Recommended Motion:
That the Director of Public Works and the City Clerk be authorized to proceed under SBMC 12.90, with the
establishment of a Landscape Maintenance Assessment District in the Elm Avenue and Coulston Street Area,
within Tract No. 15777, to be known as Assessment District No. 1023.

STAFF REPORT
On 5/27/97, we received a petition from the developer/owner of Tract No. 15777, located on Coulston Street,
West of Elm Avenue, for the establishment of a Landscape Maintenance Assessment District. This petition is a
result of a requirement of the development for the installation of landscaping along Coulston Street. The
establishment of an Assessment District for provide funding for the ongoing maintenance.
The tract is being built in 3 phases, with the first phase being built at this time. The landscaping will be installed,
and assessments levied as each phase develops.
Part of the proceedings includes the preparation of an Engineer's Report, which will have details regarding the
improvements, method of determining benefit and assessment amounts. In compliance with Proposition 218, the
proceedings will also require that ballots be mailed to the property owners relative to the proposed assessment. We
anticipate that the petitioner will still own most, if not all, of the properties involved and do not expect a majority
protest.
We recommend that authorization to establish the assessment district be granted.
