The amendment is necessary to process a Conditional Use Permit to construct and operate a self-serve carwash at an existing Shell Service Station (gasoline). The Shell Service Station is located at the southwest comer of Citrus Street and Del Rosa Avenue and further described as being located at 2886 North Del Rosa Avenue. (Exhibit 1, Site Location Map) Staff has expanded the amendment site to about 8.83 acres to include a total of twenty-five lots. The 8.83 acre project site is located on the west side of Del Rosa Avenue between the SR-30 and Lynwood Street and on the east side of Del Rosa Avenue between the SR-30 and Citrus Street. Throughout this Staff Report, the expanded amendment proposal will be referred to as the amendment proposal. KEY POINTS o Redesignation of the amendment site would result in a larger and cohesive commercial district that would be contiguous with the commercial districts located on Del Rosa A venue south of the SR-30 freeway and along Highland A venue. This is consistent with General Plan Goal 1 G. o The amendment proposal is also consistent with General Plan Policy 1.7.14 which encourages the establishment of community-serving commercial nodes at key intersections throughout the City. General Plan Amendment No. 96-06 Mayor and Common Council Meeting of March 3, 1997 Page 2 o The proposed carwash use is not permitted in the CN designation but is permitted subject to an approved CUP in the proposed CG-l designation. o The proposed carwash use at the existing service station is consistent with General Plan Policy 1.7.17. The site and proposed carwash building comply with the Development Code standards for the CG-l and all other applicable standards in terms of site layout and design. o The proposed amendment and carwash use at the existing service station are compatible with the surrounding area and uses. The Planning Commission Staff Report prepared for the February 4, 1997 Planning Commission meeting provides the detailed background and analysis of this project (Refer to Exhibit 3). COMMENTS RECEIVED The property owners within the amendment site were contacted by mail last August. To date, staff has received responses from 5 of the 25 property owners and all were in favor of the proposed amendment. No other comments have been received. ENVIRONMENTAL DETERMINATION On September 26, 1996, the Environmental Review Committee (ERG) reviewed the Initial Study which was prepared by staff for the amendment proposal and CUP project (Attachment I of Exhibit 3). The ERC determined that no significant impacts would result either from the amendment proposal or the CUP project and recommended a Negative Declaration. The proposed Negative Declaration was advertised and the Initial Study was available for public review and comment from October 3, 1996 to October 23, 1996. No comments were received. PLANNING COMMISSION RECOMMENDATION At their February 4, 1997 meeting, the Planning Commission voted to recommend the approval of General Plan Amendment No. 96-06 and Conditional Use Permit No. 96-07 to the Mayor and Common Council. The vote was unanimous: 5 ayes (Gaffney, Hamilton, Lockett, Schuiling and Thrasher), 0 nays, 1 abstention (Quiel), and 3 absent (Enciso, Gonzalez and Strimpel) . Adopt the Resolution which adopts the Negative Declaration and approves General Plan Amendment No. 96-06 to change the general plan land use designation from CN, Commercial Neighborhood to CG-l, Commercial General on about 8.83 acres of land located on the west side of Del Rosa A venue between the SR-30 and Lynwood Street and on the east side of Del Rosa Avenue between the SR-30 and Citrus Street based on the Findings of Fact contained in the Resolution (Exhibit 4). 2. The amendment is necessary to process a Conditional Use Permit to construct and operate a self-serve carwash at an existing Shell Service Station (gasoline) [pursuant to Development Code ~19.06.020, Table 06.01 (Commercial And Industrial Districts List Of Permitted Uses) and ~19.06.030(2)(P)]. The Shell Service Station is located at the southwest comer of Citrus Street and Del Rosa A venue and further described as being located at 2886 North Del Rosa Avenue. (Attachment A-I, Site Location Map) Under the authority of Development Code Section 19.50.030, staff has expanded the amendment site to about 8.83 acres to include a total of twenty-five lots. The 8.83 acre project site is located on the west side of Del Rosa Avenue between the SR-30 and Lynwood Street and on the east side of Del Rosa Avenue between the SR-30 and Citrus Street. Throughout this Staff Report, the expanded amendment proposal will be referred to as the amendment proposal. BACKGROUND On January 18, 1971, the Mayor and Common Council approved Conditional