CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
Staff Report
Subject: Resolution of the Mayor and Common Council of the City of San Bernardino
authorizing execution of a contract for services between the City of San Bernardino and the City
of Fontana for full service anima1 control.
Background:
State law requires that all cities and counties must provide rabies control programs that include
an animal shelter system, animal bite reporting and investigations, stray animal control, animal
rabies case investigation, quarantine of biting dogs and cats, quarantine of domestic anima1s
potentially exposed to rabies, and other activities for the purpose of carrying out and enforcing
the provisions of the California Rabies Control Program.
The City of San Bemardino has been providing comprehensive anima1 control services to the
City of Fontana since August 1993. The current month-to-month agreement between the two
cities is an extension of the last contract that expired 12/31/1998.
Several meetings and workshops have occurred between anima1 control staff and Fontana staff to
determine the appropriate contract for the residents of Fontana. The basic cost for the contract is
$480,000 each year, with increases for MOO and CPI. During a Fontana Council workshop
relating to animal control, the desire was expressed that one additional animal control officer and
two additional part-time License Checkers be included in the new contract. This report and the
financial impact figures reflect these additions to staff levels. If approved, this agreement would
make three animal control officers available to the City of Fontana and would meet with their
desire to have more animal control officers working every weekday. The addition of two
License Checkers was recommended so that Fontana could recover some of the costs associated
with the contract and to help secure compliance with license and vaccination laws. This new
contract will also enable the City of Fontana to begin to sell dog licenses to residents of Fontana
at their City Halllocation.
The services in the agreement remain largely the same, but there are changes that reflect
compliance with certain state and local laws and contemporary animal control practices. These
changes include:
· Removal, during normal operating hours, of any wild anima1 (other than rodents or insects)
caught in a trap or found inside any human dwelling. Increase after-hours emergency
response to include wildlife that directly threatens a person's safety.
. Pick up, upon request, any confined stray cat or any trapped cat during normal operating
hours. Traps are to be purchased and maintained by the City of Fontana.
. Extended shelter hours, including open on Mondays (previously closed) and evening hours
on Tuesdays (untiI7pm).
,
. 24 hour live answer call service.
. Emergency on call response for all injured or sick animals. (previously only injured stray
dogs and cats). This new provision would enable Fontana to be in full compliance with state
laws regarding this service.
. Advice and direction on (outdoor) wildlife exclusion and abatement.
. Phone information menu in Spanish as well as a Spanish speaking Office Specialist and
Animal Control Officer.
. Extended coverage in evenings.
. Assistance with stray cat colony removal.
Standard service includes impound care and disposal of dogs and other domestic or wild animals.
Enforcement of all provisions of the Fontana Municipal Code and state laws as they apply to
animals. Stray dog removal and dead animal removal. Investigation of alleged acts of animal
cruelty, dog fighting, cock fighting and animal neglect. Provide euthanasia services. Dog
license administration. Provision of education and information presentations. Veterinary
services for all injured or sick domestic animals. Quarantine of biting animals. 24 hour
emergency response. Administration of Fontana noise code.
This agreement was approved by the Fontana City Council on December 18,2001.
Financial Impact:
At the 1/22/02 Council Meeting, the Mayor and Council approved the addition of staff to the
Animal Control Department. Part of the cost of the staffing additions was to be offset from
increased revenue from the contract with the City of Fontana. Total revenue from the Fontana
contract was estimated to be approximately $534,600. Now that negotiations with the City of
Fontana are complete, total revenue for FY 2001-2002 is estimated to be $26,200 more than
anticipated, bringing the total to $560,800. Because the Animal Control Fund is supported by the
General Fund, this increased revenue will be a savings of $26,200 to the General Fund.
Therefore, a budget amendment reflecting the both the increased revenue of $26,200 to the
Animal Control Fund (124-000-4757) and the corresponding reduction in the transfer from the
General Fund to the Animal Control Fund (124-000-6450) is required.
This contract will automatically renew for two years unless one the parties requests re-
negotiations, in writing, prior to March 31, 2002. Total contract revenue from the City of
Fontana in FY 2002-2003 is estimated to be $572,000 and revenue in FY 2003-2004 is estimated
to be $572,000 plus adjustments tied to the Urban Consumer price index.
Total revenue for the three year-period of 7/1/01 through 6/30/04 is approximately $1,704,800
Recommendation:
I.) Adopt Resolution
2.) Authorize the Director of Finance to amend the FY 2001-2002 Adopted Budget and increase
contract revenue in the Animal Control Fund (124-000-4757) by $26,200 to reflect increased
contract revenue from the City of Fontana, and to decrease the transfer in to the Animal Control
Fund from the General Fund in a corresponding amount (124-000-6450).
