REOUEST/LOCATION
A City initiated proposal to amend the text of Development Code Sections 19.62.020(7),
(NONCONFORMING STRUCTURES) and 19.62.030(2), (NONCONFORMING USES) to
allow the continued use of a nonconforming structure and the re-establishment of a
nonconforming use, if the use of the structure or the use itself has not been discontinued for a
period of 36 months prior to the effective date of the proposed ordinance, provided the structure
or use is located on a parcel that abuts the west side of Mt. Vernon Avenue, or an adjacent
parcel that is part of a larger project, between 8th and 9th Street. (See Exhibit 2, Attachment
1, Text Changes)
Detailed background information on this project is contained in the December 17, 1996 Planning
Commission Staff Report (Exhibit 3).
KEY POINTS
. The Development Code states that if a nonconforming use or the use of a nonconforming
structure are discontinued for a period of 12 or more consecutive calendar months, the
use and/or structure shall lose its legal nonconforming status and be required to conform
with applicable Development Code standards.
. Several of the commercial uses and one multi-family residential use within the site do not
conform with the uses permitted or development standards required in the CG-4-SP or
RS designations.
. The nonconforming multi-family residential development is not permitted in the CG-4-SP
or RS designations and has lost its legal nonconforming status. For this reason, it is the
only use that would be affected by the proposed amendment.
. The adoption of the proposed amendment would reinstate the legal nonconforming status
of the multi-family residential development and allow the reuse of the 24 units which are
in poor condition. Substantial effort and costs would be required for the units to meet
minimum Uniform Building Code standards.

. The 24 units do not meet current Development Code standards in terms of density, unit
size, open space and off-street parking.
. The proposed amendment is not consistent with the Paseo Las Placitas Specific Plan
which identifies opportunities to create a vital shopping, dining, entertainment and
community facilities district for the City and the region.
. Deteriorated residential areas are identified in the Specific Plan as a major constraint to
the revitalization of the Mt. Vernon corridor and as such, the nonconforming residential
development is inconsistent.
. The amendment proposal is not consistent with General Plan Policies 1.3.10, 1.7.12 and
1. 7.13 which call for the development of specialty and theme-oriented commercial
centers along the Mt. Vernon Avenue corridor. These types of development will reflect
the City's historical and ethnic heritage that can serve regional and local populations.
. Similarly, General Plan Objective 1.24 strives to achieve the upgrading and enhancement
of Mt. Vernon Avenue, between 4th and 9th Streets, through the establishment of an
ethnic-themed specialty commercial center.
COMMENTS RECEIVED
Planning staff has received phone calls, counter enquiries, letters and petitions regarding this
proposal. Copies of letters and petitions in opposition are included in Exhibit 4 (Comments
Received). Letters and petitions in favor of the project are included in Attachment D to Exhibit
3.
ENVIRONMENTAL
Staff has evaluated the proposed Development Code Amendment and determined that it is
exempt from CEQA pursuant to the CEQA Guidelines ~15061(b)(3) which states that CEQA
only applies to projects and/or activities which have the potential for causing a significant effect
on the environment. The parcels included in the project site for this amendment proposal are
already developed and changing the time frame which regulates the legal nonconforming status
for these properties will not result in any environmental effects.

PLANNING COMMISSION RECOMMENDATION
The Planning Commission reviewed the Development Code Amendment No. 96-03 on December
17, 1996, and voted 6 to 0 to recommend to the Mayor and Common Council denial of the
Development Code Amendment, based upon the attached Findings of Fact (Exhibit 3,
Attachment C).
Planning Commission Vote: 6 ayes (Enciso, Gaffney, Gonzalez, Hamilton, Lockett and
Schuiling); 0 Nays; 0 Abstentions; and, 4 Absent (Quiel, Stone,
Strimpel and Thrasher).
MAYOR AND COMMON COUNCIL OPTIONS
1. The Mayor and Common Council may deny DCA No. 96-03 based on the Finding of
Fact (Exhibit 3, Attachment C); or,
2. The Mayor and Common Council may determine that the proposed ordinance does not
conflict with General Plan Goals, Objectives and Policies and adopt the ordinance
(Exhibit 2).
STAFF RECOMMENDATION
Staff recommends that the Mayor and Common Council deny Development Code Amendment
(DCA No. 96-03) based on the attached Findings of Fact (Exhibit 3, Attachment C).

