Adopt Resolution AND 2. REQUEST FOR COUNCIL ACTION STAFF REPORT The Central City Parking District was formed in 1977 to provide for the acquisition and improvement of the three downtown City parking Lots #1, #2 and #3, and to provide for the ongoing maintenance, operation and security of the three lots. Bonds were sold in the amount of$I,950,000 to provide funds for the acquisition and improvement of the three lots with a 25 year repayment. The revenue source for annual debt service is derived from assessments on the various parcels within the district. In addition to the bond payments, the cost of maintenance, operation and security has also been assessed against the parcels within the district. The bond repayment and the maintenance, operation and security costs comprise the total of Roll I. Credits are given for on-site parking spaces on each parcel, as well as 75% of the area tax generated by each parcel. Although EDA is not assessed directly on parcels it has acquired since the formation of the district, they pay the assessments on EDA owned parcels directly, pursuant to an agreement between the City and EDA. The attached summary shows the breakdown ofR011l , with the various credits. In 1979, it was determined that additional parking facilities were needed. Funds for the expansion of district lots #2 and #3 were loaned to the District from the City's General Fund in the amount of$812,763.45, with a 28 year payback. An annual amount of $30,300 is assessed as Roll 2. Proposition 218, approved by the voters last November, requires that all existing assessment districts that do not fall into one of the various exemption categories, be approved by a majority of the property owners. After reviewing the this district with the City Attorney's office, it was determined that the bond repayment portion of RollI was exempt from the procedural and approval requirements of Proposition 218. The maintenance operation and security portion ofR011l and all of Roll 2, however, are not exempt and would need property owner approval. Additionally, the method of assessment would also have to be brought in compliance with Proposition 218, requiring are-engineering of the district. Due to time constraints and deadlines for submitting rolls to the County, there is not enough time remaining to accomplish the re-engineering of the district this year. The Economic Development Agency will include in their proposed 1997/98 Budget to finance the costs for maintenance, Operation and Security, and Roll 2. A presentation of this proposal was made to the Parking Place Commission at a special meeting scheduled on July I, 1997. The Parking Place Commission took action at their May IS' 1997 meeting to direct preparation of the bonded portion of Roll 1, which was approved by the Commission at their June 19, 1997 meeting.
