Background: California Integrated Waste Management Board receives an annual appropriation from the California Tire Recycling Management Fund to administer the Tire Recycling Act and related legislation. The Board has allocated funds for the Waste Tire Enforcement Grant Program. Funds allocated by the Board for the Waste Tire Enforcement Grant are for inspection, compliance and survey activities at waste tire facilities, tire dealers and auto dismantlers. The intent of this activity is to develop and implement an effective inspection and compliance program at the local level that will provide guidance to facility operators, and if necessary, take initial enforcement action necessary to remediate threats to public health, safety, and the environment. These activities will enhance the City's current tire enforcement program and compliment enforcement actions by the State. To date, a total of 75 inspections of local tire dealers were successfully completed by the City's Environmental Projects staff. Of these inspections, it was determined that only one site was not in compliance with State laws. The total number of registered haulers within the City has increased by 20% since last year. In addition, training was offered to the Police Department on the current waste tire storage and hauling regulations. Currently, the City is in the final phase of completing enforcement and survey activities for the 2000102 Waste Tire Enforcement Grant. City staff has noticed a substantial decrease in the number of illegally stockpiled tires as a result of the program. In addition, by increased enforcement activities, it has reduced the occurrence of illegal tire dumping. Grant funds will be used by the City to continue local monitoring, enforcement, and education efforts for a fourth grant period. This will permit the City to continue the current education and monitoring of waste tire generators and haulers. The grant term is from July 1, 2002 through April 1 , 2004. Financial Impact: The amount requested in grant funding is $22,392 for a two year period. There are no matching funds required by the City. Of this total request, $21,920, or $10,960 per year, is used to offset personnel costs within the Environmental Projects Division. The remaining $472 will be utilized for printing and distribution of educational materials. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: WHEREAS, funds allocated are available from the California Integrated Waste Management Board for grants to solid waste Local Enforcement Agencies (LEA) and cities and counties with regulatory authority within the City and County government to perform waste tire enforcement surveys and compliance activities at waste tire facilities; and WHEREAS, the City proposes to implement a Waste Tire Enforcement Program that involves inspection and compliance activities at tire dealers, auto dismantlers, and waste tire facilities that will reduce illegal stockpiling and disposal of waste tires, The City has demonstrated it has sufficient staff resources, technical expertise, and experience with similar projects to carry out the proposed program; NOW, THEREFORE, be it resolved that the Mayor and Common Council of the City of San Bernardino authorizes the submittal of an application to the California Integrated Waste Management Board for a Waste Tire Enforcement Grant (attached hereto as Exhibit "A"). The Mayor of San Bernardino, or her designee, is hereby authorized to execute in the name of the City of San Bernardino all necessary contracts, agreements, and amendments for the purposes of securing grant funds and to implement and carry out the purposes specified in the application. The residential public education campaign did show a measurable increase in the volume of beverage containers recycled as measured in prelpost tonnage reports. Tonnage was tracked for the three months immediately following the public education campaign showing an average increase of 11 tons per month. Pre/post consumer surveys were not conducted for the residential pUblic education campaign. The effectiveness of the pilot stadium recycling program was measured by interviewing the custodial staff and the monitoring of beverage containers collected in dedicated recycling containers and in adjacent trash containers. The program education and collection methods such as receptacle placement and verbal reminders were modified until recovery was maximized. Actual quantity recovered was estimated based on sales of bottled beverages: 6,000 units bottled water in plastic, 6,120 units sports drinks & sodas in plastic, and 48 glass beer bottles. The City adopted its charter in 1905 and has a strong Mayor form of government, with a seven-member Council elected by ward. The City of San Bernardino experiences an on-going social and economic problem resulting from illegal dumping and stockpiling of tires. This problem includes the following attributes: . Annually, the City estimates that 258,000 waste tires may be generated within the City, of which at least 10% may be illegally transported and/or disposed of within the City. . On public right-of-ways, approximately 10% of the City's right-of-way crew's time is directed towards the problem of illegal tire dumping. This represents a significant cost to the City. The illegal stockpiling and disposal of waste tires within the City of San Bernardino contributes significantly to the overall problem of blight within the City, resulting in reduced property values and depressed conditions. When tires are illegally dumped on private property, it becomes the responsibility for the property owner to remove them. If the property owner fails to take action, the City, through an abatement process, will remove the tires and place a lien on the