19.62.040 EXCEPTIONS
Notwithstanding any other provision in this Development Code, any nonconforming structure
or nonconforming use located on property which abuts the west side of Mount Vernon Avenue,
or is a contiguous parcel that is part of a larger project, between 8th Street and 9th Street, shall
continue to retain legal nonconforming status provided that the use of the nonconforming
structure, or the nonconforming use, has not been discontinued for a period of 36 consecutive
calendar months prior to the effective date of this ordinance. Re-establishment of a previous

19.62.050 ABATEMENT OF NONCONFORMING USES

19.62.060 S'fRUCTURE PERMITS OR CERTIFICATES OF OCCUPANCY
PROIllBITED
When any nonconforming structure or use is no longer permitted pursuant to the provisions of
this Chapter, no permit for a structure sha11 thereafter be issued for further continuance,
alteration, or expansion. Any permit issued in error sha11 not be construed as allowing the
continuation of the nonconforming structure or use.
19.62.070 REMOVAL OF ILLEGAL NONCONFORMING STRUCTURES
AND USES
Nothing contained in this Chapter sha11 be construed or implied so as to allow for the
continuation of illegal nonconforming structures and uses. Said structures and uses shall be
removed immediately subject to the provisions of Chapter 19.46 (Enforcement of Provisions)
and State law.

BACKGROUND
Two of the lots included in the project site for the proposed ordinance are developed with a 24
unit apartment complex that has had numerous Code Compliance citations over the years. In
November 1994, the City ordered the apartments vacated because of immediate health and safety
concerns. The order stated that the apartments could not be reoccupied until the owner obtained
permits, completed all necessary repairs, and was signed-off by the City's Inspection Services
Division to reoccupy. The Board of Building Commissioners upheld this action in January 1995,
and assessed board-up costs.
The former property owner made no attempt to comply with the order and, as a result, the
property lost its legal nonconforming status in 1995 when the property was abandoned.
On September 16, 1996, the Mayor and Common Council considered a request from Councilman
Negrete to adopt an urgency ordinance to extend the time period that regulates the legal
nonconforming status for the properties. The item was continued to the meeting of September
23, 1996.
On September 23, 1996, the Mayor and Common Council determined that the circumstances of
the property and the request did not constitute an urgent situation. Planning staff was directed
to initiate and process the request as an amendment to the Development Code. [See Attachment
D., Mayor and Common Council Staff Report (September 16, 1996)]
The Development Review Committee reviewed DCA No. 96-03 on October 31, 1996 and
cleared the project to the Planning Commission.

CALIFORNIA ENVIRONMENTAL OUALITY ACT (CEO A) STATUS
Staff determined that the amendment proposal is not subject to CEQA pursuant to CEQA
Guidelines ~1506l(b)(3) which states that CEQA applies only to projects that have the potential
for causing a significant effect on the environment. At their meeting of October 31, 1996, the
Environmental Review Committee (ERe) concurred with the findings of staffs preliminary
review for CEQA. The ERC recommended that the Planning Commission and the Mayor and
Common Council concur with this determination because the parcels included in the project site
are already developed and changing the time frame which regulates the legal nonconforming
status for these properties will not result in any environmental effects.
ANALYSIS
SITE AND AREA CHARACTERISTICS
The 2.45 acre project site is situated on the west side of Mt. Vernon Avenue between 8th and
9th Streets in the CG-4-SP (Commercial Genera1/Paseo Las Placitas Specific Plan). The
adjacent parcels which could be affected by this proposal are designated RS, Residential
Suburban. Union Street parallels and runs between 8th and 9th Streets and bisects the site. The
site is flat and contains ten lots of varying sizes. Six of the lots are located in the CG-4-SP with
the remaining four lots in the RS, Residential Suburban designation. Existing land uses include
commercial retail and service uses, a vacant multi-family residential development and a single-
family residence between 8th and Union Streets. The multi-family residential development
contains two lots, of which one lot (the smaller of the two) is designated RS. Land uses between
Union and 9th Streets include commercial retail and service uses and a vacant lot.
In general, the land uses north, east and south of the site are a mix of commercial retail and
services in either the CG-4-SP or CG-2, Commercial General designations. West of the site are
single-family uses in the RS, Residential Suburban designation. On the northeast corner of 9th
Street and Mt. Vernon A venue is a public school in the PF, Public Facility designation. A City
park is located just east of the Mt. Vernon A venue corridor between 8th and 9th Streets in the
PP, Public Park designation. (See Attachment B, Existing Land Use Map)
DEVELOPMENT CODE REQUIREMENTS
Nonconforming Regulations
Development Code ~19.62.020(7) states that: "If the use of a nonconforming structure is
discontinued for a period of 12 or more consecutive calendar months, the structure shall lose its

