Subiect:
Request for a continuance of Final Map for Tentative Tract No. 14193-Southeast comer of
Ohio and Olive Avenues.
Backl!I'ound:
On October 9, 1990, the Planning Commission approved Tentative Tract No. 14193.
Extensions of time were later approved to extend the tentative map to October 9, 1993. An
automatic two-year extension was granted by Section 66452.11 of the Subdivision Map Act,
which extended this tentative map to October 9, 1995; an additional extension of time was
approved by the City to extend the tentative Map to October 9, 1996. An automatic one-year
extension was granted by Section 66452.13 of the Subdivision Map Act extending it to October
9, 1998. On October 5, 1998, the Mayor and Common Council approved a motion to continue
this to March 15, 1999, at which time a motion was approved to continue this to June 21,
1999. On June 21, 1999, the Mayor and Common Council approved a motion to continue this
item to February 22, 2000. On February 22, 2000, the Mayor and Common Council approved
a motion to continue this item to June 19, 2000. On June 19, 2000, the Mayor and Common
Council approved a motion to continue this item to September 18, 2000. On September 18,
2000, the Mayor and Common Council approved a motion to continue this item to October 2,
2000. On October 2, 2000, the Mayor and Common Council approved a motion to continue
this item to April 2, 2001. On April 2, 2001, the Mayor and Common Council approved a
motion to continue this item to August 6, 2001.
On July 23, 2001, the Mayor and Common Council adopted a resolution approving the Fifth
Amendment to Mutual Release and Settlement Agreement between the City of San Bernardino
and Dr. Irving Feldkamp, provided this subdivision be extended to May 6, 2002.
Tract No. 14193 is a 76-lot single family residential subdivision. The required improvement
securities and certificates of insurance will be filed prior to the Council meeting of May 6,
2002, and the prescribed fees will be paid prior to recordation of the final map. Additionally,
the improvement and grading plans have been prepared.
The Final Map has been reviewed and found to be substantially in compliance with the
Tentative Map and the Subdivision Map Act. Therefore, we recommend that the matter be
continued to May 6, 2002.
Financial ImDact:
There is no fmancial impact to the City.
Recommendation:
Staff recommends that the Mayor and Common Council continue this item to May 6, 2002.

of SUI Bernardino and purc:huer'slender, Upland Bank, to reach an amicable re50lution
regardina the settlement a81eeanent and amendmen18 entered into between Dr. Feldkamp and the
City, which agreement would be assumed by the purchaser.
The purchuer, Covenant Development, is in discuasions with a new bank. Pomona First Federal,
Uld doe. not anticipate the City lIpllcment to be problematic. We are moving fOlWard wilh the
Iale and certainly hope to JUCCesllfully dOlt the transaction. However, the fourth amendment to
the aettlcmcnt apeement requites the developer to comply with certain dates which now IIppear
premature. They are u fDI1ows: An obliaation to record the final map for Tract 14193 on or
before August I, 2002. Failure to conunence construction of on site building by January I, 2002
(see scetion 3.1). To allow the CUrrent purchaser to obtain tinancill8 from Pomona First Federal
andlor to allow for the contingencies of.. failure to dose this eserow, we are requesting the
following:

