REDEVELOPMENT PROJECT TO RE-ESTABLISH THE POWER OF EMINENT DOMAIN OVER
NON-RESIDENTIALLY DESIGNATED PROPERTY AS DESCRIBED IN THIS STAFF REPORT.

STAFF REPORT
Request to Initiate An Amendment To The State College Redevelopment Project Area
BACKGROUND
With the improving local economy, the Agency is seeing increasing development interest throughout
the City. The State College Redevelopment Project, established on Apri127, 1970 and encompassing
approximately 1800 acres, is an area in which there is great interest. In recognition of these
development trends, it is important for the Agency to have a variety of tools available to assist
redevelopment. One of the most effective tools for redevelopment is the power of eminent domain.
However, the power of eminent domain in the State College Project Area expired on January 1, 1999.
This proposed amendment would reinstate the power of eminent domain for 12 years over only those
properties that are within non-residential land use districts in the General Plan or are currently being
used for non-residential purposes. This amendment will not affect residentially used or designated
property.
CURRENT ISSUE
Prior to hiring consultants, conducting a public workshop or requesting a joint public hearing before
the Mayor and Common Council and the Community Development Commission, the Agency must
request that the Community Development Commission initiate this amendment.
ENVIRONMENTAL IMPACT
None.
FISCAL IMPACT
Based on contracts entered into with consultants for the first 5 project area amendments, the costs for
this amendment are estimated to be approximately $20,000. Specific cost amounts will be provided
to the Committee once consultants are under contract for the work.
