Synopsis of Previous Council Action:
02-17-86 - Resolution No. 86-47 was adopted, declaring that all land within the boundaries of Assessment
District No. 971 will be benefited by the construction of a fire station.
03-17-86 - Resolution No. 86-82 was adopted, finding that the public interest, convenience and necessity
required the formation of Assessment District No. 971
05-19-97 - Authorization was given to terminate Assessment District No. 971

STAFF REPORT
Assessment District No. 971 is a City-initiated Assessment District that was established to reimburse the City for
construction costs of Fire Station No. 11. The assessments were to run for a period of 10 years. Revenues for the
construction of the fire station were derived from the sale of Certificates of Participation. The COP's were paid off
by the City several years ago, but the assessments, which went to reimburse the City, were to be collected through
the 1998-99 Tax Year.
Proposition 218, which was approved by the voters last November, requires the continuance of assessments in any
existing assessment district to be subject to approval of a majority of the property owners within the district.
However, certain types of assessment districts are exempt from Proposition 218' s requirements. After reviewing
Assessment District No. 971, it was determined that the district is not exempt, and therefore would require
approval by property owners. It is unlikely that approval would be obtained since the fire station has already been
built and the assessments were just to reimburse the City.
On May 19, 1997, authorization was given to terminate the assessment district. The attached resolution formalizes
this action.
We recommend termination of Assessment District No. 971.