legal nonconforming status, and shall be removed or altered to conform to the provisions of this
Development Code..." Similarly, Development Code ~19.62.030(2) states that: "If a
nonconforming use is discontinued for a period of 12 or more consecutive calendar months, it
shall lose its legal nonconforming status, and the continued use of the property shall be required
to conform with the provisions of this Development Code." There are several commercial uses
and one residential use within the site that do not conform with the uses permitted or
development standards required in the CG-4-SP or RS designations.
Of the existing uses and structures on the site, staff finds the nonconforming multi-family
residential development of most concern. Multi-family residential uses are not permitted in the
CG-4-SP or RS designations. Because the multi-family development has lost its legal
nonconforming status, it is the only use that would be affected by this amendment. The adoption
of the proposed amendment would reinstate the legal nonconforming status of the 24 units and
allow their reuse. In general, the apartments are in poor condition and substantial effort and
costs would be required for the units to meet minimum Uniform Building Code standards. In
addition, the units do not meet current Development Code standards in terms of density, unit
size, open space and off-street parking.
The density on the site is very high (about 40 dwelling units per gross acre) and exceeds even
that allowed for the RH, Residential High designation (31 dwelling units per gross acre), the
City's most intensive multi-family residential land use designation. And, the individual units,
which are about 375 square feet each, do not meet the 500 square foot minimum required for
bachelor units.
A new multi-family residential development of commensurate size and density would be required
to provide a minimum of one recreation amenity. Examples of a recreation amenity include:
swimming pool, spa, clubhouse, tot lot with play equipment, picnic shelterlbarbecue area, court
game area or others. The site contains 12 duplexes in 6 rows with 2 buildings each. The
buildings are spaced closely together (7-10 feet apart) and as a result, there is little or no open
space available on the site.
The parking required for the 24 units is 36 covered spaces and 5 uncovered guest spaces. The
required parking cannot be accommodated on-site and it doesn't appear that there are any
existing on-site parking spaces. Future tenants with vehicles will probably park on either Union
Street or Mt. Vernon Avenue.
The two lots of the multi-family residential development are designated CG-4-SP and RS;
however, the site was developed and functions as one development. It is unlikely that a single-
family residence would be built on the RS lot. The site is nonconforming in either designation.

Paseo Las Placitas Specific Plan
The subject site is within the Paseo Las Placitas Specific Plan area. The purpose of the plan is
to revitalize the Mt. Vernon Avenue corridor. Due to the proximity to the downtown area,
freeway access and the establishment of Metrolink service, the plan identifies opportunities to
create a vital shopping, dining, entertainment and community facilities district for the City and
the region.
The plan identifies adjacent deteriorated residential areas as a major constraint to revitalization
efforts. The General Plan also addresses the negative impacts to the City from deteriorated
residential areas, and identifies the opportunity to recycle these areas. Residential units at this
location are inconsistent with the vision for the Mt. Vernon corridor.
GENERAL PLAN CONSISTENCY
The amendment proposal is not consistent with the provisions in the General Plan that relate to
the revitalization of the Mt. Vernon Avenue corridor. Policies 1.3.10, 1.7.12 and 1.7.13 call
for the development of specialty and theme-oriented commercial centers which reflect the City's
historical and ethnic heritage that can serve regional and local populations. These policies are
further refined by Objective 1.24 which strives to achieve the upgrading and enhancement of Mt.
Vernon Avenue, between 4th and 9th Streets, through the establishment of an ethnic-themed
specialty commercial center. Policies 1.24.10 through 1.24.36 specify permitted uses and
development and design guidelines that are implemented through the Paseo Las Placidas Specific
Plan. Residential uses on the ground floor of buildings are not permitted or encouraged along
this portion of the Mt. Vernon Avenue corridor either in the General Plan or in the Specific
Plan.
PERMIT REQUIREMENTS
If the proposed amendment is approved, the property owner of the vacant, nonconforming multi-
family residential development can submit plans and obtain building permits to rehab the
structures for reuse. At this time, no other proposals or applications for rehab and/or reuse have
been submitted or discussed with Planning staff.

