Background: This project consists of removal of existing curb, gutter and sidewalk and construction handicap access ramps to meet ADA requirements. This project will provide easier accessibility for disabled citizens to public or private facilities; therefore staff is proposing to move forward with this project as soon as possible. Plan and specifications for this project are complete. The project is ready to be awarded. The estimated project costs are as follows: Construction Cost $ 158,274.00 Contin encies $ 20,000.00 Desi n, Ins ection, and Contract Administration $ 21,726.00 Total $200,000.00 This project was advertised locally in the San Bernardino County Sun Newspaper, F.W. Dodge, Green Sheet, Daily Construction, Bid America, Plan Room, the City's web site, and with the San Bernardino Area Chamber of Commerce. Fischer Plumbing is the lowest responsible bidder for ADA access ramps 8 at various locations, per Plan No. 10356. A contract is awazded accordingly to said bidder in 9 a total amount of $158,274.00 with a contingency amount of $20,000.00 but such award shall 10 be effective only upon being fully executed by both parties. All other bids, therefore, are 11 12 hereby rejected. The Mayor is hereby authorized and directed to execute said contract on 13 behalf of the Ciry; a copy of the contract is on file in the office of the City Clerk and • 14 incorporated herein by reference as fully as though set forth at length. 15 SECTION 2. This contract and any amendment or modifications thereto shall not take 16 effect or become operative until fully signed and executed by the parties and no party shall be 17 18 obligated hereunder until the time of such full execution. No oral agreements, amendments, 19 modifications or waivers are intended or authorized and shall not be implied from any act or 20 course of conduct of any party. 21 SECTION 3.
