STAFF REPORT
Subject:
Resolution awarding contract to Silvia Construction, Inc. for pavement rehabilitation on 40th
Street from east of Sierra Way to Waterman Avenue, per Plan No. 10240.
Background:
This project consists of cold milling (grinding) 0.2 feet of the existing street and replacing it
with new asphalt pursuant to the design consultant's recommendation, street repairs, crack
sealing, and striping. This section of road experiences significant vehicular traffic and the
original pavement section has deteriorated. It is currently in poor condition; therefore staff is
proposing to move forward with this project as soon as possible. The city hired Ludwig
Engineering for the amount of $45,624.00 to prepare the plans and specification for this
pavement rehabilitation project in addition to the 40th Street widening project between Electric
Avenue and Acre Lane.
Plan and specifications for this project are complete. The project is ready to be awarded. The
estimated project costs are as follows:
Construction Cost $ 127,718.75
Contingencies $ 20,000.00
Design, Inspection, and Contract Administration $ 65,281.25
Total $ 213,000.00
This project was advertised locally in the San Bernardino County Sun Newspaper, F.W. Dodge,
Green Sheet, Daily Construction, Bid America, Plan Room, the City's web site, and with the San
Bernardino Area Chamber of Commerce. The following seven companies responded:

STAFF RE,PORT
Based on review of the sealed competitive bids received, staff has determined that Silvia
Construction, Inc. the apparent low bidder, has met the minimum requirements of the
specifications and bid guidelines, and therefore recommends that the Mayor and Common Council
award the referenced contract accordingly.
Financial Impact:
Funding for this project, in the amount of $315,900 has been budgeted in FY 01-02 from AB
2928 Fund, and 1/2 Cent Tax Fund Account No's. 129-367-5504-7212 ($155,900) and 135-378-
5504-7212 ($160,000).
Recommendation:
Adopt resolution.

This memorandum is in response to the inquiries regarding the 40th Street Pavement Rehabilitation
Agenda Item No. 14. The design costs listed actually cover both this rehabilitation project and the
future street widening project on 40th Street between Electric Avenue and Acre Lane, (estimated
construction/ROW cost of well over $1,000,000). Of the $45,624 design cost, approximately 75% to
80% is related to the more complex street-widening project.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SA1\"
BERNARDINO A WARDING A CONTRACT TO SILVIA CONSTRUCTION, INC., FOR
PAVEMENT REHABILITATION ON 40TH STREET FROM EAST OF SIERRA WAY
TO WATERMAN A VENUE, PER PLAN NO. 10240.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Silvia Construction, Inc. is the lowest responsible bidder for pavement
rehabilitation on 40'h Street from east of Sierra Way to Waterman Avenue. per Plan No. 10240. A
contract is awarded accordingly to said bidder in a total amount of 5127,718.75 with a
contingency amount of 520,000.00 but such award shall be effective only upon being fully
executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby
authorized and directed to execute said contract on behalf of the City; a copy of the contract is on
14 file in the office of the City Clerk and incorporated herein by reference as fully as though set
15 forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of passage of the resolution,