CONCLUSION
The amendment proposal is not consistent with the General Plan or the Paseo Las Placitas
Specific Plan and many of the existing uses and structures on the site, particularly the existing
nonconforming multi-family residential development, are not in compliance with Development
Code standards. The amendment would reinstate the legal nonconforming status and allow reuse
of the apartments and extend the legal nonconforming status of some of the commercial uses and
structures.
RECOMMENDATION
Staff recommends that the Planning Commission recommend that the Mayor and Common
Council deny Development Code Amendment No. 96-03 based on the Findings of Fact
(Attachment C).

FINDINGS OF FACT
DEVELOPMENT CODE AMENDMENT NO. 96-03
1. The proposed amendment is not consistent with General Plan provisions that call for the
revita1ization of the Mt. Vernon Avenue corridor through the development of specialty
and theme-oriented commercial centers which reflect the City's historical and ethnic
heritage and that can serve regional and local populations in that the permitted uses listed
for the Mt. Vernon Avenue corridor between 4th and 9th Streets do not include
residential uses on the ground floor or specified commercial uses which could be
reinstated.
2. The proposed amendment would be detrimental to the public interest, health, safety,
convenience, or welfare of the City in that it will allow the reuse of a nonconforming
multi-family residential development that does not meet current Development Code
standards in terms of density, unit size, open space and off-street parking and commercial
uses which are not permissible within the CG-4-SP (Commercial Genera1lPaseo Las
Placitas Specific Plan) district.

Urgency Ordinance Amending Chapter 19.62
Currently the Development Code, as amended by MC-957 on February 5, 1996, requires
a nonconforming structure and a nonconforming use to lose its legal nonconforming status
if the use is discontinued for a period of 12 or more consecutive calendar months.
This urgency ordinance will extend this time from 12 months to 30 months at specified
locations. Under the urgency ordinance, if a nonconforming use or the use of a
nonconforming structure is discontinued for less than 30 consecutive calendar months prior
to September 16, 1996, then the use or the structure shall not lose its legal nonconforming
status and the structure or the use need not be altered to conform to the Development
Code provided that the use or structure is located on a lot abutting the west side of Mt.
Vemon Avenue between 8th and 9th Street.
It is necessary that this urgency ordinance take effect immediately in order to protect the
public peace, health, and safety, so that previously legal nonconforming uses and
structures can be rehabilitated and reoccupied to revitalize economically blighted areas of
Mt. Vernon Avenue.
In addition to adopting this Urgency Ordinance, the Mayor and Council should direct the
Planning Department to initiate a regular ordinance amending Development Code
Chapter 19.62 consistent with this Urgency Ordinance.

San Bernardino West Side Community Development
Corporation has purchased' the apartment complex on the
corner of M t. Vernon and V nion Streets. Plans for the
complex are to be a Sober Living Community free of drugs
and alcohol. A complex of this type will have 24 hour
intensive management and security which will decrease the
homeless on the streets, police calls, vandalism, and theft for
the surrounding business and homeowners.

ISSUE
Item no. S-l on the supplemental agenda for 9/16/96 is a proposed urgency ordinance to extend
the period of time before a structure loses its nonconforming status for properties located on the
west side of Mt. Vernon Avenue, from 8th - 9th Streets.
BACKGROUND
The block covered by the proposed ordinance has a 24 unit apartment complex that has had
numerous Code Compliance citations over the years. In November 1994, the City ordered the
apartments vacated because of immediate health and safety concerns. The order stated that the
apartments could not be reoccupied until the owner obtained permits, completed all necessary
repairs, and was signed-off by Building Inspection to reoccupy. The Board of Building
Commissioners upheld this action in January 1995, and assessed board-up costs.
The property owner made no attempt to comply with the order and we must conclude that there
was no intent on his part to comply and that he voluntarily gave up his nonconforming status in
1995 when he abandoned the property which is now owned by a lending institution.
Adoption of this ordinance would reinstate the nonconforming status and allow reuse of the
apartments. The apartments are in deplorable condition and should be demolished. Substantial
effort and costs would be required for the units to meet minimum Building Code standards. In
addition, the units do not meet current Development Code standards in terms of density, unit
size, open space and off-street parking.