property for the costs of abatement. In some locations, these property owners are repeatedly victimized by illegal tire dumping, to the . point that the abatement liens exceed the value of their property. Illegal tire dumping further contributes to secondary problems such as illegal trash dumping and graffiti. Tire piles also provide a breeding ground for rodents and mosquitoes. These vectors are known to carry diseases that threaten public health. The City received funding for a third grant term in 2000/02 from the CIWMB for the implementation ofa Waste Tire Enforcement Grant. Site visits to facilities, development and distribution of educational materials, and coordinated cooperation from related departments were the key elements of this grant. Through the grant, the City was able to continue using an easy-to-understand brochure that contained information on tire disposal regulations, necessary fire department permits, and options for tire disposal services. Instead of handing the brochure during the site visit, stafffound that it was more effective to mail the brochure along with a letter to notifY the facility of our upcoming visit. This gave facility managers ample time to gather the required materials for inspection and also gave them an opportunity to ask questions and discuss the material with a City staff member prior to an inspection. This approach gave facility managers plenty of time to prepare for the inspection and the opportunity to address any issues with non-compliance. Facility managers have been appreciative of this method because the inspections didn't interfere with their business day. However, regular unscheduled site visits still prove to be the most effective method of ensuring compliance. e e e Previously, 30,000 tires were stockpiled in various locations within the City. With the funding from the previous three grant terms for the Waste Tire Program, we have considerably decreased the number of tires stockpiled. Currently, approximately 600 tires are illegally stockpiled at various locations within the City. The reduction of illegally stockpiled tires is due to the continuous inspection/compliance activities; and through our efforts to inform the City's Police Department and Code Compliance Department of waste tire storage and hauling regulations. Grant funds would enable the City to continue local monitoring and enforcement efforts for a fourth grant term. If funding is received, a full-time staff member would be dedicated part-time to the program, continuing the current education and monitoring of waste tire generators and haulers. OBJECTIVES The primary goal for this grant is to maintain a local waste tire enforcement program. Utilizing the inspection/compliance and survey activities available through this grant will enable the City to further reduce the environmental impact of illegal tire stockpiles and illegal tire dumping within the City. Grant activities will be complimented by the approaches and techniques already developed and implemented by the City of San Bernardino to manage used tires. The proposed program combines both state and local efforts to increase the likelihood that appropriate actions will be taken by tire dealers, auto dismantlers and waste tire facilities to properly dispose of waste tires. Objective 1 -Program Development The City's Environmental Projects Assistant assigned to the grant will revise and maintain a current list of tire dealers, auto dismantlers and waste tire facilities within the City limits. The educational brochure developed under the previous tire grant will be reviewed for any necessary changes and printed for distribution to all facilities. Initially, the brochure will be mailed to facilities with a cover letter. The mailing will notify all facility operators of the City's ongoing Waste Tire Program. This objective will be completed within 30 days. Objective 2 - Initial Field Survey Immediately following the mailing, the Environmental Projects Assistant will visit each site, conduct a survey of their current waste tire inventory, provide them with an additional copy of the educational brochure and answer any questions the facility operator may have about the program. Technical assistance regarding issues related to waste tire reporting, processing and disposal will also be provided. Previous studies have documented illegal waste tire piles throughout the City. Staff from the Public Services Department will partner with the City's Code Compliance Department to identify any additional facilities. This information will be used to compare against studies conducted after compliance/inspection and survey activities have concluded to determine program effectiveness and compliance with local and state regulations. This objective will be completed with 90 days of grant initiation. 2 e e e Objective 3 - Periodic Update Survey There are currently 63 tire dealers and 12 auto dismantlers within the City of San Bernardino. Three waste tire facilities that store more than 500 tires have been identified within the City limits. The Environmental Projects Assistant will perform inspection/compliance and survey activities on identified sites within the grant term. Objective 4 - Compliance Activity. The City will review the three identified waste tire facilities within the City during the Initial Field Survey to determine current status at each site. In addition, the City will identify any new or previously undisclosed sites. Once a site has been determined to accept or store 500 or more tires, the City shall prepare and issue a Letter of Violation (LOV) to the owner/operator of the site. If a facility is non-compliant, copies of the LOV shall be forwarded to the City's Code Compliance and Fire Departments to ensure a complete, thorough