Description) N/A Finance: Council Notes: QS~ Agenda Item No. /' CITY OF SAN BERNARDINO -REQUEST FOR COUNCIL ACTION Staff Report suB.1ECT: Resolution authorizing an application to the Local Agency Formation Commission for a reorganization between the Cities of San Bernazdino and Highland generally along portions of 3`a Street between Tippecanoe Avenue and a point 232 feet east of Shirley Avenue BACKGROUND: As a result of recent development proposals within San Bernardino International Airport (former Norton Air Force Base) along the south side of 3`a Street, the widening of 3`a street will be necessazy pursuant to the requirements of the proposed industrial development and Circulation Element of the City's General Plan. Presently, the common corporate boundaries between the City of San Bernardino and the City of Highland in this azea run along the south side of 3`a Street between Tippecanoe Avenue and a point approximately 232 feet east of Shirley Avenue, with the exception of the azea between Del Rosa Drive and Del Rosa Avenue, south of Court Street. The City of Highland has jurisdiction over the entire portion of 3`a Street for this azea, except as noted above. Currently, the City of Highland would need to process any permits for street improvements, including curb cuts for driveways, that would occur as a result of development in the airport, which is under the jurisdiction of the City of San Bernazdino. The City of Highland has requested this realignment of boundaries to minimize any dual jurisdiction involvement for development that occurs along this portion of the airport. Additionally, Highland is recommending a change of boundaries for a portion along the north side of 3`a Street, lying between Del Rosa Drive and Del Rosa Avenue, south of Court Street, since the portion along 3`a Street, between Tippecanoe Avenue and just east of Shirley Avenue is within Highland's jurisdiction. A vicinity map and a map depicting the present and proposed boundary change is attached. Under this reorganization proposal, no pazcels would be annexed to the City of San Bernardino; Eleven pazcels would be de-annexed from the City and annexed by the City of Highland. The present land use of the azea to be de-annexed is a combination of residential, commercial, vacant and public facility. More specifically, there aze 4 vacant parcels; 2 parcels contain a well site for East San Bernazdino County Water District; 3 residential parcels and 2 commercial parcels, one of which is a boarded up market, and the other appeazs to be an auto repair facility. As part of the proceedings, Highland will contact the property owners within the azea proposed to be annexed to the City of Highland. The formal proceedings to be conducted by LAFCO will include mailed notices to the property owners within the area to be annexed and a public hearing will be conducted by LAFCO. If a majority protest is made by the property owners, the reorganization could be modified to exclude this area and address only the issue of realigning the boundazy along the centerline of 3`a Street. If the reorganization is approved as proposed, the property tax revenue, which is estimated to be approximately $600 per year to the City of San Bernazdino, would go to the City of Highland. Actual tax revenue dollars will be calculated as part of the proceedings. Since the area is within the Inland Valley Redevelopment Agency's Staff Report- continued (IVDA) boundary, most of any increases in property tax revenue (tax increment dollars) as a result of new development or redevelopment of this azea, would go to the IVDA regardless of which City has jurisdiction of this area. The benefit to the City of San Bernardino for this reorganization would be a more orderly development of the airport along this portion of 3`d Street, since the permit process for street improvements would be handled by one City, rather than two. The de-annexation of the block between Del Rosa Drive and Del Rosa Avenue from the City of San Bernardino and annexation to the City of Highland would benefit the azea by a more efficient delivery of services, including Police, Fire and Code Enforcement, since the area is bounded on three sides by the City of Highland and would reduce the confusion of public safety calls and have consistency of land use regulations on all properties on the northerly side of 3`d Street. The area containing the eleven privately owned parcels contains approximately 2.75 acres (including adjoining streets). This small peninsula of eleven pazcels protruding north above 3rd Street into the City of Highland was annexed in 1976 to the City of San Bernardino, prior to the incorporation of Highland in 1987. The perimeter of this block is approximately 1400 feet (measured along the centerlines of the adjoining streets). Currently, the City of San Bernazdino is responsible for maintenance of any existing curbs, gutters and sidewalks. If de-annexed from San Bernazdino, future responsibility for such street improvements would be Highland's. The area presently receives water distribution from East Woods Farms Community Water and maintenance of sewer lines is under the jurisdiction of East Valley Water. Water and sewer services would remain the same after this reorganization. Attached is a summary of pros and cons relative to the annexation of this block to the City of Highland. The City of Highland is acting as lead agent for this Reorganization and will pay the necessazy filing fees. The City of Highland has prepared the necessazy documents that will need to be filed with the Local Agency Formation Commission (LAFCO). On December 11, 2001, the City of Highland adopted a resolution authorizing the filing of the application for reorganization with LAFCO. The City of San Bernardino will be a co-applicant for this proposal and the attached resolution authorizes the filing of the application with LAFCO. FINANCIAL IMPACT: The City of Highland will pay any LAFCO fees for this proposal. Estimated tax revenues of $600 per year will go to the City of Highland; however, Highland will also assume the responsibility of street maintenance, police and fire protection and other related municipal services for this area. The amendment and pre-zone shall be completed within 60 days of an application being submitted to C 11 12 13 14 15 LAFCO. 3. The City of San Bernazdino shall accept (annex) from the City of Highland (detachment) the southerly 41.25 feet from the centerline of 3`d Street for maintenance, access permits and other governmental responsibilities associated with public right-of--way. 1 4. The City of Highland shall accept (annex) from the City of San Bernazdino (detachment) the azea north of 3`d Street between Del Rosa Avenue and Del Rosa Drive and the portions of the public right-of--ways of Court Street, .Del 21~ Rosa Avenue, and Del Rosa Drive. The City Councils of the City of San Bernardino and the City of Highland shall both accept all standard conditions as required by LAFCO. WHEREAS, the reasons for this proposed boundary adjustment between the City of San Bernardino and the City of Highland aze as follows: 1. Assist property owners and public in understanding the jurisdictional boundazies between the City of San Bernazdino and the City of Highland. 