POLICY CONCERNS
The subject site is within the Paseo Las Placitas Specific Plan area. That plan was undertaken
with the intent to revitalize the Mt. Vernon corridor. In particular, the proximity to the
downtown area, freeway access and establishment of Metro1ink service, the plan identified
opportunities to create a vital shopping, dining, entertainment and community facilities district
for the City and the region.
The plan identified adjacent deteriorated residential areas as a major constraint to revitalization
efforts. The General Plan also addressed the negative impacts to the City from deteriorated
residential areas, and identified the opportunity to recycle these areas. Residential units at this
location are inconsistent with the vision for the Mt. Vernon corridor.
RECOMMENDATION
Based on the concerns outlined above, I recommend that you not support this proposal.

On October 10, 1996, I wrote to Tun Steinhaus regarding the possibility of the Economic
Development Agency's considering the approval of a project which supposedly would establish a
live-in drug rehabilitation center across the street from the Home of Neighborly Service. As Mt.
Vernon Elementary School is only a block away from the proposed center, several parents and
community members had expressed deep concern.
In my letter I requested that he postpone making a decision for a week or more until we could
study the impact on the school and students. We have since learned that the Mt. Vernon Union
Street Project is the project in question. Mrs. Valerie Pope Ludlam provided us with a copy of
her Management PIan, and we note that the tenants and visitors, in fact, will not be permitted to
bring alcohol or drugs onto the premises.
If there are major changes in the project at some time in the future which might impact our
schools, we would appreciate being notified so we could study the proposed changes. Thank you
in advance for your consideration of our request.

The Westside Action Group is a non-profit conununity based organization which has been actively serving
the greater San Bernardino Conununity since 1972. The membership of WAG is composed of business
owners, civic officials, conununity activists, and public employees... with many of them having specific ties
to the Westside of San Bernardino.
We were asked by a couple of city residents living near the area of Union Street and Mt. Vernon Avenue
to research and make a reconunendation in reference to the contemplated apartment complex which is being
developed under the auspice of the San Bernardino Westside Development Corporation. The following
were some of our findings which we also choose to share with you.
QUESTION: Is this going to be a rehab complex for drug and alcohol problem residents?
ANSWER: Per staff and management of Wests ide CDC the answer is a resounding "NO", and instead is
due to be an alcohol and drug free residence.
QUESTION: Is this complex opposed by the San Bernardino Unified School District?
ANSWER: Per members of the San Bernardino School District Board concerns had been expressed, but
following research found their concern was not justified thus ultimately sent a letter of support.
QUESTION: Are the businesses, agencies, and residents of the affected neighborhood opposed?
ANSWER: Contacts "ith a number of businesses and individuals in the immediate neighborhood resulted
in a finding that the great majority were not opposed.
We have thus come to the conclusion that most of the opposition to the project is political, and based on
false facts and innuendo. We have reviewed the history of the apartment ownership at this complex in the
past, and the ragged state it currently is in. It appears to be in the best interest of the conununity to develop
a positive sobriety tjpe apartment complex as contemplated. We therefore urge you to support the
application and proposal of the San Bernardino Westside Development Corporation.

Committee (PAC). The MVCRP was initiated and approved by
the mayor and council action on April 3rd, 1989, initially
extending from Baseline to the southern city limits.
The PAC was thereafter organized and worked diligently and
committed itself to fulfiJ1 the responsibility to discuss and
approved of a plan, working in conjunction with city staff, city
resources and urban planning consultants, culminated in the
final development and approval by the PAC, mayor and city
council on April, 1990, of The Paseo Las Placitas Specific Plan
(PLPSP), an ambitious and progressive architectural and urban
plan to establish commercial and business enterprises on Mt.
Vernon Avenue from Ninth Street to Fourth Street.
Additionally, the city and its staff expended enormous amount
of city funds to finalize a viable plan for the revitalization of
San Bernardino's West Side.
The PLPSP has been slowly progressing and recent storm drain
work was completed, which is a preliminary sub-project to the
final plan.
In the judgement of PAC members and I, as chairperson,
dtliations of the PLPSP as a result of an amendment being
proposed to continue the extension of a nonconforming
structure and the re-establishment of a nonconforming use, is

