Senator Robert Kenne<ly was shot to death with a Saturday niiht special. Within months, Congress responded by passing the Gun Control Act of 1968. That law made it illegal to import into the United States handguns that fail to meet specific safety standards. In 1968 Conifess banned the ilT\POrtation of Salurda,y nillht speci&.l!l!iunk jpllIs into the - United States. The NRA sJUlPOrted the ban. However, because at the time these guns were primarily made overseas, the law did not establish the same safety standards for domestic manufacturers. Through that loophole emerged a half dozen southern California companies set on cornering the market for poorly made, concealable, cheap handguns that are favored by young criminals. As a result these guns continued to be sold in our communities. John Hinkley Jr used a domestically manufactured Saturd~ niiht !ij:)llCial in his assassination attempt on former President Ronald Rllaian. Today the problem is worse than ever with a handful of California gun manufacturers producing 80 percent of the Saturday night specials sold in the entire country. I have introduced legislation that simply applies the same safety standards to domestic manufacturers that we apply to foreign manufacturers. Senate Bill 500 is a common sense, responsible gun law. If certain guns are so poorly made we have not allowed them on our shores for nearly 30 years, why are we allowing a small group of gun manufacturers to continue to produce them here in California? The manufacturers argue that people oflesser means should be able to buy these poorly made, unsafe guns. But ask yourself, would we allow cars to be sold without headlights, brakes, seatbelts and other safety features so they would be more affordable? Of course not. Seven of the ten illnS most commonly confiscated at crime scenes are Saturday niiht &Ptlcials. Thirty California cities have passed local ordinances prohibiting the sale of these guns within their city limits. This month. the people of I,ivermore California lIPproved a ballot mea~ure hannin~ the sale of such weapons. Californians recognize that tougher sentencing and "Three Strikes" is not enough. We must also invest in prevention and we must stop the flow of cheap, disposable handguns that are so often used in violent crimes. Attorney General Dan Lunven's policy council that investiiated wl\Ys to reduce violent crime in California recommends a ban on Saturday niiht &Ptlcials. My legislation, Senate Bill 500 would do just that. Earlier this month the California Senate voted in support ofSB 500. SB 500 will next be heard in the State Assembly. I need your help. POLANCO TWENTY-SECOND SENATORIAL DISTRICT SENA TE BILL 500 FACT SHEET The pUJ1lose of this bill is to prohibit the manufacture and sale/transfer in California of handguns commonly known as "Saturdav ni8ht specials". At the federal level, the importation of "Saturday night specials" has been banned through the enactment of the Gun Control Act of 1968. Section 92S(d)(3) of the act provides that a firearm shall be imported ifit is ofa type .....generally recognized as particularly suitable for, or readily adaptable to, sporting purposes," The phrase "sporting purposes" has been defined to eliminate small, poorly constructed handguns, A factoring criteria was designed to prevent the importation of these handguns. The factoring criteria is based on a relatively simple point system. First the firearm must meet all of the prerequisites. Pistols must have a manually operated safety device. The combined length and height must be not less than ten inches with the height being at least four inches and the length at least six inches. Revolvers must pass the safety test and have an overall frame length ofatleast four and one half inches and barrel length of at least three inches. In addition, a point value is assigned to the handgun's individual characteristics such as length of barrel, overall length, frame. construction, weight, caliber, safety features, type of sight, trigger, hammer and grip. Generally, the handguns passing this criteria are bigger, heavier and of a better quality than "Saturday night specials". Under Senate Bill 500 (polanco) the same standards and criteria established for guns imported into the United States would be applied to California manufacturers and dealers. The Attorney General would be responsible for compiling a catalogue of handguns that fail to meet the requirements and are therefore unlawful. The catalogue would be distributed to dealers and law enforcement personnel. Minnesota, Maryland, Hawaii, Illinois and South Carolina all currently have laws in place that prohibit "Saturday night specials". California would be the sixth state to take such action.
