Synopsis of Previous Council action:
Ordinance No. 1915 was enacted in 1951 to control the loitering of persons under the age
of eighteen (18) years.
On AprilS, 1993, MC-866 amended chapter 9.68 of the San Bernardino Municipal Code
relating to a juvenile curfew.
On May 20, 1996, MC-967 renumbered 9.68.060 and added sections 9.68.060, 9.68.070
and 9.68.080 to the San Bernardino Municipal Code relating to minors being on the streets during
school hours and reimbursement for costs of curfew violations.
Recommended motion:
That said Urgency Ordinance be adopted.

An Ordinance of the City of San Bernardino Adding
Chapter 9.69 of the San Bernardino Municipal Code
Relating to Minors being in or on Public Streets, Public
Grounds or other Public Places during School Hours
and Declaring the Urgency Thereof
In MC 967, dated May 20, 1996, Section 9.68.060 was renumbered and Sections 9.68.060,
9.68.070 and 9.68.080 were added to the San Bernardino Municipal Code relating to minors
being on the streets during school hours and reimbursement for costs of curfew violations.
It is requested that the Mayor and Common Council amend in its entirety, Chapter 9.68 and
devote it solely to juvenile curfew issues. As a result of this amendment it is requested that a new
chapter, Chapter 9.69 be added to the San Bernardino Municipal Code relating solely to truancy
issues and minors being in or on public areas during school hours.
The creation of separate chapters of the San Bernardino Municipal Code will facilitate the
determination of violations of these sections by those persons empowered to enforce the San
Bernardino Municipal Code.
It is requested that the Council ordain that this proposed ordinance take effect immediately for the
preservation of the public peace, health and safety. The urgency is supported by the fact that the
current truancy provisions are contained within Chapter 9.68 of the San Bernardino Municipal Code
which is being amended in its entirety to solely address juvenile curfew issues. If the new proposed
Chapter 9.69 is not immediately enacted the City will be unable to enforce violations of minors being
in public areas during school hours. The City has a compelling interest in having juveniles be in
school during the days schools are in session.
