Dear Mayor and Common Council:
first, I make clear for the record by this Letter Report and Photolog that we are not
adversaries of Redlands Federal Bank or their maneuvers for the release of their September
30,1985 $1.3 Million Instrument of Credit for Performance and Obligations to the City. We
addressed this release and the prior approved constructive alternative at the May 5, 1997
Council Public Hearing along with submitting our May 5, 1997 letter and documentation to
the Mayor/Council and City Clerk for the Official Public Record (see tab 7).
We are adamant in our belief that the Planning/City Attorney's Offices have not
discharged their public responsibility in this long standing matter (1980-1997) in that they
recommend to the Council only how to foster this continued neighborhood "Blighted
Dump". The Planning/City Attorney Offices provide no productive course for the Council to
follow in achieving the needed alternative, increased property values to the citizens and
generated public revenues for a plummeting City General Fund.

We were disappointed for the community in hearing the further representation made at
the May 5, 1997 Public Hearing by Planning/City Attorney offices, which we believe were
misrepresented. Though it was humorous to the Mayor, Council and everyone, including
myself, listening to the City Attorney influence the Public Hearing while watching his T.V.
monitor and phoning the council dais from his sixth floor compound was a sad experience on
the face of it.

However, it is not humorous when effected citizens are curtailed by being allowed to
speak only three (3) minutes to represent their honestly believed facts at a Public Hearing
KANGEROOED by the Planning/City Attorney offices. The City's three (3) minute policy then
forces effected public and parties to be subjected to MINDLESS RIDICULE for their hard work in
preparation and submittal of applicable documentation for the Public Record and the only
alternative of legal action if required.
This letter is further regarding the above referenced May 5, 1997 Mayor/Common
Council Public Hearing and Agenda Item 27 as recommended by the Planning/City Attorney
offices. This matter is commonly referred to as (Sterling Heights) Tentative Tract No. 15775
Reversion to acreage, but in truth being the Release of Redlands Federal Bank $1.3 Million
Instrument of Credit for Performance given to the City and that remains in effect for
construction of the January 22, 1986 Dedicated Sterling A venue and Daley Canyon Roads.
These are City required Public Health and Safety Primary and Secondary Emergency Access
roads.

This letter is also regarding, but not limited to, Planning/City Attorney offices on-
going representations to the public and Council relative thereto that this action is exempt
from CEQA and has no imvact on Sterling Heights' Tentative Tract No. 14112 November
7, 1990, May 18, 1993 and May 24, 1993 Planning/City Attorney's Offices prior
conditions, requirements, etc.
Rancho San Andreas Company (RSA) had worked in cooperation with Redlands
Federal Bank beginning in December 1991 and further cooperated with the City in
September 1992 toward the above purpose, but with an constructive alternative to bring
about release of their Instrument of Credit for Performance given to the City. There was joint
concurrence with Sterling Heights, Secret Hollow Ranch and City property owners in
October 1992 to fonn an Improvement/Maintenance District, the owners and the City
reconfirmed this on December 18,1992. The City Engineer's requests for action was brought
before the Mayor and Council on December 21,1992.
Because of Planning/City Attorney's Offices curtailments, the constructive alternative
was not approved until May 24, 1993 by the Council's directive for the City Clerk and City
Engineer to proceed with the establishment of an Improvement/Maintenance District. The
purpose being for construction of the Redlands Federal Bank required 1122186 Dedicated
Sterling Avenue Primary and Daley Canyon Road Secondary Emergency Access serving the
Sterling A venue/Foothill Drive Area, 180:1: acre City Property to the north and the existing
100:l: homes to the northeast.

This improvement/maintenance district would allow RELEASE of the Redlands
Federal Bank $1.3 Million Instrument of Credit for Performance given to the City. Therefore,
as RSA and the other two property owners had volunteered on SePtember 30, 1992 to
consider paying one third (1m each of these improvement costs, less access and reservoir site

benefits paid for bv the EVWD, RSA's position is not that of an adversary to the Redlands
Federal Bank.
What is even more disappointing to me and for the community is the following:

1.
Redlands Federal Bank has owned this BUGHI'ED property or controlled its development by debt
for over fifteen (15) years or more. On May 5, 1997 under the recommendation of P1anning/City
Attorney offices the City gave them a CONSOLATION PIIlZE; release of their $1.3:1: million
Instroment of Credit for Perfonnance to provide their fonner developer's, Redlands Financial
Services, prior 1980-1985 representations and obligations given to the City and neighborhood.
What was once a beautiful estate with fifty (50) manicured acres of citroslfann, Sterling Heights,
has been transfonned over the years by Redlands Federal Bank or affiliates into a burned out and
abandoned blight on the surrounding City neighborhoods causing major depreciating property
values (see tab 9). In addition to that the 1992-1996:1: Property taxes or City Assessment
District fees in the range of $125,000:1:, including for Police and Fire services have not been paid
in years and all of this has been allowed to come about with the help of the P1anning/City
Attorney offices on-going curtailments.

