WE HAVE CONDUCTED A THREE MONTH INVESTIGATION AND
DISCOVERED CITY DOCUMENTS THAT SUPPORT THE FACT THAT THE
ILLEGAL EVICTION OF THE RESIDENTS OF .. CYPRESS INN TRAILER
PARK ~ WAS RACIALLY MOTIVATED.

ERATELY MISLED THE COURTS TO ALLOW A COURT ORDER TO THROW

I read in the paper yesterday a statement attributed to you, "In Mexico, they treat us better
than here."
The City of San Bernardino, out of concern for the safety of you and your fUnily, evacuated
you and your family on Tbunday, December 14, 2000 from Cypress Inn TraDer Park to the Bl.8
Motel. Our Fire Department Inspectors believe you and your family were Iivins in a situation that
could re&Uh in serioullnjury or even death, due to the condition of the park and your mobile home.
The people ofthc City of San Bernardino are presently payins for two rooms at the motel for
you and your fiunily and are reimbursing the Salvation Army for providins you and your family with
d8iIy meal..
We intend to continue providing you this assistanCC fur the remainder of the two week period

I have obtained public records and documents under the Califbrnia Access to Records Act
pertaining to code enforcement activities conducted by San Bernardino City Fire
Department personnel at the Cypress Inn Mobile Home Park, located at 2057 No. Mount
Vernon Ave. in the city of San Bernardino from April 1, 1996 to December 14, 2000.
As a 19 year veteran Fire Captain for the San Bernardino City Fire Department (Employee
#24464-February 4, 1980 to January 14, 1999), I have specific knowledge of and
extensive experience in fire safety inspection activities. Prior to my retirement, 1 was
assigned the responsibility of conducting, gaining compliance and completing 216 annual
fire prevention inspections including: small business owners, apartment complexes,
hospitals, assisted living, convalescent and nursing facilities, fuel dispensing stations,
commercial and industrial complexes, education facilities and mobile home parks within
San Bernardino City limits.
Based on the following documents, it can be shown that the residents of the Cypress Inn
Mobile Home Park may have been denied a customary and fundamental remedy in the
form of "Due Process" after receiving a fire safety inspection report dated December 6,
2000 from officials of the San Bernardino City Fire Department.
It can also be demonstrated that in the recent past and on numerous occasions, other
San Bernardino City Fire Department officials conducted the same level ofFirelSafety
inspection and found no cause to order an eviction.
Other significant findings are discussed and annotated during an examination of the
following public records:

Fire Safety Inspection dated December 6, 2000,

This document speaks to a fire safety inspection at the Cypress Inn Mobile Home Park,
located at 2057 Mount Vernon Ave. San Bernardino conducted by Captain John Hale
(Employee #25031), Apparatus Engineer James Sheridan (Employee #25031), and
Firefighter Jeff English (Employee #61033) on 12-6-2000.
John Hale had recently been promoted to Captain at the time of the fire safety inspection
on December 6, 2000. I have knowledge John Hale is a State Certified Fire and Arson
Investigator with police powers. Captain Hale has investigated numerous fires where a
suspect was detained, questioned and either released or arrested.
Additional remarks in the space reserved to record fire safety violations included
"Inspector 611 was notified and asked to assist in further inspection and enforcement of
fire safety violations. " The document also indicates an entry near the F.D. Signature/Date
stating "Referred to Nre Prevention - 12-6-00 Inspector Kent. "
I will address each of Captain John Hale's six (6) violations;
# I.. .As a matter of due process, the property owner or his manager is always given the
courtesy and opportunity to correct any violations during the initial inspection. By his own
admission, it appears violations # 1, 2 & 6 were corrected with the help of not only the
property manager, but with the direct assistance of Captain John Hale and his crew.
The Cypress Inn Mobile Home park was issued City permits when it was built in 1940 and
the existing roadways certainly must of accommodated emergency vehicle access then and
thus gives rise to allowing the roads to remain as they were under a "Grandfather Clause."
In addition to the grandfather clause and in the express absence of an obvious life safety
issue, a property owner can appeal to the Fire Marshal for a variance under a section in
the fire code that allows the use of "Alternate Methods in Materials and Construction,"
when he or she can demonstrate a reasonable attempt was made to comply, but because of
the cost/benefit analysis it would likely cause an economic hardship.
#2...Regarding the chained and locked rear gate that provided a secondary means of
emergency access from Turrell St. The fire suppression crew cleared debris and insured it
was in a locked open position. This is clearly out of the authority and scope of firefighter
duties for the simple reason that any damage or loss arising from their intervention would
place a liability upon the City.