review of each site and a coordinated response to any potential violations, if necessary. Once a facility is determined to be in compliance with the regulations, staff will send a letter notifying them that there were no violations found during the inspection. On a weekly basis, the City shall monitor the issuance of the LOVs to ensure the receipt of Corrective Action Plans (CAP) by the deadlines outlined in the LOV. Upon receipt of the CAP, the City will forward a copy of the CAP to the CIWMB's Tire and Enforcement Agency, Permitting and Enforcement Section for review. Upon review and approval of the CAP, the City will continue to monitor each site to ensure the CAP time schedule is being met. A Warning Letter will be issued by the City in the event that the owner/operator of the site fails to submit a CAP, or fails to comply with the schedule outlined in the CAP. The Warning Letter will identify the action(s) the owner/operator must undertake to come into compliance and the deadline for completion. When unable to obtain a CAP or when the owner/operator continually fails to meet the deadlines set forth in the Warning Letter, the City will refer the file to the CIWMB's Tire and Enforcement Agency, Permitting and Enforcement Section for additional enforcement. When necessary the City will coordinate a response against the owner/operator through the City Attorney's Office for possible civil or criminal prosecution. This objective will be ongoing throughout the grant term. METHODOLOGY The City will utilize staff from the Public Services Department to conduct the inspection/compliance and survey activities outlined in this grant. The City currently employs four full-time Environmental Projects Assistants. One Environmental Projects assistant will be assigned the tasks outlined in the grant. The Environmental Projects Assistant assigned to the grant will continue to be responsible for the implementation and management of this program when grant funding is no longer available. 3 e e e Task 1 - The City's current list of tire dealers, auto dismantler and waste tire facilities will be revised to include all businesses currently selling or storing waste tires. Each business will be contacted to determine the quantity of waste tires that are accepted or stored on their premises. Tire dealers or dismantlers identified as Waste Tire Facilities that store over 500 tires will be categorized for enforcement/compliance and survey activities. Those storing less than 500 tires will be categorized for survey activities. Task 2 - Tire dealers, auto dismantlers and waste tire facilities will be surveyed monthly to determine if they are using registered waste tire haulers for tire removal and properly manifesting waste tire disposal. Surveys will be conducted using forms provided by the California Integrated Waste Management Board, Tire Enforcement Branch. Copies of surveys for facilities with more than 1,500 tires will be submitted to the Board at the end of each month. Each month sites will be reviewed to determine if any violations of State or local requirements have occurred since the last visit. Task 4 - The City shall prepare and issue the Letter of Violation (LaV) to the owner/operator of the facilities that are found to be out of compliance with State and local statutes or regulations. Copies of the Lay will be forwarded to the City's Code Compliance and Fire Departments to ensure a complete and thorough review of each site and a coordinated response to any potential violations. Task 5 - The City shall monitor the issuance of the Lavs on a weekly basis to ensure receipt of Corrective Action Plans (CAP) by the deadlines set forth in the LaV. Upon receipt of the CAP, the City will forward a copy of the CAP to the CIWMB's Tire and Enforcement Agency, Permitting and Enforcement Section for review. Upon review and approval of the CAP, the City shall monitor each site to ensure the CAP time schedule is being met. This close monitoring reduces the opportunity for owners/operators to ignore compliance requirements. Task 6 - The City will issue a Warning Letter to owner/operators for sites that fail to submit a CAP, or fail to comply with the schedule outlined in the CAP. The Warning Letter will identify the action(s) the owner/operator must undertake to come into' compliance, as well as the deadline for completion. Task 7 - When unable to obtain a CAP from the owner/operator, or if the owner/operator consistently fails to meet the deadlines outlined in the CAP, the City will refer the file to the CIWMB's Tire and Enforcement Agency, Permitting and Enforcement Section for additional enforcement. In addition, the City will coordinate a response against the owner/operator through the City Attorney's office for possible civil or criminal prosecution. This integrated enforcement approach permits the City to leverage all available resources in order to gain compliance. Qualificatiolls The City's Department of Public Services has a full-time permanent staff of 180. The Department's Refuse Division is comprised of the Automated Residential Collection Unit, the Subscription Refuse Service Unit, the Street Sweeping Unit, the Recycling and Environmental Projects Unit, and Refuse Administration. The Refuse Division is 4 e e e responsible for the collection of refuse, recyclables, green waste and waste tires from residential and commercial accounts within the City's corporate boundaries. In 1995, the City of San Bernardino enacted a local ordinance and designed a program to deal with the issue of illegal tire disposal within the City. The City adopted the Used Tire Management Ordinance on June 20,1995, attempting to close several leaks in the State's waste tire reporting and manifest programs. The ordinance