Synopsis of Previous Council Action:
7/9/01 Allocation of $250,000 ($237,000 remaining) in the 2001/02 Capital Improvement
Program (CIP) for disabled access ramps at various locations Account No's. 126-369-5504-
7235 ($89,400) and 129-367-5504-7202 ($160,600).

STAFF REPORT
Subject:
Resolution awazding contract to Fischer Plumbing for ADA access ramps at various locations,
per Plan No. 10356.
Background:
This project consists of removal of existing curb, gutter and sidewalk and construction
handicap access ramps to meet ADA requirements. This project will provide easier
accessibility for disabled citizens to public or private facilities; therefore staff is proposing to
move forward with this project as soon as possible.
Plan and specifications for this project are complete. The project is ready to be awarded. The
estimated project costs are as follows:
Construction Cost $ 158,274.00
Contin encies $ 20,000.00
Desi n, Ins ection, and Contract Administration $ 21,726.00
Total $200,000.00
This project was advertised locally in the San Bernardino County Sun Newspaper, F.W. Dodge,
Green Sheet, Daily Construction, Bid America, Plan Room, the City's web site, and with the San
Bernardino Area Chamber of Commerce. The following six companies responded:

Based on review of the sealed competitive bids received, staff has determined Fischer Plumbing
the appazent low bidder, has met the minimum requirements of the specifications and bid
guidelines, and therefore staff recommends that the Mayor and Common Council awazd the
referenced contract accordingly.

Financial Impact:
Funding for this project in the amount of $236,200 is budgeted in FY 01-02 from Gas Tax and
1/2-Cent Sales Tax funds in Account No's. 126-369-5504-7235 ($89,400) and 129-367-5504-
7202 ($146,800).
Recommendation:
Adopt resolution.

3 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AWARDING A CONTRACT TO FISCHER PLUMBING, FOR ADA
4 ACCESS RAMPS AT VARIOUS LOCATIONS, PER PLAN NO. 10356.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
6 CITY OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. Fischer Plumbing is the lowest responsible bidder for ADA access ramps
8 at various locations, per Plan No. 10356. A contract is awazded accordingly to said bidder in
9 a total amount of $158,274.00 with a contingency amount of $20,000.00 but such award shall
10
be effective only upon being fully executed by both parties. All other bids, therefore, are
11
12 hereby rejected. The Mayor is hereby authorized and directed to execute said contract on
13 behalf of the Ciry; a copy of the contract is on file in the office of the City Clerk and
• 14 incorporated herein by reference as fully as though set forth at length.

SECTION 2. This contract and any amendment or modifications thereto shall not take
16
effect or become operative until fully signed and executed by the parties and no party shall be
17
18 obligated hereunder until the time of such full execution. No oral agreements, amendments,
19 modifications or waivers are intended or authorized and shall not be implied from any act or
20 course of conduct of any party.

SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
22
~ within sixty (60) days of passage of the resolution.

adopted Resolution 2002-82 -Resolution awarding a contract to Fischer Plumbing for ADA
access ramps at various locations, per Plan No. 10356.

contracts. Please obtain signatures where indicated and return one fully executed original
contract to the City Clerk's office as soon as possible.