In 1992 eight (8) WIWFIRES on their un-maintained Sterling Heights (50:!: acres) and
contiguous City owned property (180:!:) acres burned down hundreds of trees and costs the City
and others Fire Agencies $250:!: thousand to fight with equipment and air tankers.
4. In 1994 City Frre and Public Service Departments had to maintain the Sterling Heights property
by the grading of existing and new fire roads, clean out the dumped debris from the retention
basin and other dumped materials left on the upper abandoned Sterling Heights property.

However, City Frre and Public Services Departments left other 1994 public dangers and
nuisances including "burned out" home foundations, abandoned open concrete swirurning pool
and open steel reservoirs painted with pornography and racial graffiti slurs. This examples
Redlands Federal Bank ownership pride given to the City and the Planning-Building
Services/City Attorney offices lack of Code Enforcement at it's best.
Ironically, in 1991 the CitylSBMWD and the City/EDA mounted their January 22, 1986
Dedicated Sterling A venue east fallow 180:1: acre Little Sand Canyon Development. They
announced their development as being the answer to stop our citizens from leaving their homes
in San Bernardino for the preferred residential area of REDLANDS.
To mount their program, the City EDA and City/SBMWD hired Associate Engineers from
Rancho Cucamonga to prepare the plans and had their real estate brokers William E. Leonard
and Frank Schnetze acquire eight (8) acres of additional property for $360,000 to improve
access and the Foothill Drive frontage. This is approximately $45 thousand dollars per acre.
In truth even the City's own 180:!: acre property, a managed asset of the City Municipal Water
Department, is allowed by Planning/City Attorney offices to be maintained as nothing more than
a burned out dump. The City's property is a refu~e for the homeless and abandoned vehicles
stolen from the neighborhood.
9. This City property and area is nothing more than CLASSIC HUGHT perpetrated on the City
neighborhoods and surrounding properties causing major loss of property values and while
generating no Public Revenues to balance the City's depleting General Fund Budget.

regarding these issues was respectfully made. The Council unanimously directed such a meeting
and continued the matter to their April 7 , 1997 regular meeting.
11. However, not until thirty (30) days later on Thursday, April 3, 1997, 3 :30 P.M. did
Planning/City Attorney offices reluctantlv scheduled a last minute meeting with Redlands Federal
Bank and the effected parties. They came with incomplete documentation for discussion.
Friday, April 4, 1997 was a City Employee's furlough day and the Council meeting for the
continued matter was Monday, April 7, 1997, A.M.
12. In sincere response to the Planning/City Attorney offices unprepared April 3, 1997 meeting we
then went to great effort to prepare applicable documentation and factual background. Our
preparation was curtailed because of an immediate family death, but was handed Mr. Hayes,
Planning Director on April 25, 1997 with our applicable April 23, 1997 letter to both he and
Henry Empeilo, Jr., Deputy City Attorney, representing Mr. Penman. -
13. This was ten (10) days prior to the May 5, 1994 Public Hearing by the Council regarding the
Redlands Federal Bank Tentative Tract No. 15775 Reversion to Acreage and $1.3 Million
release of their Instrument of Credit for Performance. This left ample time for scheduling a
meeting with effected parties to meet with the Planning/City Attorney offices. Not hearing from
Mr. Hayes since our April 25, 1997 discussion I wrote to him regarding his non-response
carried in my April 30, 1997 letter (see tab 1).
14. On August 30, 1996 Redlands Federal Bank first submitted their application for Tentative Tract
Map NO. 15775 Reversion to Acreage (Sterling Heights). The true underlying purpose was I!lll
addressed what so ever and that being to esca!)e their applicable development company's,
Red1ands Fmancial Services, long standing representations and obligation to the City and
neighborhood under the September 30, 1985 Redlands Federal Bank Instrument of Credit for
Performance still in effect to the City.

Even more disappointing and sad to us and for the Community is the following:
1.
In the over eight (8) months of this process in futility, the whole thrust of Planning/City
Attorney offices has been how to proceed with undoing that which had already been
accomplished by the City and neighborhood starting in 1980 through 1985. This includes the
various repetitious steps and ordeals added by Planning/City Attorney's Offices through May
24, 1993.
This Planning/City Attorney Offices process in futility has taken years of staff time and
neighborhood input during 1980-1985 which was confirmed by Redlands Financial Services
representation and backed up by the September 30, 1985 Redlands Federal Bank Instrument of
Credit for performance to the City.
Now without one charted course toward productivity the Planning/City Attorney offices leave
the effected parties and surrounding property owners with cost/losses in the millions forced on
them. The City is left with this fallow unproductive property, including their own 180:!: acres,
used like a series of un-permitted neighborhood dumps.
4. The existing 100:1: homes to the northwest have been permitted by the City, including new
building permits, without their required Development Code Secondary Emergency Access. This
being a major potential City Public Health and Safety liability long known by Planning/City
Attorney offices and allowed to continue by their accumulative May 5, 1997 recommendations
approved by the Mayor and Common Council.