Development Permit (CDP) No. 535, a request to construct and operate a gasoline service station. Since its construction, the service station has been operated continuously. All elements of the project were reviewed by the Development Review Committee (ORC) on September 26, 1996, October 3, 1996 and October 24, 1996. At their meeting of October 24, 1996, the DRC recommended that the Planning Commission recommend to the Mayor and Common Council the approval of CUP No. 96-07 and of the expanded amendment proposal for GPA No. 96-06 as proposed by staff. Since DRC clearance to Planning Commission, the applicant and staff have been resolving site plan issues relative to on-site circulation. CALIFORNIA ENVIRONMENTAL OUALITY ACT (CEOAl STATUS An Initial Study was prepared by staff and presented to the Environmental Review Committee (ERC) for the amendment proposal and CUP project request on September 26, 1996 (Attachment n. GENERAL PLAN AND DEVEI1lPMENT CODE CONFORMANCE The applicant's amendment proposal for the CUP site is not consistent with certain provisions in the General Plan pertaining to patterns and distributions of land uses [General Plan Goal lG(i),]. The expanded amendment proposal is consistent with the provision specified and also with Objective 1. 7 and Policy 1. 7.14. A detailed discussion of this issue is included in the Analysis section of this Staff Report. The proposed carwash use at the existing service station is consistent with General Plan Policy 1.7.17. The site and proposed carwash building comply with the Development Code standards for the CG-l and all other applicable standards in terms of site layout and design. [See Attachment E, Development Code and General Plan Conformance Table] ANALYSIS AMENDMENT AND PROJECT SITE AND AREA CHARACTERISTICS Amendment Site and Area Characteristics The amendment site, located just north of the SR-30/Del Rosa Avenue intersection, is flat and L-shaped. The Shell Service Station site is located within the amendment site at the southwest comer of Citrus Street and Del Rosa Avenue. Other land uses in the amendment site include some small businesses along Del Rosa Avenue and a number of single-family homes fronting on Park Avenue. And, four lots are vacant. (See Attachment A-2, Existing Land Use Map) From the west through the east of the site are single-family residential uses in the RS, Residential Suburban designation. From the east through the south are public flood control uses in the PFC, Public Flood Control district, multi-family residential uses in the RMH, Residential Medium High designation and the SR-30 freeway with commercial retail and services uses located beyond in the CG-l designation. I GENERAL PLAN AMENDMENT NO. 96-06 AND CONDmONAL USE PERMIT NO. 96-07 AGENDA ITEM: 1 HEARING DATE: February 4, 1997 Page 4 The service station site is bounded by Citrus Street on the north. This segment of Citrus Street is not paved and contains a 50 foot Burlington Northern & Santa Fe Railway Company right-of- way and tracks. PROJECT DESCRIPTION (EXISTING SERVICE STATION AND PROPOSED CARWASB) The service station site contains a 2,170 square foot retail building that includes a 306 square foot food mart, 3 auto repair service bays and 2 storage areas. The site is equipped with 2 gasoline pump islands that will serve up to 8 cars. The proposed self-serve carwash structure is 640 square feet. (See Attachment B, Site Plan; Attachment C, Carwash Building Elevations; and, Attachment 0, Service Station Building Elevations) Operation of the service station and accessory uses will be from 7:00 a.m. to 9:00 p.m., 7 days a week. The total number of employees on the site at any given time will be 2. To improve on-site circulation, the applicant is proposing to remove the southernmost service bay from the retail building. This will provide a 16 foot drive aisle between the southern property line and the retail building. EXISTING LAND USE OESIGNA TION The purpose of the CN, Commercial Neighborhood land use designation is to meet the City's objective, as follows: "To provide for the continued use, expansion, and new development of small scale, low- intensity commercial uses which serve and are in proximity to residential neighborhoods throughout the City." (General Plan Objective 1.26) The CN designation permits neighborhood-serving commercial uses such as small grocery stores, shoe repair shops, dry cleaning establishments, drugstores, florists and similar uses. A self- serve carwash as a primary or ancillary use to a gasoline service station is not permitted. While the existing service station has an approved COP (COP No. 535), it is legal nonconforming because the sales of gasoline and oil related products are only permitted in the CN designation as