Nonnally, the fire officer would require the manager or owner to clear the debris by a
mutually agreed upon time and document the need for compliance on the fire safety
inspection notice. The issue of the locked gate is best resolved by recommending and
giving the manager or owner an application for a Knox Co. padlock. The Knox padlock
would have allowed the gate to be locked and still provide the required emergency access
since all San Bernardino fire engines carry a Knox Co. padlock "pass" key. The manager
also has the option of correcting the violation(s) in the captains presence.
#3.. .Multiple non permitted wood structures attached to trailers would require
compliance. it seems if the wood structures were attached at one point, they could be
likewise detached, thus giving rise to allowing a violator a measure of equal due process in
order to correct those infractions. Evidence of such due process is clearly described on the
Fire Safety Inspection (Doc. #A) notice where a fee is charged after the first revisit to
verifY compliance.
#4...The issue of "Several extension cords used in lieu of penn anent wiring" is a very
common violation and one of the easiest to gain compliance through Due Process.
Even the fire department had a fire safety inspection (Doc. #G) where correction was
ordered and due process allowed in order to gain compliance.
#5..No-Parking Fire Lane signs or painted curbs were required on both sides of the access
road where the width is 20 feet or less. For the benefit of all concerned, the fire code
requires a minimum road width of20 feet with posted signs and/or painted red curbs on
both sides indicating that fire lanes exist. It's always been a practice to seek compliance
through the manager or owner of the occupancy to provide signage.
#6...Captain Hale describes the housekeeping as "undesirable," which carries a subjective
inference rather than objectively determining whether the debris constituted a significant
fire hazard and recording same. To state that the housekeeping "...was undesirable'
implies a specific absence of this objectivity. Furthennore, the firemen appear to have
mitigated the "...trash piled at rear of property" when the fire suppression crew cleared the
debris and insured the rear gate was in a locked open position."
The relevancy of Document #A speaks to the material fact that Captain John Hale and his
crew conducted a fire safety inspection on 12-6-2000 whereby a total of6 violations were
recorded. Based on this fire safety inspection report, Captain Hale did not state any reason
for evacuation ofthe Cypress Inn residents.
Only Captain John Hale can rationale why it was necessary to initiate an action that he had
knowledge could also displace the residents of the Cypress Inn Mobile Home Park on
December 6, 2000. Likewise, only Captain Hale knows if his state of mind and ability to
make sound judgments was impaired during the fire safety inspection since he apparently
became ill and went off duty at 17:00 hours (Station's Log: Doc. #H).

Article 6. Fire Protection Standards for Mobile Home Parks

Pertaining to parks for which the department (Department of Housing and Community
Development) is the enforcement agency, afire agency, as defined in this Article, may
elect to assume responsibility to enforce its fire prevention code in parks within its
jurisdictional boundaries by providing the departmentwith a written 30-day notice
pursuant to Health and Safety Code Section 18691(d).
It goes on to speak about how a fire agency, once it assumes responsibility of providing
fire prevention and suppression services must inspect the property according to the

Fire Prevention Officer Rita Kent's Declaration on Pages I & 2, Lines 27-28, also states
the tenant in Space #51 was issued a "written order" (Doc. #E) regarding his continual
parking in the roadway. The actual written order consists of a VIOLATION written to
"Space #51." Fire Prevention Officer Rita Kent demonstrates her authority to write a
warning containing an overt threat by advising Space #51, "...your vehicle will be towed
for parking in fire lane

According to Fire Prevention Officer Rita Kent's Declaration on Pages 2, Lines 14-16,
"As a temporary safeguard measure, fire suppression crews opened a lockedlblocked
required secondary means of emergency access route to the park, by clearing debris
and insuring it was in a locked-open position. "

Fire Prevention Officer Rita Kent made an error when she cited the CCR for a natural gas
utility, but described the violation as electrical in nature. (See enclosed CCR, Doc. #F).
In addition to the violations cited by Captain John Hale, Fire Prevention Officer Rita Kent
added elements of the following in her request for a judicial warrant;
Fire hose cabinets OR individual water outlets are required, but again the property owner
is always given a reasonable amount of time to comply. Individual trailers lacking required
separations, setbacks, sub-standard additions not meeting flame spread requirements,
various combustible storage, required exterior doorways, inoperable windows, exterior
stairways, electrical utility disconnection's and gray water/sewage issues are again subject
to due process in order to give the occupants time to comply.

This document speaks to a fire safety inspection at the Cypress Inn Mobile Home Park,
located at 2057 Mount Vernon Ave. San Bernardino conducted by Captain Eugene
DuCloux (Employee #23987) and Firefighter Steven Davis (Employee #23987) on
12-14-1999.
The document also speaks to resident Manager Jose Hernandez, having been present at
the time of the inspection and to have signed and dated the document.
The relevancy ofthis document speaks to the material fact that Captain Eugene DuCloux
signed the inspection form on December 14, 1999 after concluding that no violations
existed at the Cypress Inn Mobile Home Park.
This document demonstrates a high level of fire safety existed on or before April 1, 1996
and also clearly indicates that there was no alarm or other need to be concerned of any
safety issue to cause an evacuation of the residents of the Cypress Inn Mobile Home Park.