The PlanninglCity Attorney offices have abandoned their true obligation to the citizens to
discharge their responsibilities. This includes the charting of a productive course to generate
Public Revenues, Increased Property Values, jobs and equal quality of life for all of our
Citizens.
6. No one liked facing the truth of the recent articles written by the Sun; January, 26,1997 "Crrr IN
PFJlILANDFAIllNGFOKfUNES" and April 4, 1997, "CrrrSEEKSTOENDSwt".
It is time to face the underlying source of the City's plummeting General Fund and of
our "City in Peril" and "Falling Fortunes"

The January 26, 1997 Sun article describes the City homes and propeny values that have fallen
fifty (50) percent or more in many cases and accumulatively amounting to Billions. The article
even interviewed homeowners that wished they could pick their home up and move it to
Redlands for better value and quality of life.
2. The April 4, 1997 article discloses the costs and losses to the City for the Planning/City Attorney
offices ArdenlGuthrie debacle; $1.5 million legal fees paid the outside legal counsel to
recommend a $5.15 million settlement offer to the City for Mr. Penman's "Faked" code
enforcement sweep. Over and above that there has been $7:1: million of Costs and Losses already
accrued by the City. They now total $13.5:1: Million and are growing.

The PlanninglCity Attorney offices Arden/Guthrie DEBACLE costs and losses alone have
reached $13.5:1: million to the City. Even the U.S. Coun of Appeals agrees that Mr. Penman is
personally liable and cenainly the Council does or they would not have authorized the City
Attorney's outside legal counsel, Mr. Joe Arias, Esq. 's recommendation of adding another City
$5.15 Million settlement offer of public funds for Mr. Penman's 1991 Arden/Guthrie "Faked"
Code Enforcement DEBACLE.
4. According to The Sun's articles, the City's 1997-1998 General Fund Budget has a shonfall of
$7.2 Million. Mr. Aria's, Esq. settlement offer from the City of $5.15 Million for Mr. Penman
will not all come from the City's insurance company carriers and these cost could impact the
City's 1997-1998 General Fund shonfall of $7.2 Million and several millions more.

The City already has growing costs and losses in the Arden/Guthrie area of $8.5 Million, little
alone their recently added $5.15 Million settlement offer. Mr. Penman is also general legal
counsel to the City/EDA and acts as advisor to the City Council. Cenainly Mr. Penman will not
~empt to continuously siphoning millions more of public funds generated from the various
Redevelopment Project Areas to pay for his Arden/Guthrie PlanninglCity Attorney Offices'
"Faked" Development Code Enforcement debacle as he has in the past.
City Attorney Penman has used un-budgeted City public funds to pay his outside legal counsel,
Mr. Joe Arias, Esq. at least $2.5:1: Million to defend his multiple incompetencies and the City.
Mr. Arias has become so rich from Mr. Penman giving him the City of San Bernardino's ~
~thathe moved from our city's depressed Valencia Avenue and Country Club area to the
City of Redlands.

Mr. Penman represented his need of Mr. Joe Arias, Esq., as outside Associate Counsel to help
him because of the City's Significant Exposure to litigation pursuant to subdivision (6) of
Government Code Section 54956.1, Case No. SCV 01030, Le.: City Attorney Penman vs.
Rancho San Andreas Company, for June 1992 maintenance, fire control and aba1ement within
the existing dirt access of the January 22,1986 Dedicated Sterling Avenue Public Road right-of-
way.
The September 30, 1985 Redlands Federal Bank outstanding $1.3 Million Instrument of Credit
for Performance given to the City covers construction of the January 22, 1986 Ded;cated
Sterling Avenue and Daley Canyon Roads. On Anri127. 1992. the CitylSBMWD I!:ave an Entrv

The CityISBMWD and City Attomey's Office April 27, 1992 "Entrv Agreement" purpose was
for EVWD consultants massive grading and trenching by heavy bulldozer to locate future
pipelines, access and location for a new 3 to 6 million gallon reservoir within the January 22,
1986 Dedicated Sterling Avenue Area/East (see tab 6).
See tabs 2,3 and 4 photologs of results from he City/SBMWD and Mr. Penman's April 27,
1992 "Entrv Al!reement" allowed massive grading, un-permitted code violations by the EVWD
consultants from that time through March 1995. The on-going 1992-1995 TTI/ljor EVWD
consultants' bulldozer and heavv eauiDment activity disturbed the existing Sycamore Trees in the
1/22/86 Dedicated Sterling Avenue public Road right-of-way, crossed two stream course and up
700:tfeet of foothill ridgelines without compacted back-fill. This resulted in continuous 1992-
1997 TTI/ljor erosion and mud flows into neighborhood streets.
On January 26, 1996, the California Department of Fish and Game and Attorney General expen
ENFORCED the State RETROACTIVE 1601 Stream and Lake Alteratian Agreement upon the
City/SBMWD for their massive grading, un-permitted code violations (see tab 5) This
included the City/SBMWD on-going 1971-1995 dumping of asphalt petroleum products for
streamcourse dams, pipeline drain construction in the streamcourse, Bull-Dozinr out sycamore
tuu.for their 1.2 Million gallon Daley Carryon Reservoir construction, EVWD 3 to 6 million
gallon Sterling Avenue Reservoir and City/SBMWD 3 Million gallon Sterling/Foothill Drive
Reservoir. (For Discussion on June 2. 1997 Council Closed Session Arendal.

