foUowing criteria: 1. Equal population; 2. Geographic
boundaries; and 3) Communities of interest
If you approve of Exhibit B, we request that you adopt form motions one and
two listed on the Request for Council Action.
Special thanks go to Ruth Parish of Information Services for her diligence in
preparing the maps, making the adjustments needed to come up with
boundaries that divided the population as evenly as possible, and her infinite
patience during this process. Thanks also go to Teri Baker of the City
Administrator's Office for chairing the committee and keeping the process
on track.

proposal based on the principles of a sound plan that meets the requirements of the law.
This plan has attempted to do the following:
. Create wards that adhere to the "one person, one vote" requirement
. Create wards that are compact and contiguous
. Create wards that address issues related to various communities of interests
. Create wards that address Section 2

WAG is concerned that there was no opportunity for public input during the initial 13
meetings that the city had prior to presenting the proposed boundaries for council
consideration. We strongly urge the Council to take the time to make sure that all options
are explored in detail before voting on a final plan. To date there has been no presentation
ofthe legal points addressed by each plan. You have provided no data to the public that
shows how each plan has met the requirements of compactness. There has been no
presentation of the communities of interests identified by the committee. Moreover, the
City did not allow for self-identified communities of interest to address their concerns
before your first reading.
One of the most important areas that concern our coalition is that there has been no data
provided to show that the proposed plans have met the Section 2 requirements. The
various indicators or formulas normally used by social scientists have not been used to
confirm that non-white groups will be able to elect the candidates of their choice.
We feel that it is essential that the Council take the initiative to make sure that an open
discussion on these points is held at the public hearing on Monday, May 20th. WAG
knows that you will do what is best for the city of San Bernardino when you consider the
plans for redrawing the ward boundaries.

WHEREAS, an Authorized committee of Northwest Redevelopment Project Area
Committee. Request that Redistricting be stopped until the following question can be answered
and input from the Northwest Redevelopment Project Area Committee be considered.
1. Was participation provided for Owners, Business and Tenants in the Project Area
and the 6th ward about changes in redistricting?
2. Was appropriate action taken by the Mayor and Common Council to involve the
Northwest Redevelopment Project Area Committee in there intensions to redistrict
the ward and Project area?
3. Where the Resident, Property Owners and Business Owners ofthe 6th ward,