This document speaks to a fire safety inspection conducted by Captain Steven R. Shaw
(Employee #24463) at the Cypress Inn Mobile Home Park, located at 2057 Mount
Vernon Ave. San Bernardino on April 1, 1996.
This document also represents the last fire safety inspection performed until December 14,
1999. San Bernardino Deputy City Attorney Michael Rieter speaks to the absence of the
1997 and 1998 fire safety inspection reports in his letter dated January 24,2002 (Doc. #D)
The relevancy of this document speaks to the material fact that Captain S. Shaw signed
the inspection form on April 1, 1996 after concluding that no violations existed at the
Cypress Inn Mobile Home Park. The document also speaks to resident Jose Hernandez as
the name of the Owner/Manager,
This document demonstrates a high level of fire safety existed on or before April 1, 1996
and also clearly indicates that there was no alarm or other need to be concerned of any
safety issue to cause an evacuation of the residents of the Cypress Inn Mobile Home Park.

These documents speak to the release of public information under California's Access to
Records Act and the City of San Bernardino Attorneys response as to what will be
provided and a brief explanation why some items are being denied.
Attorney Michael Rieter confirms the fire department is missing the 1997 and 1998
Cypress Inn Mobile Home Park fire safety inspections.

Fire Prevention Officer Rita Kent's Declaration on Pages 1 & 2, Lines 27-28, states the
tenant in Space #51 was issued a "written order" regarding his continual parking in the
roadway. The actual written order consists ofa VIOLATION written to "Space #51."
Fire Prevention Officer Rita Kent wrote a warning containing an overt threat by advising
Space #51, "...your vehicle will be towed for parking in fire lane."
It is the usual and customary practice to issue the fire safety inspection notice to the
property manager and allow time for compliance. A verbal warning would be given to the
registered owner of a vehicle in violation and if that didn't work, each Captain has the
authority to issue a traffic citation or summon police. However, if the prohibited parking is
not adequately posted, it' is reasonable to conclude that the alleged violator would prevail
in a court oflaw.
Whether or not the Captain or the Police write a ticket, a "Written Order" is issued or an
initial fire safety inspection notice is given, there is a due process provided at all stages of
the inspection process. Based on this written order, Fire Prevention Officer Rita Kent
never indicated there was any emergency requiring evacuation of the Cypress Inn
residents.

of evaluating the integrity bfthe mobilehome park's emergency access and on-site fire protection.

My findings were that the lllverall park's access roadways did not meet Local or State guidelines for

mobilehome parks, by re4son of lack of maintenance of roadway widths and paving which pose

water supplieslhose cabineis for the park's occupants to use for possible fire within the park. Verbal

orders were issued to the ~anager and all tenants regarding the parking on roadways which reduced'

the required widths for emergency access. A written order was issued to the tenant in Space #51

release mechanisms, and blocked with either

Numerous homes were placed on what
appears to be unsafe supports (many were
set upon bricks/wood);

7. On or aboJt December 11,2000, I received a telephone call from Carl Dietz, the

owner of Cypress Inn 10ca~ed at 2057 North Mt. Vernon Avenue (a mobilehome trailer park),
I
San Bernardino, California. l\1r. Dietz advised me that his Manager had brought to his attention that
!
the Fire Department had giv~n him orders to restore the "No Parking-Fire Lane" signs and also had
I
advised him of our concerns about the substandard construction and/or hazards within the park.
I
I explained to Mr. Dietz, th~ Fire Departments concerns were about the unsafe conditions and about
I
the Inspection Warrant which will be acquired being that there is an immediate concern about the
I
I
occupants safety and that ~ctions to safe guard the park is necessary now. Mr. Dietz advised me
I
that he had pulled permits tq rebuild the park, however, Mr. Dietz had become ill in fact was in the
I
hospital during our conversl\tion. He advised me that he understood and that he would do whatever
I
is necessary if made it thropgh the surgery.

8. On or abott December 11, 2000, the City Attorney's Office spoke with Carl Dietz
I
via telephone. Mr. Dietz id+ntified himself as the owner of the mobilehorne park and stated that the
I
City has his full cooperatiom. He added that he was in the hospital and would most likely not ever
I '
be released due to having p~creatic cancer. He stated that upon his death, his son Christian Dietz
I
will take control of the property.

