Synopsis of Previous Council action:
Ordinance No. 1915 was enacted in 1951 to control the loitering of persons under the age of
eighteen (18) years.
On AprilS, 1993, MC-866 amended chapter 9.68 of the San Bernardino Municipal Code relating to
a juvenile curfew.
On May 20, 1996, MC-967 renumbered 9.68.060 and added sections 9.68.060, 9.68.070 and
9.68.080 to the San Bernardino Municipal Code relating to minors being on the streets during school hours
and reimbursement for costs of curfew violations.
Recommended motion:
That said Urgency Ordinance be adopted.

An Ordinance of the City of San Bernardino Amending
Chapter 9.68 of the San Bernardino Municipal Code
Relating to a Juvenile Curfew and Declaring the Urgency
Thereof
Currently, San Bernardino Municipal Code, Title 9, Section VII. Chapter 9.68 enumerates offenses
by or against minors. These specifically include curfew and truancy violations, exceptions and
penalties.
The United States Court of Appeals for the Ninth Circuit, on June 9, 1997, reversed the United States
District Court of the Southern District of California in Nunez v. City of San Diel!o (1997) 1997 U.S.
App. Lexis 13409 on the grounds that a San Diego curfew ordinance, similar to ours was
unconstitutional for a variety of reasons.
By amending Chapter 9.68 to include broader exceptions for legitimate activities, with or without
parental permission and to more narrowly tailor the language within the chapter, the ordinance would
avoid the problems that currently exist with the current Chapter 9.68 as it relates to curfew
restrictions. This would assure that we are in compliance with the Nunez decision.
It is important to maintain a juvenile curfew ordinance as the City has a compelling interest in
protecting the entire community from crime, including juvenile crime. The City's interest in
protecting the safety and welfare of its minors is also a compelling interest. The Police Department
has provided statistical support for the nexus between the curfew and the City's compelling interest
of reducing juvenile crime and victimization. That information was reviewed by the City Attorney's
office. It is requested that the Council ordain that this proposed ordinance take effect immediately
for the preservation of the public peace, health and safety. The urgency is supported by the Nunez
decision and the questionable validity of our own code section regulating juvenile nocturnal activity.
