That the request by Richard Pope for authorization to install an
lS-inch high retaining wall to encroach into the street rights-of-
way, at the northwest corner of ninth Street and "D" Street, be
approved, in principle; and the City Attorney be directed to
prepare a standard form License Agreement.

CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
The building on the northwest corner of Ninth Street and
"D" Street is currently being renovated. Landscaping will be in-
stalled under the 50/50 cost sharing arrangement through the
Ci ty' s Economic Development Agency. A copy of this letter is
attached for reference.
A request has been received from Richard Pope, Landscape
Architect, by letter dated 6-20-97, for an encroachment permit to
allow construction of an 18-inch retaining wall into the street
rights-of-way. This wall will be installed on the boundaries of
the original planter, which apparently encroached into the right-
of-way without proper authorization.
The parkway along Ninth Street is 9.25 feet, and will be
decreased to 7.75 feet where the retaining wall will encroach.
Along "D" Street, the parkway varies from 9.25 to 14 feet. At
those locations where the wall will be installed, the parkway
will be reduced to 6.25 to 11 feet. A miniMum width of 4 feet
will be Maintained for the sidewalks, in order to provide
handicap access.
A standard form License Agreement has been developed to
authorize the encroachMent of private facilities into a street
right-of-way. This agreement provides, in general, that the
applicant may install the item wi thin the street right-of-way,
but the City may direct that it be reMoved at any such time as
necessary to accommodate a public purpose.

Dear Roger:
This letter is to request an encroachment permit for the project at 404 W. Ninth Street. The encroachment consists
of adding an 18" high retaining/garden wall with planting, in already existing planters, 18" into the R.O.W. along
Ninth Street, 7'-6" at the corner of Ninth and "D" into R.O.W. (please note building at this corner is already in
R.O.W.) and 3' along "D" Street.