May 19, 1997 City Council Rejection of existing 1/22/86 Dedicated Daley Canyon
Road for Redlands Federal Bank:
on Monday, May 19,1997, the Council made their motion approving the Redlands
Federal Bank Final Tract Map No. 15775 (Sterling Heights) reversion to acreage. They had
approved the Tentative Tract Map with conditions, requirements, etc. on May 5, 1997 as
represented by Planning/City Attorney's Offices, with the City to accept ROWand slope
easements for the January 22, 1986 Dedicated Sterling Avenue and Daley Canyon Road.
Planning/City Attorney's Offices did not divulge on May 5, 1997 to the Council,
public or effected property owners or during the entire process starting August 30, 1996, that
the Redlands Federal Bank Final Map recording requirements and owners certification sheet
included onlv the Council's ACCEPTANCE of the existing 1/22/86 Dedicated Sterling
Avenue with slope easement and the Council's REJECTION of the Daley Canyon Road
Secondary Emergency Access road with slope easements.
The Council's May 19, 1997 REJECTION of Daley Canyon Road. with slope
easements "CUTS OFF" the existing 1/22/86 dedicated access serving the property to the

north, the City property to the east and is the Public Health and Safely required Secondary
Emergency Access for the l00f: existing homes to the northwest. This is further addressed in
our May 28, 1997 letter to the City Engineer and Director of the City Department of Public
Works and who confirms the Redlands Federal Bank FInal Tract Map and Reversion to
Acerage will not be recorded until the $125,OOOi: of unpaid property taxes have been
paid(see tab 8).
Upon recordation of the Councils May 19, 1997 approved Final Tract Map the
Planning/City Attorney offices have accomplished nothing, but release of the long standing
September 30, 1995 Redlands Federal Bank $1.3 Million Instrument of Credit for
Performance given to the City for the Bank's development subsidiary's 1980-1985
obligation to construct Sterling Avenue and Daley Canyon Road. As their fifteen (15) year
BONUS to the City, Redlands Federal Bank leaves a once beautiful area turned into a
"Burned Out" dump with abandoned foundations, dead trees, open reservoir hazards with
graffiti and RACIAL SLURS (see tab 9).
Ironically, in 1991 the City publicly represented they had started development of
Foothill upscale housing on their contiguous 1/22/86 Dedicated Sterling Avenue blighted
City/SBMWD 180 acre property and in March 1992 the City even paid $360 thousand to
purchase eight (8) vacant acres more. The City's farce was publicly billed as the answer to
keep people from moving to Redlands.
This total affair is another example of the continuing "slight of hand" by the
Planning/City Attorney offices while their incompetence and ineptness escalates not only the
Sterling Avenue neighborhoods deteriorating areas, but escalates all of the citizens falling
property values and loss of equity mounting into the billions.
It is !ill! any wonder the City faces a shortfall of $7.2 Million in the 1997-1998
General Fund Budget. This does not include the above referenced City costs and losses in
the Arden/Guthrie area of $13.5 Million and growing. Unfortunately, the Planning/City
Attorney Offices befit the recent Sun articles, "City in Peril" and Falling Fortunes".
On May 27, 1997 the City Clerks office informed us there is no City vehicle for the
public or effected parties to appeal the Council's May 19, 1997 Motion or to request the
Council's reconsideration of this manipulated oversight.

AGREEMENT FOR GRANT OF RIGHl OF WAY
THIS AGREEMENT is entered into by and between EAST VALLEY WATER
OISTRICT, a public agency (hereinafter 'OISTRICT") and the CI1Y OF SAN
BERNARDINO WATER DEPARTMENT, a municipal cPrporation (hereafter
'Cl1Y").

RECITALS
.
WHEREAS, East Valley Water District desires to inve~tigate certain lands owned
by the CI1Y, which are more fully described in the a~ched map Incorporated
herein as exhIbit. A", to determine the suitability of the land for use by the
DISTRICT. as a reservoir site; and
.
WHEREAS, the DISTRICT requires access to the said property to conduct soils
and geologic investigations and requires approval of a Right of Entry onto CITY
property for this purpose.
COVENANTS
.
NOW THEREFORE BE IT AGREED, that based upon the foregoing
recitals and the consideration to be determined that:
.
1. CITY grants to DISTRICT a right of entry onko property of the CllY,
which is described in Exhibit. A. attached hereto and incorporated herein for
the purpose of conducting such soils and geologic investigations as needed to
determine the suitability of the property for a reservoir site. .
2. Said right of entry shall permit the DISTRICT to dig and excavate
trenches and holes in various parts of the said prop~rty.

