STAFF REPORT
RESOLUTION AUTHORIZING AN AGREEMENT
TO PROVIDE FACILITIES FOR COMMUNITY
SCHOOLS PROGRAM.
The Parks, Recreation and Community Services Department has worked
closely with the San Bernardino County Superintendent of Schools
since 1994 to provide Community Schools programs at City community
centers. This arrangement has several advantages. The Community
Schools program allows local youth to return to school in a less
restrictive environment. The youth are generally from the local
neighborhood and their use of the facility through the Community
Schools program have resulted in a reduction in graffiti and
vandalism. The schools utilize classroom space at the centers in
off-peak hours so there is no imposition on the general public.
Improvements have been made to the centers by the schools.
This agreement formalizes the arrangements between the City and San
Bernardino County Superintendent of Schools. This will allow for
the continuation of the existing programs now located at five
community centers.

COl\IMUNITY SCHOOL CLASSROOM AGREEMENT

I. PARTIES INVOLVED
This Agreement is made and entered into by and between the San Bernardino County Superintendent of
Schools, bereinafter called SUPERINTENDENT, and City of San Bernardino Parks. Recreation and
Community Services Deoartment, hereinafter called CITY.
D. DURATION OF THIS AGREEMENT
The term of this contract shall be from date of signing and on-going.
DI. SERVICES TO BE PROVIDED
WITNESSETH:
A. WHEREAS, SUPERINTENDENT has the ability and resources to provide a Community School
program for the length of time described in this agreement for the CITY; and
B. WHEREAS, SUPERINTENDENT will provide services in accordance with
SUPERINTENDENT'S policy, contract and procedure. Information will be provided to the CITY
prior to providing the service; and
C. WHEREAS, CITY has the need and desire for the SUPERINTENDENT to provide such services
under the following conditions.
NOW IT THEREFORE, mutually agreed between parties to the following conditions for the provision of services:
IV. PROGRAM COMPONENTS
A. The CITY will follow prescribed procedure as developed by the SUPERINTENDENT for
referring students to the SUPERINTENDENT'S program.
B. Subjectlaught in the Community school by SUPERINTENDENT include reading/language arts,
math. social science, art and physical education. Particular emphasis will be given to proficiency
preparation and social behavior.
C. All instructional material will be provided by the SUPERINTENDENT.
D. The method of instruction for facility pupils is under the discretion of the
SUPERINTENDENT.

E. The SUPERINTENDENT'S Community Schools programs provides a 240-minute
instructional day.
F. The SUPERINTENDENT will operate a traditional school year (September through June) and non-
traditional programs unless the CITY requests otherwise. Program calendars will be coordinated
between the SUPERINTENDENT and CITY.
G. The SUPERINTENDENT does not transport students.
H. The facility will have appropriate staff on site to respond to immediate caI1s for
assistance for crisis interventions.
I. When feasible, SUPERINTENDENT will make SUPERINTENDENT facilities i.e.
classrooms/conference rooms available for CITY use.
V. PERSONNEL
A. The SUPERINTENDENT will provide appropriate personnel for the provision of services under
State requirements and conditions.
B. The personnel assigned will be under the supervision of the SUPERINTENDENT and will be
employees of the SUPERINTENDENT.
C. The SUPERINTENDENT will provide an itinerant principal to supervise all program operations
and personnel. The SUPERINTENDENT'S principal will work with the CITY staff to enlist
support during emergencies.
VI. CLASSROOM
The CITY agrees to provide an appropriate classroom facility for the SUPERINTENDENT to conduct
activities related to classroom instruction.
The classroom(s) shan be located and operated at various community centers throughout the City of San
Bernardino.
A. Classroom has been inspected for .asbestos and has been determined to not have any friable
asbestos as well as relevant building codes.
B. Telephone must be available and supplied by SUPERINTENDENT. The telephone will only be
used by SUPERINTENDENT employees or students for emergencies.
C. All windows and doors must be able to be locked, and/or interior secured storage area is available.
D. SUPERINTENDENT will provide basic classroom furniture other than tables and cbaits.
E. Adequate recreational area, when available, for students to participate in physical education
activities and sports leagues.
F. The CITY will provide adequately supplied restroom facility for students and
SUPERINTENDENT'S employees.

G. CITY agrees to provide necessary utilities and regular custodial services and to provide upkeep
and maintenance including heating/cooling of the classroom and furniture.
H. Facility must be approved by SUPERINTENDENT'S facility staff prior to initiation of program
services.
1. SUPERINTENDENT will make capital improvements to CITY facilities to facilitate
SUPERINTENDENT's use of facility. All improvements must have CITY approval before
construction.
J. The SUPERINTENDENT may provide specialized equipment for program use when
CITY classroom meets security standards. CITY has no liability for stolen equipment.
VII. HOLD HAm-fi..ESS
A. SUPERINTENDENT shaII defend, indemnify and hold CITY, its officers, agents and employees
harmless from and against any and all liability, loss, expense (including reasonable attorney fees),
or claims for injury or damages arising out of the performance of this Agreement but only in
proportion to and to the extent such liability, loss, expense, attorneys' fees or claims for injury
or damages caused by or result from the negligence or intentional acts or omissions of
SUPERINTENDENT, its officers, agents or employees.
B. CITY shall defend, indemnify and hold SUPERINTENDENT, its officers, agents and employees
harmless from and against any and all liability , loss, expense (including reasonable attorney fees),
or claims for injury or damages arising out of the performance of this Agreement but only in
proportion to and to the extent such liability, loss, expense, attorneys' fees or claims for injury
or damages caused by or result from the negligence or intentional acts or omissions of CITY, its
officers, agents or employees.
vm. TERMINATION CONDITIONS
A. Whenever it shall be necessary for either party to give notice to the other, such notices sbaII be
sent to CITY at the following address: 547 Sierra Wav. San Bernardino. CA 92410 ,and
SUPERINTENDENT at the following address: 601 North E Street. San Bernardino. CA 92410-
3093; and such notice shall be deemed to be completed five (5) days after the same has been
deposited in any United Stats post office. All other notices and correspondence, other than notice
of termination, may be sent by regular mail.
B. This agreement may be terminated at any time by giving the other party thirty (30) days written
notice of such action in accordance with parsgraph VIII, A.