secondary uses to convenience markets (General Plan Policies 1.26.10 and 1.26.11). GENERAL PLAN AMENDMENT NO. 96-06 AND CONDmONAL USE PERMIT NO. 96-07 AGENDA ITEM: 1 HEARING DATE: February 4, 1997 Page 5 PROPOSED LAND USE DESIGNATION The purpose of the CG-I, Commercial General land use designation is to meet the City's objective, as follows: "Provide for the continued use, enhancement, and new development of retail, personal service, entertainment, office and related commercial uses along major transportation corridors and intersections to serve the needs of the residents; reinforcing existing commercial corridors and centers and establishing new locations as new residential growth occurs." (General Plan Objective 1.19) As indicated, the CG-I should occur along major arterials such as Del Rosa Avenue and at major intersections to provide commercial services for the convenience of nearby commercial and residential developments. While the existing Shell Service Station is not located at a major intersection, it is in close proximity to the SR -30 freeway. The CG-I permits a diversity of community-serving retail and service uses, entertainment uses, and professional and fmancial offices. Gasoline service stations are permitted at major intersections subject to a conditional use permit. Similarly, carwash facilities (either self-serve or full-serve) are permitted as ancillary or primary uses, also subject to a conditional use permit. GENERAL PLAN CONSISTENCY The amendment proposed by the applicant is not consistent with the General Plan because it would result in the creation of a 0.52 acre CG-I district consisting of a service station use with accessory commercial retail and service uses. General Plan Goal I G(i) stipulates that development patterns and uses be cohesive and uniform in nodes and districts to prevent "leap frog" development. A single lot containing a single commercial use can not be considered a district. A commercial district (or a node) generally provides a diversity of services to the adjacent and surrounding areas. The expanded amendment site is located at a major intersection (SR-30/DeI Rosa Avenue) in a commercial area surrounded by single-family and multi-family residential uses. Redesignation of the site would allow the establishment of a broader range of commercial uses more in keeping with the other commercial districts in the vicinity. The commercial developments located on Del Rosa Avenue south of the SR-30 freeway and along Highland Avenue will combine with the amendment site resulting in a larger and cohesive commercial district. This is consistent with several points in General Plan Goal IG(a), (g), (i) and (j) and also with General Plan Policy - GENERAL PLAN AMENDMENT NO. 96-06 AND CONDmONAL USE PERMIT NO. 96-07 AGENDA ITEM: 1 HEARING DATE: Febroary 4, 1997 Page 6 1.7.14 which encourages the establishment of community-serving commercial nodes at key intersections throughout the City. About 1.01 acres within the amendment site are vacant and constitute 4 lots. The remaining 7.82 acres contain commercial retail and service uses and single-family residential uses. The majority of existing commercial uses are permitted in the CN and CG-l designations. The existing single-family residences along Park Avenue are permitted uses under the CN designation and will remain as such under the CG-l. COMPATIBILITY The amendment proposal and the proposed carwash use at the existing service station are compatible with the surrounding area and uses. A portion of the amendment site is already developed with commercial and single-family uses and there are existing commercial retail uses south of the SR-30 on Del Rosa Avenue and alSo on Highland Avenue. The area surrounding the amendment site consists of single-family and multi-family residential uses for which the existing, proposed and future commercial uses will provide commercial services. As previously stated, the existing single-family residential uses on Park Avenue are permitted uses in the CN designation. Their status as permitted uses will not change under the CG-l designation. COMMENTS RECEIVED On August 21, 1996, Planning staff contacted all of the property owners for the expanded amendment site by mail. The mailing included a map of the proposed amendment site and a reply form on which the property owner could indicate hislher opposition or support for the proposal. Of the twenty-five property owners contacted, five responded and all were in favor of the amendment. CONCLUSIONS The applicant's amendment proposal for a single parcel is not consistent with the General Plan because it would result in the creation of small commercial area containing a single commercial use. In addition, it would result in a disjointed