3. DISTRICT agrees to provide CITY with a ce,rtificate of insurance for
general liability naming the CITY as a CO-insured on the policy for the duration of
the work conducted on said property, :

4. DISTRICT hereby agrees to indemnify. hole! harmless and assume the
defense of, and pay all court costs and attomeys fe~ relating to or arising
therefrom, In an actions of law or in equity, the CITY, iits officers, agents,
employees, and elective boards, against all claims. losses, damage, including
property damage, personal injury, including death, any liability of every kind,
nature and description, arising out of or in any way connected with the negligent
acts, errors or omissions, or the willful misconduct of the DISTRICT. or any

AGREEMENT REGARDING PROPOSED STREAM OR LAKE ALTERATION

THIS AGREEMENT, entered into between the State of California,
Department of Fish and Game, hereinafter called the Department, ,and
Rprnard Kprsy of Citv of San Bernardino, State of California,
hereinafter called the Operator, is as follows:

WHEREAS, pursuant to Section ~ of California Fish and Game Code,
the Operator, on the .l.lll.h day of Janllary, l.i2..6., notified the
Department that they intend to divert or obstruct the natural flow of,
or change the bed, channel, or bank of, or use material from the
streambed(s) of, the following water(s): 3 unnamed channels, San
Bernardino County, California, Section 18 &19, Township lN, Range ~.

WHEREAS, the Department (represented by Michael Giusti has made an
inspection of subject area and has determined that such operations may
have substantially adversely affect existing fish and wildlife
resources including: rentiles. sona birds. rantors. other wildlife
resources. and rinari an habi tats in thp an~a.
.
THEREFORE, the Department hereby proposes measures to protect fish
and wildlife resources during the Operator's work. The Operator
hereby agrees to accept the following measures/conditions as part of
the proposed work.
.
If the Operator's work changes from that stated in the notification
specified apove, this Agreement is no longer valid and a new
notificatioh shall be submitted to the Department of 'Fish and Game.
Failure to comply with the provisions of this Agreement and with'other
pertinent code sections, including but not limited to Fish and ~ame
Code Sections 5650, 5652, 5937, and 5948, may result in prosecution.

Nothing in this Agreement authorizes the Operator to trespass on any
land or property, nor does it relieve the Operator of resp61'lsibility
for compliance with applicable federal, state, or local laws or
ordinances. A consummated Agreement does not constitute Department of
Fish and Game endorsement of the proposed operation, or assure the
Department's concurrence with permits required from other agencies.
This Agreement becomes effective on dat~ of Denartment's sicrnature and
terminates Novpmber 1. 1997 for restoration activiti~s onlv. This '

STREAMBED ALTERATION CONDITIONS FOR NOTIFICATION NUMBER: 5-011-96
.
1. 'The following provisions constitute the limit of activities
agreed to and resolved by this Agreement. The signing of this .
Agreement does not imply that the Operator is precluded from doing
other activities at the site. However, activities not specifically
agreed to and resolved by this Agreement, shall be subject to
separate notification pursuant to Fish and Game Code Sections 1600
et seq.
.
.
2. The Operator proposes to alter the 3 streambeds restoring the
streambed to a non-erodible condition. Site 1 is approximately 500
,feet long and 150 feet wide and was filled in 1983 with the
construction of Del Rosa No. 3 water storage reservoir. This area
will be re-contoured and will have sand bags placed to prevent
future erosion problems. Site 2 is approximately 250 feet long by
125 feet wide and will be restored to its pre-project condition.
Sand bags may be used to reduce future erosion problems. Site 3 is
located at the Daley Canyon reservoir site and is an overflow
pipeline which has caused erosion within a small drainage co~rse.
The pipeline will be removed and relocated into the San Bernardino
County Flood Control basin.
3. The agreed work includes activities associated with No.2
above. The project area is located near the intersection of
Poothill Drive and the proposed Sterling Avenue in San Bernardino
County. Specific work areas and mitigation measures are described
on/in the plans and documents submitted by the Operator and shall
be implemented as proposed, unless directed differently by this
agreement.

1. The Operator shall seed all disturbed areas once they have been
restored. All seeding shall be completed by December 1, 1996. The
seed mix Shall be approved by the Department prior to its use. The
seed mix shall contain a mixture of native grass and Riversidian
sage scrub. Hydro-seeding is not recommended. It is recommended
that the seeds be raked into the soil to achieve maximum potential'
for germination and survival.
.
2. At Site 1, the Operator shall install 25 sycamore cutt;n.g along
the center of drainage area. The cuttings shall be 18 incnes long
and approximately 1/2 inch in diameter. The cuttings shall be
installed by January 1, 1997.
.
.
3. At Site 3 all concrete,. asphalt or other petroleum products
shall be removed from the stream channel.. Only clean rock shall be
used for erosion protection. Rock rip rap may be used to protect
the existing water storage reservoir only any other uses not
specified in the submitted plans shall require a new notification
and agreement with the Department.
4. Equipment shall not be operated in wetted areas (including but
not limited to ponded, flowing, or wetland areas) without the prior
. written approval of'the Department.