2. Improve essential services such as street maintenance and repair, public safet}~, and fire protection, knowing that the centerline of 3rd Street will be the boundary between the two Cities and that the public right-of--ways of Court Street, Del Rosa Avenue, and Del Rosa Drive will be fully within the corporate boundary of the City of Highland. 3. Coordinate property development standazds and essential services such as 1 streets, police and fire protection, and land use implementation in a more defined corporate boundary between the two Cities. 4. Permit the City of San Bemazdino to properly address the development of the 21I San Bernardino International Airport by adequately reviewing access to 3`d Street and any development projects that may be proposed and not have to obtain an entitlement and/or permit from the City of Highland. DATE SIGNATURE OF APPLICANT • • • FACTORS OF CONSIDERATION FOR BOUNDARYADJUSTMENTBETWEEN THE CITIES OF HIGHLAND AND SAN BERNARDINO Physical Factors in Favor of the Boundary Adjustment The City of Highland presently surrounds the approximate three acres area of developed property currently within the corporate boundaries of the City of San Bernardino. The area is essentially an "island" surrounded by the City of Highland and is developed with a variety of land uses of commercial, light industrial and nonconforming residential units. The San Bernardino City land use designation of the area is CG1 (Commercial General) which will not significantly change if the area is annexed to the City of Highland. With regards to 3rd Street, the majority of the public right-of-way is within the corporate boundary of the City of Highland. The boundary adjustment between the two Cities will also include the adjustment of the two Cities' boundary to be the centerline of 3'd Street. The new boundary will permit each City to maintain access control to property within its corporate boundary. In addition, half of Del Rosa Avenue, Del Rosa Drive, and Court Street will be detached from the City • San Bernardino and annexed to the City of Highland. Present and Planned Uses in the Area The land uses of the area to be detached from the City of San Bernardino and annexed to the City of Highland consists of a mix of commercial, light industrial, and nonconforming residential uses. The City of Highland intends to pre-zone the area to compliment the land use district Commercial General of the City of San Bernardino encompassing the private and/or developable parcels. The 3'' Street public right of way will remain as is. The City of San Bernardino will install and/or construct improvements to accommodate the development of industrial projects on the sou#herly side of 3'd Street as necessary. Capacity/Adequacy of Public Facilities and Public Services The area will not require the extension of any public facilities (i.e., water, sewer, streets, etc.) to accommodate the existing land uses. If in the future the property owners submit an application to improve/develop their property, the appropriate analysis will be conducted to determine the adequacy of such facilities. • Water Service -Water service is presently provided by a East Valley Water District (formally East San Bernardino County Water District). The service will not change as a result of this boundary adjustment between the two Cities. • Factors for Consideration LAFCO Boundary Adjustment January 2002 page 2 Sewage Services -Sewage disposal services are currently being provided by one of two ways. First, some of the lots are being served by public sewers. East Valley Water District serves as the sewer purveyor and as property owners request a connection to the public facility the District will determine the feasibility and do the necessary work. Secondly, many of the properties of the area are on private disposal systems (i.e., septic tank, leach line, etc.). If the property owner in the future request a connection to the existing sewer line, the District will be directly involved with the planning and installation of the connection. In either case, the City of Highland does not foresee any additional public facility and/or service required as part of this boundary adjustment between the two Cities. Fire Service -Fire services are presently provided by the City of San Bernardino Fire Department for the private land area and by the City of Highland's fire service contractor, the California Department of Forestry, for incidents that may • occur on 3'd Street. However, both Cities have mutual aid agreements and assist each other when the need arises, especially when the corporate boundary is the area of the incident. A positive impact of the change in boundary is that the service provider for the properties along the northerly side of 3rd Street will be just the City of Highland and not two cities as presently exists. Law Enforcement Services -Law enforcement services for the City of San Bernardino and City of Highland are provided by the City of San Bernardino Police Department and Highland's service contract provider, the San Bernardino County Sheriffs Department, respectfully. The boundary adjustment between the two Cities will change only slightly with each jurisdiction increasing and decreasing service area. The continuity of services along the northerly boundary wi11 be of a benefit to the property owners in that one law enforcement service will assume responsibility of the entire area. The factor can also be attributed to the public right-of-way exchange between the two Cities. Road Maintenance Service -Road maintenance services will change in that the City of San Bernardino will incur costs for maintenance of the southerly half of 3'd Street. This increased area to San Bernardino is offset by the City of Highland's increased area of maintenance of half of Del Rosa Avenue, Del Rosa Drive and Court Street. However such increased maintenance is minor and subordinate to • the enhanced benefit of service to each city and more particularly to the City of San Bernardino to control the access to those properties that front 3'd Street. • Factors for Consideration LAFCO Boundary Adjustment January 2002 page 3 Land Use Services -Land use services such as planning, building and code enforcement will transfer to the City of Highland. Many of the properties are in a state of disrepair and some of the land uses are nonconforming. The effort to maintain health and safety conditions will be that of the City of Highland. A significant benefit will be the consistency of land use regulations, codes, and enforcement. Presently, the area has a mix of regulatory agencies overseeing land use issues which may cause land uses and standards to be at odds. • Existing and Proposed Redevelopment Areas, Improvement Zones, and Infrastructure Financing Districts The proposed boundary adjustment will not impact any existing improvement zone, redevelopment area, assessment district, or community facilities district. The boundary adjustment will affect the tax increment financing incumbence the property for the Inland Valley Development Agency. The transfer of the financing mechanism from the City of San Bernardino to the City of Highland wil be required.