land use pattern and is inconsistent with General Plan Goal IG(i). GENERAL PLAN AMENDMENT NO. 9(H)6 AND CONDmONAL USE PERMIT NO. 96-07 AGENDA ITEM: 1 HEARING DATE: Febroary 4, 1997 Page 7 The expanded amendment proposal is consistent with General Plan and General Plan GoallG(i) (and other elements of the Goal) because it would result in the creation of a commercial district containing a diversity of commercial retail and service uses, existing single-family residences and vacant land. It is consistent with General Plan Policy 1.7.14 which encourages the establishment of community-serving commercial districts at the City's key intersections. The expanded amendment proposal would result in a cohesive commercial corridor on Del Rosa Avenue because the existing commercial districts to the south are also designated CG-l. The existing single-family residences on Park Avenue are permitted uses in the CN and CG-1. The proposed carwash at the existing service station is not permitted in the existing CN land use designation but is permitted in the proposed CG-l designation with an approved CUP. The proposed carwash is consistent with General Plan Policy 1.7.17 which encourages the development of auto-related uses in the CG-l with a Conditional Use Permit. The existing service station, proposed car wash and associated changes to the site and site circulation meet all applicable Development Code standards and design guidelines. A Negative Declaration is proposed for the project. RECOMMENDATIONS Staff recommends that the Planning Commission recommend to the Mayor and Common Council the: 1. Adoption of the Negative Declaration; 2. Approval of General Plan Amendment No. 96-06 based on the Findings of Fact (Attachment F); and, 3. Approval of Conditional Use Permit No. 96-07, based on the Findings of Fact (Attachment F), subject to the Conditions of Approval (Attachment G) and Standard Requirements (Attachment H). There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed carwash at the existing service station would not be detrimental to public health and safety in that the project has been reviewed by the affected City departments and public agencies. 2 ATIACHMENT G GENERAL PLAN AMENDMENT NO. 96-06 & CONDmONAL USE PERMIT NO. 96-07 AGENDA ITEM: 1 HEARING DATE: February 4, 1997 CONDmONS OF APPROVAL FOR CONDmONAL USE PERMIT NO. 96-07 1. Within two years of development approval, commencement of construction shall have occurred or the permit/approval shall become null and void. In addition, if after commencement of construction, work is discontinued for a period of one year, then the permit/approval shall become null and void. Projects may be built in phases if preapproved by the review authority. If a project is built in preapproved phases, each subsequent phase shall have one year from the previous phase's date of construction commencement to have occurred or the permit/approval shall become null and void. Project: Expiration Date: Conditional Use Permit No. 96-07 February 4, 1999 2. The review authority may, upon application being filed 30 days prior to the expiration date and for good cause, grant one time extension not to exceed 12 months. In the event that this approval is legally challenged, the City will promptly notify the applicant of any claim or action and will cooperate fully in the defense of the matter. The applicant further agrees to reimburse the City of any costs and attorney's fees which the City may be required by the court to pay as a result of such action, but such participation shall not relieve the applicant of his obligation under this condition. 4. Minor modification to the plan(s) shall be subject to approval by the Director through a minor modification permit process. Screening and sign regulations compliance are important considerations to the developer because they will delay the issuance of a Certificate of Occupancy until they are complied with. Any exterior structural equipment, or utility transformers, boxes, ducts or meter cabinets shall be architecturally screened by wall or structural element, blending with the building design and include landscaping when on the ground. This requirement also includes any applicable Land Use District Development Standards for residential, commercial and industrial developments regarding minimum lot area, minimum lot depth and width, minimum setbacks, maximum height, maximum lot coverage, etc. 6. The applicant shall comply with all requirements of the San Bernardino County Department of Environmental Health Services (DEHS) , California Regional Water Quality Control Board, Santa Ana Region and other agencies, as applicable. 7. This project (CUP 96-07) shall be required to maintain a minimum of 8 standard off- street parking spaces.