5. Preparation shall be made so that runoff from steep, erodible
surfaces will be diverted into stable areas with little erosion
potential. Frequent water checks shall be placed on dirt roads,
cat tracks, or other work trails. to control erosion.
.
6. Water containing mud, silt, or other pollutants from aggregate
washing or other activities, shall not be allowed to enter a lake
or flowing stream or placed in locations that may be subjected to
high storm flows.
.
7. If a stream channel has been altered during the operations, its
low flow channel shall be returned, as nearly as possible, to
pre-project conditions without creating a pOSSible future bank
erosion problem.
.
8. Staging/storage areas for equipment and materials shall be
located outside of the stream/lake.
!.
9. Spoil sites shall not be located within a stream/lake; where
spoil shall be washed back into a stream/lake, or where it will
cover aquatic or riparian vegetation.
10. Stationary equipment such as motors, pumps, generators, and
welders, located within or adjacent to the stream/lake shall be
positioned over drip pans.
I.
11. Raw cement/concrete or washings thereof, asphalt, paint or
other coating material, oil or other petroleum products, or any
other substances which could be hazardous to aquatic life,
resulting from project related activities, shall be prevented from
contaminating the soil and/or entering the waters of the state.
Any of these materials, placed within or where they may enter a
stream or lake, by Operator or any party working under contract, or
with the permission of the Operator, shall be removed immediately.
12. The Operator shall comply with all litter and pollution laws.
. All contractors, subcontractors and employees shall also obey these
laws and it shall be the responsibility of the operator to insure
compliance.

15. The Operator shall notify the Department, in writing, at least
five (5) days prior to initiation of construction (project)

16. The Department reserves the right to enter the project site at
any time to ensure compliance with terms/conditions of this
Agreement.

17. The Department reserves the right to suspend and/or revoke
this Agreement if the Department determines that the circumstances
warrant. The circumstances that could require a reevaluation
include, but are not limited to, the following:
a. Failure to comply with the terms/conditions of this
Agreement.
b. The information provided by the Operator in support of the
Agreement/Notification is determined by the Department to be
incomplete, or inaccurate.
c. When new information becomes'available to the Department
representative(s) that was not known when preparing the. original
terms/conditions of this Agreement.
d. The project as described in the Notification/Agreement has
changed, or conditions affecting fish and wildlife resources
change.

5. Vegetation
.
The project sites are situated in the foothills of the San Bernardino Mountains. This area is
characterized as Coastal Sage Scrub habitat which contains California Buckwheat (Eriganum
facculatum), Deerweed (Lotus scoparus) and California Sage (Orlemisia californica). Much of the
area has been distwbed by past human activities including off road vehicle use, illegal dumping, etc.
The Coastal Sage Scrub community in the distwbed areas have been replaced by weedy grasses such
as Bromus diandrus and Haridum jubatum
.
Site I:
.
This site is a small drainage channel that was altered by the placement of soil excavated for the
construction of the Del Rosa No.3 Reservoir and a construction access road in about 1983. This
channel has revegetated and presently contains a healthy Coastal Sage Scrub plan community.
Site 2'
This site is a small drainage course that was disturbed by the placement of soil material excavated
from the adjacent hillside during a geotechnical investigation performed about one year ago. The
8 habitat in this channel has been disturbed and it primarily consists of weedy grasses.
Sites 3 & 4'
These sites are located within areas disturbed by roads, pipeline installation and flood control
. facilities. No native vegetation, except possibly some sage and buckwheat near the Daley Canyon
Reservoir occur. Based on available data, no Coastal Sage Scrub habitat will be disturbed by this
project. .
6. Wildlife Protection

The pUlJlose of this project is to remediate for past disturbances. The project is itself; therefore,
intended to benefit fish and wildlife. A description of the proposed activities is provided in Item 8
below.

Proposed Construction
Site I:
.
Storm water drainage flows arrive at this site from the adjacent hillsides and the access road
constructed about 1983 during site grading for the Department's Del Rosa No.3 Reservoir.
Presently, these flows accumulate on the road and discharge as a concentrated flow on the southerly
side of the filled area. This concentrated flow has eroded about a 200 foot long, 3 foot wide rivelet