Dear Mr. Casey:
I have been requested by Dr. I.M. Feldkamp m, owner of Tract 14193, to contact you requesting
you recommend the City Council of the City of San Bernardino grant an extenSion of time until
August 2, 2001 within which to record the Final Map. As you are aware, both the City and Dr.
Feldkamp were hopeful that Dr. Feldlc:amp would be able to sell the subject property to a
reputable developer who would comtnCllCC development ofhomes on the tract. Dr. Feldkamp has
entered into escrow with various bwlders of note; however, the escrows have been cancelled by
the developers due to concerns regarding Mello-Roos issues and development costs.
Therefore we would request that the City Council authorize further lIII1eMment of the Release
and Mutual Settlement Agreement to extend the required recordation of the Final Map for a
period of one hundred twenty days after April 2, 2001, or August 2,2001. We also request that
the commencement of construction of housing units for Phase I be continued to a date on or
before sixty days after final approval and written certification of each finished lot, but in no event
later than three hundred thirty days from April 2, 200 1.
We now anticipate entering into an escrow at First Aroeric:an Title Insurance Company with
'Covenant Development and Corman Leigh Communities, Inc. on or before March 23, 2001. The
buyer of the property is based in the City of Sill Bernardino and meets required qualifications as
an Clq)erienced and active builder participating in several projects within the Inland Empire. The
terms of the purchase contract provide for a thirty day due diligence period in order that the buyer
will have time to verify costs of construction and requiremc:nts to develop the project in the City
of San Bernardino. Upon completion of this initial thirty day period, buyer shall have fifteen days
to consummate the sale. This closing date is anticipated to be on or about May 10, 2001.
Following the closing of escrow, Covenant Development shall post sureties, pay all applicable
fees and Cl(ccutive subdivision agreements necessary to record the Final Tract Map. ConstNction
of the project will commence shortly thereafter.

We realize that should circumstances arise resulting in the tiIilw-e of the wrrcnt escrow, the
options at that time will be to either record the Fmal Map prior to August 2. 200 1 or forfeit
entitlements of the wrrcnt map approval. It is not out intention to request any additional
enension of time.

I have been requested by Dr. 1M. Feldkamp m, owner ofTract 14193, who is cum:ntly out of
the country, to contact you requesting you rceommend the City Council of the City of San
Bernardino grant an eJrteDsion of time within which to satiaty the time constraints of section 3 of
the Third Amendment to the Mutual Release and Settlement Agreement entered into between the
City and Dr. Feldkamp.
All you are aware, both the City and Dr. Feldkamp were hopefill that Dr. Feldkamp would be able
to sell the subject property to a reputable developer who would commence development of homes
on the tract.
Dr. Feldkamp has entered into escrow with various builders of note; however, the escrows have
been cancelled by the developers due to conc:ern& regarding Mlillo-Roos issues and development
costs. We recently entered into an escrow with Century Homes and were most hopeful that the
escrow would successJill1y close. However, last week Century cancelled the escrow because of
its concerns regarding high development costs and the lack: of financial programs available within
the City to offset the development costs.
Dr. Feldkamp remains optimistic and as soon as he returns to the countty will continue efforts
towards marketing the property. Immediately upon beillg notified of the cancellation, he
instructed his staff to send markctini packages to thirty-seven development companies and
numbers of real estate broken IIOliciting development offers.

At this time he would request that the City Council authorize amendment of the Mutual Rel_
and Settlement Agreement to emend required rec:oniation of the final map for a period of 180
days after October 2, 2000. He also requests that the commencement of construction ofhousing
units for Phase 1 is continued to a date on or before sixty days after final approval and written
certification of each finished lot, but in no event later than 330 days Crom October 2, 2000.
He ill concerned that the upcoming election and holiday season will impact interest in the property
through the balance of calendar year 2000, but is most hopeful that durins the winter of calendar
year 2001, there will be evidence ofinterest in the property.

Dr. Feldkamp has entered into a purchase agreement and opened
escrow with Century Homes for the purchase of the Feldkamp
properties located within former CFD 995. The due diligence period
ends September 19, 2000. After that time, the purchaser is
committed to proceed with closing.
The Mayor and Common Council originally continued this matter to
September 18, 2000. That date is one day prior to the end of the

Dr. Feldkamp has been usiduO\Qly marketingthe property. he has not yet received a bona fide
offer to purchase. The housing market in North San Bernardino has improved recently, and Dr.
Feldkamp remains optimistic that a sale may be e1rectuated shortly. However, in order for the
prospective purchasers to complete due diligence, fiidy extensive escrow periods are anticipated.
Dr. Feldkamp hereby requests a continuance oCthe requirement to record the Final Map until the

