STAFF REPORT
Subject:
Resolution of the Mayor and Common Council of the City of San Bernardino authorizing
execution of an agreement between the City of San Bernardino and the San Bernardino City
Unified School District for financial assistance in the amount of $5,000 from Asset Forfeiture
funds in support of the Junior Police Academy at Lytle Creek Elementary School.
Background:
A request was received from Lytle Creek Elementary School for Civic and Promotion funding in
the amount of$19,000 for FY 2001/2002 for the Junior Police Academy Program. The Ways
and Means Committee reviewed the request in the fall of 200 1. The Committee took no action at
that time, and requested additional information concerning the status and results of the program.
That information was subsequently forwarded to the Committee in a memo from Teri Rubi,
dated December 10,2001, and in a letter from G. Jackson, principal of Lytle Creek Elementary
School, dated November 29,2001 (attached).
Since that time, it was determined that $5,000 is available in the Police Department's Asset
Forfeiture account to fund the Junior Police Academy program for the remainder of the fiscal
year. At the February 6, 2002 meeting of the Ways and Means Committee, G. Jackson, Lytle
Creek Principal, was asked to prepare and submit a program budget for the remainder of the
fiscal year. That information is attached as Exhibit "A". The Committee recommended approval
of the $5,000 allocation to fund the program, with a $5',000 matching funds requirement from the
San Bernardino City Unified School District.
Financial Impact:
Funds in the amount of $5,000 are available in the Asset Forfeiture Reserve Drug and Gang
Education designated fund balance for this program.
Recommendation:
Adopt resolution, and authorize the Director of Finance to amend the FY 2001/2002 Adopted
Budget and appropriate $5,000 from the Asset ForfeittiteFund balance to account number 108-
271-5505 (Asset Forfeiture professional/contractual) to fund the Junior Police Academy at
Lytle Creek Elementary School.

Jr. Police Academy Program

At the December 5th meetm:g of the Ways and Means Committee, committee members
questioned whether or not the Jr. Police Academy at Lytle Creek Elementary School is
currently active. This office contacted the school's principal. Ms. Jackson said that the
academy is currently active and participating in parades through the help of volunteers.
The volunteers are previous Jr. Police Academy participants and they have promised to
keep the program going until February.
Ms. Jackson was under the impression that funding for the program from the City would
be coming any day. She was not aware that the Ways and Means Committee had decided
to fund the program for the second half of the school year only. Ms. Jackson also
expressed concern that she may not be able hire an instructor this late in the year.
The attached letter from Ms. Jackson provides some information regarding success of
students who have attended the program.

Dear Ms. Rubi:
This letter was requested by Mr. Narciso Cardona, Assistant Superintendent of Student
Services, regarding our Junior Police Academy (1.P.A.). A brief overview of the Junior
Police students reflects a variety of positive outcomes.
All J.P.A. students are taught self discipline, appropriate citizenship, and life skills.
Overall, students' attendance is 96%, in comparison to the state average of 94%. Some
1.P.A. students that transitioned into the middle school, continued in the Intermediate
Police Academy (I.P.A.),'When'ihe program existed at the middle school level.
The high expectations of our J.P.A. program carry over into all aspects of our students'
lives. Self-discipline promotes positive behavior in our students and they acquire the
desire to become productive citizens in their communities. This self-discipline benefits
our students greatly in reaching their educational goals. They learn how to focus and
attend to the task at hand, This skill helps our students respond positively to authority
figures, which helps them in their interactions at school. They, in turn, are aware that
they are viewed as positive role models.
The emphasis on attendance also positively affects our students' academic experiences.
They assist school regularly,which helps them attain consistency in their learning
acquisition. This regular attendance promotes a gap-free education. Students are,
therefore, better prepared and have a more positive approach to their education. J.P.A.
promotes positive and appropriate behaviors, close to perfect attendance, and productive
citizens in our communities.
As an example oflifelong leaming through the 1.P.A. program, we currently have four
high school students, former J.P.A. cadets, who are volunteering their time to work with
our new 1.P.A. cadets. These high school students have continued striving for excellence
in their lives. They are all college bound and positively involved in their educational
endeavors.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and
directed to execute on behalf of said City, an agreement with the San Bernardino City Unified
School District for an Asset Forfeiture fund allocation in the amount of$5,000, a copy of which
is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though
set forth at length.
SECTION 2. The authorization to execute the above referenced agreement is
rescinded if the parties to the agreement fail to execute it within sixty (60) days of the adoption
of this resolution.

Use of Funds.
The funds paid to Organization shall be used solely for the purposes set forth in
Paragraph 1 above. No deviation from these provisions shall be made without the express

Financial records shall be maintained in accordance with generally
the expenditure of the funds. All books and records of Organization are to be kept open for

entered into with the understanding that the San Bernardino City Unified School District will

18 provide a dollar-for-dollar match up to $5,000, at the conclusion of the program, Organization

shall present the City Administrator or his designee copies of all receipts for expenditures

connected with said program in the total amount of $10,000. If Organization does not submit
receipts totaling $10,000 which City deems appropriate, Organization shall remit to City one-half
of the difference between $10,000 and the amount of said appropriate receipts so submitted.

of the use or receipt of the funds paid hereunder and all operations under this agreement.
Payments hereunder are made with the understanding that the City is not involved in the

performance of services or other activities of Organization. The costs, salary and expenses of the
6

City Attorney and members of his office in enforcing and defending this Agreement on behalf of
8 the City shall be considered as "counsel fees" for the purpose of this paragraph.

Insurance.
While not restricting or limiting the foregoing, during the term of this
agreement, Organization shall maintain in effect policies of comprehensive public, general and
automobile liability insurance, in the amount of$I,OOO,OOO, per occurrence combined single

limit, naming the City of San Bernardino, its officers, employees and agents, as additionally
14
15 insured. Said coverage shall require ten (l0) day written notice to the City if insurance is
16

terminated or materially altered.
7.
Termination.
City shall have the right to terminate this agreement by mailing a ten-day written notice
19
to Organization and this agreement shall terminate ten days after the mailing of such notice. In

the event this agreement is terminated for reasons of improper use of funds or use of funds for
any purpose other than those authorized, any unexpended portion of the funds provided by City
shall be returned to City. In addition, Organization shall reimburse to City any funds expended
24 which were used for any purpose other than those authorized under this agreement.

Organization hereby covenants that it has taken all actions necessary to

Entire Agreement.
This agreement and any documents or instruments attached hereto or
5 referred to herein integrate all terms and conditions mentioned herein or incidental hereto, and
6 supersede all negotiations and prior writing in respect to the subject matter hereof. In the event

of conflict between the terms, conditions or provisions of this agreement, and any such document
or instrument, the terms and conditions of this agreement shall prevail.
