Synopsis of Previous Council Action:
On October 1, 2001,the Mayor and Common Council adopted Resolution No. 2001-304, a
Resolution of the City of San Bemardino amending Resolution No. 6413, Section Ten, entitled
in part "A resolution ... establishing a basic compensation plan ... ` ; by updating information
codifying prior Council Actions (General Unit).
On October 1, 2001, the Mayor and Common Council adopted Resolution No. 2001-305, a
Resolution of the City of San Bernardino amending Resolution No. 6413, Section Eleven,
entitled in part, "A Resolution ... establishing a basic compensation plan ... ` ; by codifying
prior Council actions (Middle Management Unit).
On February 25, 2002, the Personnel Committee recommended this item for approval.

STAFF REPORT
SUBJECT
A Resolution amending Resolution No. 6413, Section Ten (General Unit) and Section Eleven
(Mid-Management Unit), which establishes salaries and classification for employees in these
assigned bazgaining units.
Effective January 1, 2001, California Senate Bill 739 altered the requirements for employee
associations to request the right to an agency shop. An agency shop agreement between a union
and the City of San Bernardino requires all employees in a bargaining unit to become dues
paying members, or alternatively, pay an equivalent fee to the union. The San Bernardino Public
Employees Association (SBPEA) complied with all the mandated requirements set forth in SB
739. On October 19, 2001, the State of California Department of Labor Relations mailed ballots
to all General Unit Employees as identified by the City. The ballots were due to the State of
California on November 6, 2001; on November 14, 2001, representatives of the City of San
Bemazdino, SBPEA and the State of California counted the ballots. A total of 207 ballots were
received; 140 voted for the agency shop with 67 voting against it.
The Agency Shop has brought to light an issue involving unit assignment of employees working
for elected officials. Under the City Charter, employees of elected officials aze unclassified and
as such are considered "at will employees." In spite of this, there are fourteen (14) employees in
ten (10) classifications assigned to the General and Mid-Management bazgalning units who work
for elected officials. The City Attorney's Office has issued an opinion, which determined that
assignment to these bazgaining units conferred certain rights on these employees, which are in
conflict with the City Charter. In an effort to rectify this conflict, staff is recommending these
positions be removed from the General Unit and Mid-Management salary resolutions and under
a sepazate action be covered by the newly retitled "Management/Confidential and Unclassified"
Resolution. The affected positions aze as follows:

Under sepazate Council action, these employees will be placed in the Management/Confidential
and Unclassified Association. The City met and reached agreement with the San Bemazdino
Public Employees Association on this issue, and the effected employees have been notified of
this action and the change in benefits.
Once assigned to the Management/Confidential and Unclassified Association, these affected
employees will receive the benefits and salary increases as stated in the
Management/Confidential and Unclassified Association agreement.
The effective date of these changes will be Mazch 15, 2002.
FINANCIAL IMPACT
There is no fmancial impact to the City to remove these positions from the General and Mid
Management salary resolutions.