that occasionally discharges water and sediments offsite. The Department proposes to place sandbag
baniers across the road and drainage swale to reduce the velocity of the storm water flows and the
. potential for erosion. Some minor grading will be required on a previously disturbed portion of the
flowline. This will occur in the upstream reach of the flowline and affect about 15,000 sq. ft. of area.
The eroded rivelet will be backfilled and compacted imported class n base. Once filled and
compacted, all areas disturbed by this project will be reseeded using a native Coastal Sage Scrub seed
mix prior to or during the rainy season to promote germination. Neither artificial irrigation or hydro
. seeding is proposed so as to reduce the potential for weedy species to occur.
It is estimated that about 50 cubic yards of soil will be required to fill the eroded area. Dirt will
probably be imported from offsite. Figure 3 shows the location of the activities proposed at this site.
It is anticipated that implementation of these activities will take about two weeks and that the
. following pieces of equipment will be used: A small endloader, a compactor, a water truck, and a
dump truck.
Site 2'
.
Soil which was deposited in the small channel will be removed and deposited back on the pad on the
hillside from which it was excavated. The channel will be recontoured to as near its previous
configuration as feasible. If needed, water bars, sand bags or other similar water energy dissipation
devices will be installed to reduce the potential for erosion until natural vegetation occurs. Because
the project area is preclamately vegetated with grasses, it should be anticipated that revegetation will
occur within the first year. It is anticipated that implementation of this activity will take about 2 days
and the following pieces of equipment will be utilized: A dozer and a flatbed truck.

Site 3:
.
The existing overflow pipeline from the Daley Canyon Reservoir is underground and will be
abandoned in place. No surface disturbance of its alignment will occur. The existing overflow pipe
also serves as a tank dewatering device to empty the reservoir in case of emergency or for
maintenance reasons.
.
To provide overflow and tank dewatering capabilities at the facility, the Department is proposing to
construct a new overflow device at the tank and a new tank dewatering facility which will be located
about 1,000 feet down gradient from the reservoir. The overflow device will consist of a pipe which
will take overflow water to a :I: 400 square foot rip-rap energy dissipator to be constructed adjacent
to the reservoir. Water leaving the energy dissipator will flow in the existing drainage swale located
adjacent to the access road. Flows int his swale, both natural drainage and historic overflow, are
discharged to a San Bernardino County Flood Control District debris basin located about 1,000 feet
down gradient from the reservoir. This project will not alter that condition or increase the volume
of flow.

To provide tank dewatering capabilities, the department will connect the reservoir to a San
Bernardino County Flood Control District debris basin which is located about 1,000 feet down
gradient. This connection will be accomplished by installing an underground pipeline from the
.

.
reservoir to the basin. This pipeline will parallel the existing reservoir water supply line within the
existing right of way. This alignment is located within an existing dirt road or areas disturbed by
ongoing human activities. The pipeline will not encroach into a streambed or lake. A small area a
(:I: 400 square feet) within the debris basin will be disturbed by installation of a pipe outlet structure
and energy dissipator. lbis basin, however, is maintained by the Flood Control District which
activities include removal of vegetation and debris. As such, this project has no potential to
significantly disturb native vegetation or alter a streambed or lake.

To prevent erosion along the proposed pipe alignment, the Department will compact the backfilled
trench to at least the density of the adjacent soil. Because no undisturbed areas or areas with
significant native vegetation will be disturbed, no revegetation is proposed. It is anticipated these
activities will take a few months to implement and that backhoe, flatbed, compactor and various
trucks will be utilized. Because none of these activities or vehicles will encroach into a streambed
or lake, no mitigation other than soil compaction is proposed.

I have received the ENCLOSED Copy of the April 29, 1997 letter from Planning to Appellant
Ron Kemper, Crawford Investment Company. Attached to Planning's April 29, 1997 letter was
Planning's April 24, 1997 Recommended Motion for Council Action and Addendum to the March
3, 1997 Staff Report to the Council. These April 24, 1997 Planning documents were written
twelve (12) days prior to the May 5, 1997 Council Meeting and forwarded five (5) days later by
their April 29, 1997 letter to Ron Kemper, Crawford Investment Company.
ENCLOSED is the May 5, 1997 Council Agenda and Item 27 Recommended Motion i.e.:
Tentative Tract Map No. 15775 Reversion to Acreage with April 24, 1997 Planning Requests for
Council Action, Addendum to their March 3, 1997 Staff Report, and Certified April 21, 1997
letters from Ron Kemper, Crawford Investment Company (Appellant), to Michael Hayes, DirectOt
of Planning, and received by the City Clerk on April 28, 1997.
I am a CITIZEN reasonably knowledgeable as to: (1) this areas blighted conditions, (2)
depreciating home values, (3) un-maintained City and City/EDA 18O:t acre Little Sand Canyon
Development property, (4) existing 100:1: Homes to the northwest allowed by the City and
continued new permits without the required Secondary Emergency Access and (5) all this with the
lengthy knowledge of Planning/City Attorney offices poses the potential of major liability to the
City, etc.
Being reasonably knowledgeable to these matters 1 do not concur with the Planning/City
Attorney offices representations and therefore oppose their recommendations as represented to the
Council for Approval of Tentative Tract Map No. 15775 Reversion to Acreage. The Sterling
Heights Tentative Tract No. 14112 recommended by Planning/City Attorney offices and approved
by the Planning Commission on November 7, 1990 is underlying the Tentative Tract Map No.
15775 Reversion to Acreage. Since that time Planning/City Attorney offices have continued to
ignore the impacts of their recommendations and actions as to costs and losses effected on the
various property owners.
The Addendum to the March 3, 1997 Planning Staff Report and mailed to Ron Kemper, Crawford
Investmi;:nt Company (Appdlant) by Planning's April 29, 1997 li;:tter mis-re,presents that; Quote:
"Warner Hodgdon agreed to provide copies of materials he presented at the
April 3rd meeting to the City no later than Wednesday, April 9th. To date,
those materials have not been submitted to the City."
Irrespective of the Planning Addendum ifOss rnis-re,presentation forwarded to Ron
Kemper, Crawford Investment Company (Appellant) by Planning's April 29, 1997 letter, I
(Wamer Hodgdon) personally met at the Planning offices with Director, Michael Hayes on April
25,1997,10:00 A.M., five (5) days prior to Planning's April 29, 1997 letter was written. At that
time I submitted to Mr. Hayes my April 23, 1997 letter to him and Henry Empeiio, Jr., Deputy
City Attorney, along with two Books I of II and II of II tided: Public Health and Safety (San
Andreas Fault, Storms and Wildfires) Primary and Secondary Access. In addition, immediately
thereafter, I personally ddivered my April 23, 1997 letter to Henry Empeiio, Jr., City Attorney's