9. On or ab~t December 11,2000, I contacted the City of San Bernardino's Business
I
Registration Division to fu1ther identify all owner(s) and interested parties. Their records showed

At our meeting on January 24,2002, I provided all the documents you requested for your
jnspection except for a few. This is the written response to explain why certain records were not
provided for your inspection.
There were no 1996 or 1997 inspection records in the Fire Department's files, and thus were
not provided for your inspection.
The California Code of Regulations sections you requested are not records open to inspection
under the Public Records Act, because they were not prepared by the City of San Bernardino.
Similarly, you were correct in saying that the documents regarding the Knox Box were not
subject to disclosure. They, too, lvere not prepared by the City of San Bernardino.
The documents you have requested have been copied for you and are available for you to pick
up. Please bring $5.90 for copying costs to the City Attorney's Office and we will provide these

!i1284. Water Conditioninq Equipment.
(a) A permit shall be obtained from the enforcement agency prior to installing any regenerating
water conditioning equipment on a mobile home lot. Approval of the park operator is required on all
applications for a permit to install such equipment. Where the water conditioning equipment is of
the regenerating type, and the park drainage system discharges into a public sewer, approval of the
sanitary district or agency having jurisdiction over the public sewer is required.
(b) Regenerating water conditioning equipment shall be listed and labeled by an approved listing
agency. '

(c) Regenerating units shall discharge the effluent of regeneration into a trap not less than one and
one-half inches in diameter connected to the park drainage system. An approved air gap shall be
installed on the discharge line a minimum of 12 inches above the ground. The trap need not be
vented. .
(d) Electrical supply connections to regenerating water conditioning equipment shall comply with
the requirements of this subchapter.

111300. Application and Scope.
(2) "Fire Agency" means a city, county, or city and county fire department, or fire district.
(3) "Fire Hydrant" means a connection to a water source for the purpose of supplying water to a tire
hose or other fire protection apparatus.
(4) "Park" means a manufactured housing community, mobilehome park, or special occupancy park.
(5) "Private Fire Hydrant" means a fire hydrant owned by the park.
(b) Fire protection equipment meeting the requirements of the National Fire Protection Association
(N.F.P.A.) Standard No. 24, 1977 Edition, shall be installed and maintained in every park consisting
of 15 or more lots constructed after September I, 1968, or, parks enlarged to consist of 15 or more
lots. Installation of fire protection equipment is required only for the new lots added.
(c) Testing of Private Fire Hydrants. Park owners and operators shall be responsible for the testing
and certification of the operation and water flow of private fire hydrants in a manner consistent with
this Article.
(d) Reciprocity of Enforcement Agencies. The provisions of section 1302 and sections 1316 through
1318, inclusive, do not create any obligation for the enforcement agency to report violations to a fire
agency, or for the fire agency to report violations to the enforcement agency. However, this
subsection does not preclude either enforcement agencies or fire agencies from sharing information
related to fire prevention or suppression in parks.

!l1302. Local Fire Prevention Code Enforcement.
(a) Pertaining to parks for which the department is the enforcement agency, a fire agency, as defined
in this Article, may elect to assume responsibility to enforce its fire prevention code in parks within
its jurisdictional boundaries by providing the department with a written 30-day notice pursuant to
Health and Safety Code Section 18691(d).
(b) The written notice assuming enforcement responsibilities shall clearly identity the geographical
boundaries of the jurisdiction of the fire agency and include the name and address of each park
located within these geographical boundaries.
(c) The fire agency that has assumed responsibility to enforce its fire prevention code in parks
within its jurisdictional boundaries pursuant to this Article, shall do all of the following:
(I) enforce its fire prevention code as it applies to each of the following areas: fire hydrant systems,
water supply, fire equipment access, posting of fire equipment access, parking, lot identification,
weed abatement, debris abatement, combustible storage abatement and burglar bars.
(2) Apply its code provisions only to conditions:
(A) that arise after the adoption of its fire prevention code;
(B) not legally in existence at the adoption of its fire prevention code; or
(C) that, in the opinion of the fire chief, constitute a distinct hazard to life or property. Any reporting
requirements imposed by the local agency fire prevention code shall be in addition to, and shall not
replace, the reporting requirements of this Article.
(3) Upon assuming responsibility to enforce its fire prevention code in parks within its jurisdictional
boundaries, the fire agency shall notify all park operators of the assumption of enforcement
responsibility .
(A) This notification shall include identification of the specific applicable codes that will be
enforced, where copies of the identified codes may be obtained, and the scope and proposed
timeframe of any established or proposed inspection program.
(B) The park operator shall post a copy of the notification in the park as near as possible to the
location where the annual permit to operate is posted in order to advise the residents of the change in
enforcement jurisdiction.