included an increased local penalty for illegal tire dumping: Under this program, staff visited all identified sellers of new and used tires within the City and provided them with information regarding both the State's waste management programs and the City's ordinance. Field audits of dealers to ensure compliance with local and state requirements were also planned. The passage of AB 21 08, which changed the point of collection fee to the point of retail purchase on January I, 1997, combined with a change in City staff, resulted in the City temporarily suspending the active development of it's Used Tire Management Program. The City has worked closely with the Tire Enforcement Unit of the CIWMB in order to seek abatement of illegal tire stockpiles within the City. As a result of this joint effort several tire piles were abated, either through direct threat of legal action from both the State and City levels, or through an increased awareness and closer monitoring at the City level. In addition, the City's residential refuse collection service permits residents to discard one tire per collection day, with a maximum of four tires in any three-month period. These tires are collected separate from the refuse and diverted to a local tire processor. In 2001, the City collected approximately 89.85 tons or 7,188 tires. Over the past seven years the City has coordinated enforcement activities with the CIWMB's Tire and Enforcement Agency, Permitting and Enforcement Section, demonstrating the City's ability and capacity to carry out these actions in a timely manner. Additionally, the City received funding from the CIWMB for the implementation of a 2000/02 Waste Tire Enforcement Grant. The City is close to completion of this grant program. Mallagemellt Persollllel Mike Moore, Environmental Projects Assistant, has coordinated the City's Waste Tire Surveillence and Enforcement Program for the past two years. In addition to the Waste Tire Program, Mr. Moore works with other staff members in coordinating the City's Used Oil Program and the City's Household Hazardous Waste Program. Mr. Moore has a Bachelor of Arts Degree in Public Administration from the California State University, San Bernardino. Linda Ceballos, Environmental Projects Manager, has over seven years of experience in the development and implementation of grant funded community resource programs for the City. Ms. Ceballos supervises a staff of four full-time Environmental Projects Assistants. A few of the duties that Ms. Ceballos is responsible for include the coordination of the City's recycling program and four grant funded projects. Ms. Ceballos has an Associate of the Arts Degree in Communications from Chaffey Community College in Rancho Cucamonga, California. 5 e e e Lynn Merrill, Director of Public Services, has over fifteen years of experience in the development of community resource programs, including presentations on a variety of topics, and the coordination of large, multi-faceted projects. Mr. Merrill has a Bachelor of Science Degree from the University of California, Riverside and a Masters Degree in Public Policy from Claremont College. Cooperative Efforts The staff coordinating the Waste Tire Program has developed a strong partnership with the City's Code Compliance Department, as well as the Police Department. Both code compliance field officers and police officers have been informed of waste tire storage and hauling regulations by the Public Services staff. The enforcement of these regulations by Code Compliance and the Police Department have been instrumental in the completion of the objectives outlined in the City's Waste Tire Grant. EVALUATION On a monthly basis City staff will monitor the number of illegally dumped tires reported by residents and City staff to determine if a 10% reduction in tire dumping has occurred as a result of the program. The City will compare the number of reports in the current period to the number of past reports to measure effectiveness. Program success will also be determined using the inspection/compliance and survey activities outlined by the grant. Monthly surveys will indicate the level of compliance with state and local regulations regarding disposal and hauling waste tires, as well as compliance when issued a Letter of Violation and/or Corrective Action Plan. Additionally, staff will prepare a monthly status report to measure the Waste Tire Program activities, discuss problems, and list Letters of Violation, Corrective Action Plans and follow up enforcement requirements on a site by site basis. 6 e e e BUDGET SUMMARY There are currently 63 tire dealers and 12 dismantlers within the City of San Bernardino; three of these facilities have been identified to store more than 500 tires. The estimated costs include all inspection/compliance and survey activities required to complete the activities within the grant term. The City believes that the funding is adequate to accomplish the tasks outlined. In addition to the work statement, a description is provided summarizing required expenses. A budget itemization is provided (Exhibit C). A. The City provides curbside, commingled recycling service to 45,000 single-family residencies within the City. Residents participating in the program have an opportunity to recycle glass, plastic, aluminum cans, steel cans, newspaper, mixed paper, cardboard. The City also provides the opportunity for residents to recycle greenwaste, used tires and used motor oil and filters. These items are collected curbside for the residents. In addition to residential recycling, the City has also implemented a commingled recycling program for businesses. The City's Municipal Code 8.24 sets forth the definition of recyclable materials and services provided by the City.