meeting and discussion.

the City under the Council's May 19, 1997 Motion and approval.
You further clarified to me that the City acceptance and City rejection were as
carried on the separate Redlands Federal Bank's "Owner's Certification Sheet"
previously prepared by their engineer, Integra Engineering, Inc.
You also confirmed to me that the Fmal Tract Map No. 15775 and the front
"Owner's Certification Sheet" were, (1) not provided to the Council or the public with
the May 19, 1997 Agenda package, (2) not provided to the Councilor the public further
for the May 19, 1997 meeting action and (3) nor was the City Sterling Avenue
acceptance with slope easement sand Daley canyon Road rejection with slope
easements even mentioned to the Council and/or public at the May 19, 1997 Council
Meeting.
In addition, I pointed out that the Planning/City Attorney's Offices or Department
of Public Services had not notified the Appellant, Crawford Investment Company and/or
other effected parties that the Redlands Federal Bank's Final Tract Map No. 15775, with
the never before seen or heard of separate Owner's Certification Sheet, was being
placed on the Council's May 19, 1997 Agenda for approval.
Further, I pointed out the Redlands Federal Bank requirement of the City
rejection of the Daley Canyon Road with slope easements for the Final Tract Map was
never mentioned at any Planning/City Attorney's Office meetings with the Appellant or
effected parties, the public meetings or within their recommending documentation to the
Council. I now understand that the City's rejection cuts off the existing 1/22/86
Dedicated Daley Canyon Road access to the north property owners land.

Your staff had provided me with copies of the 1997 Subdivision Map Act: (1)
Pages 52, Land Dedicated for Public Improvements, and (2) Page 81, rejected offers to
remain open, termination of rejected offers. (See attached). As I confirmed with you
when we met, 1/22/86 Dedicated Daley Canyon Road is the existing direct access to the
Appellant's Secret Hollow Ranch to the north. As this existing access is only a short
distance it is the most feasible for egress and ingress to their property.
I do not see that these map act documents have anything to do with the
Planning/City Attorney's Office written and verbal representations to the Council,
public and effected parties. It was clearly represented the 1122186 Dedicated Sterling
Avenue and Daley Canyon Road with slope easements would remain.

I then asked you why the city would accept Sterling Avenue and reject Daley
Canyon Road? Your Reneral explanation of the justification was that there is case
law in which a City (Los Angeles) had legal action filed against it for ~ maintaining
an accepted street ROW. For my clarification and at your earliest convenience,
Dlease Drovide a CODY of this case vou refer to or the case no. thereof, in order that I
can review it for relevance.
Irrespective of the City May 19, 1997 rejection of existing 1/22186 Daley Canyon
Road acceptance with slope easements, you also confIrmed to me when we met, that the
Final Tract Map cannot be recorded by Redlands Federal Bank, until the $125:t
thousand property taxes and City assessments are paid. Further, until the Tract Map is
recorded, the City cannot release the existing Redlands Federal Bank Instrument of
Credit for Performance given to the City.
For my clarification, and at your earliest convenience, please provide a copy
of the Final Tract Map No. 15775 Sheet and separate Owner's Certification Sheet in
order that I can review them for their relevance. If this requires the services of
Riverside Blueprint we will pay for the cost.
It is clear to me that this entire matter has not been properly handled by the
Planning/City Attorney's Office. This includes the City's handling of this matter
regarding the Monday, May 19, 1997 Council Agenda, Item 16, Redlands Federal
Bank's Final Tract Map No. 15775 with Owner's CertifIcation Sheet.
On Tuesday, May 27, 1997, the City Clerk's OffIce informed me the City has no
vehicle in which the public or effected parties may appeal or request reconsideration by
the Council of their May 19, 1997 Motion. Their action approved the Redlands Federal
Bank Final Tract Map No. 15775 Reversion to Acreage with rejection of the existing
1/22/86 Dedicated Daley Canyon Road with slope easements. This leaves the only
course to equity the consideration of legal action.