REVISED--Tract Map 14193 and Amendment to
Settlement Agreement -- Feldkamp Property
Dr. Feldkamp has requested that the City take action to
extend the period to record the tract map for the Feldkamp
property. The reason for the extension is that Dr. Feldkamp has
been unable to locate a buyer/developer of the parcels due in part
to the existence of the Community Facilities District 995 ("CFD
995") and the outstanding county property tax amount due of
approximately $300,000.
Now that CFD 995 has been paid in full and will be
dissolved within the next month and Dr. Feldkamp has negotiated his
property tax bill down to approximately $63,000, Dr. Feldkamp has
again begun to contact the various developers/purchasers regarding
the development of his parcels. Dr. Feldkamp's agents believe that
in light of the substantial reduction in the outstanding liens on
the property, the prospective developers/purchasers may show more
interest in the property at this time.
Dr. Feldkamp requests an extension until June, 2000 in
order to provide time to (i) negotiate a deal with the various
purchasers/developers, (ii) close the transaction, and then (iii)
provide sufficient time for the new owner to take the necessary
steps to record the final tract map.
While normally actions by the City to extend deadlines
for individuals could be preceived as setting a precedent for other
extensions, the extensions afforded Dr. Feldkamp do not necessarily
do the same. In this instance, the City is acting in its best
interest to achieve development at the least cost to the City.
This is a unique situation in which the property will be
.
transferred to the City in the event that the map is not extended.
Currently, the City and Agency are now in the process of
addressing the disposition of the the Bice and Glaziers property
contained within CFD 995 on which the City foreclosed. In the event
that the Feldkamp property is transferred to the City, the City
will then be confronted with the disposition of the Feldkamp
property as well.
In the event that the City determines to extend the
period to record the tract map, the Settlement Agreement between
the City and Dr. Feldkamp must be amended in order to conform the
dates contained in the Settlement Agreement to the new deadline for
recording the tract map. Specifically, the last date to:
(i) Apply for a grading permit would be extended to June 1, 2000;
(ii) Commence construction of on-site grading activities would be
extended to October 1, 2000;
(iii)Commence construction of housing units would be extended to
December 1, 2000; and
(iv) The period in which the City will be required to work with the
Agency to require the Agency to use its best efforts to provide MAP
funds to Dr. Feldkamp's home buyers would be extended by one year
to the following: 2000\01 - $50,000; 2001\02 - $100,000; and
2002\03 - $50,000.

We understand from Michael W. Grubbs' letter to Dr. I.M. Feldkamp, III, dated
September 30, 1998 (copy attached), that the final map for Tract No. 14193 was timely
filed and received by the City Engineer on September 23, 1998, before the expiration date
of the tentative map, pursuant to Government Code Section 66452.6(d), which in part,
states:
"Once a timely filing is made, subsequent actions of the local agency,
including, but not limited to, processing, approving, and recording, may
lawfully occur after the date of expiration of the tentative map. Delivery to
the county surveyor or city engineer shall be deemed a timely filing for
purposes of this section."
Because modification of the existing, delinquent Mello Roos Assessment District
financial obligations on this tract are being considered by the City in conjunction with an
amendment to the settlement of the City's judicial foreclosure action in San Bernardino
Superior Court Case No. SCV 09593 involving this same tract, we feel that in this case,
six months from the date the final map was filed is a reasonable period of time for the
applicant to complete the processing, approval, and recordation of the final map pursuant
to Government Code Section 66452.6(d). Accordingly, we request that your Department
send Dr. Feldkamp a letter extending the time to March 23, 1999, in which he must submit
to your Department the executed Subdivision Agreement, security for required public
improvements. and insurance certificates, as outlined in Mr. Grubbs' attached letter. We
feel that this six month time period is reasonable given the unique circumstances in this
case.

The Final Map has been reviewed and found to be substantially in compliance with the Tentative
Map and the Subdivision Map Act. Therefore, we recommend that the Final Map be approved.