an action deterrant to the implementation of the PLPSP and its
mission.
The proposed amendment would, in effect, delude the true
spirit, intent and resources which the PLPSP represents, as
authorized and approved by the PAC and mayor/council.
The amendment would, additionally, discourage
businesspersons, entrepreneurs and developers to consider
investing in an area not conducive to a business and
commercial climate, in other words, a mixture of other types of
services alien to the purpose of the PLPSP.
Other points to be considered:
-The memo submitted by the Planning and Building Services
Department, dated September 12, 1996, to the mayor and
council, states that the city ordered the apartments vacated in
November, 1994, due to health and safety concerns, with
specific repairs to be completed and approved by building
inspection, and the order upheld by the Board of Building
Commissioners on January, 1995.
-Said owner failed to comply with the order and voluntarily
giving up his noncomforming status (which at that period of
time was 12 months) and abandoning the property, which was
regained by a lending institution.
-The above-stated memo (dated September 12, 1996)
recommends that the intended amendment not be supported
by the city council.
-In principle and actual action, the city has demolished
business structures with comparable deteriorated conditions in
the Mt. Vernon area.

-The proposed structure, "Sober Living Community" submitted
by the San Bernardino West Side Community Development
Corporation, has, todate, failed to present plans and/or
information requested by individuals in the community, which
would disclose a management and organization profile, tenant
rules and regulations, services to be provided and fund
resources.
-The PLPSP will derive it tax revenue base, as a
redevelopment project, by new businesses, commercial
enterprises and other investments. Will other enterprises, such
as non-profit organizations with a tax exempt status, be
required to contribute to the tax revenue base?
-Is there a redevelopment ordinance or regulation that
requires a process to request modifications to an existing
redevelopment project prior to requesting an amendment
modification?
In summary, the City of San Bernardino, in coordination with
the many business groups, has prioritizing their efforts to
regain economic growth in the area. The Mt. Vernon Corridor
Redevelopment Project and its proposed plan, the Paseo Las
Placitas Specific Plan, is a vital component of that economic
growth.

Mt. Vernon plans:
Before the 24 apartments are brought down for a million
reasons, the lender should be contacted first.
He could donate the structure to the city, take a $100,000.
tax write-off. The city in turn could :demolish the apartments,
and dedicate it to public parking.
This would give the surrounding businesses more visiblity
and much needed parking.
Mt. Veron is a mama thorough-fare. It is the historical
route 66. (Not Court st.) It has an off ramp to the freeway.
It has a new storm-drain system. Underground utitlites. A
stable community rich in its traditions. An asset to the city.
Converting this property into public parking would be a
win-win situation.

Development Code Amendment No. 96-03 will not promote improvement to the
community in Ward 1. It will in fact facilitate further decline to the commnnity. In my
opinion, apartments oftltis type will add to the community's already rampant drug and
prostitution problem. Substandard housing such as these need to be removed and suitable
land use adopted.
There is no need for this type of housing as C1Iidenccd by the length of time this
property has been vacant. As most of the neighbors will attest, this property even in its
current unsightly state (boarded windov,,"S and doors) is far better than how it was a couple
of years ago. It was a drug and prostitution haven wreaking havoc to the nearby residents.
Besides its history, this property seems to have major design and structural flaws.
Some of these include substandard block wall construction, inadequate property line set-
backs, insufficient parking, excessive density, and lot coverage exceeding maximum
allowances.
If this property had been properly maintained and remained in use as
nonconforming continuously, I would not hesitate to support its continued existence.
However, that is not the case. I would strongly urge the planning commissioner to deny
this proposal. A denial of this proposal and enforcement of city zoning laws will improve
the community instead of allowing it to return to its prC1liously poor state.

The Board of Directors of the Home of Neighborly Service has not
taken any position on the proposal for special nonconforming use
regulations for properties located on the west side of Mt. Vernon
Avenue between 8th and 9th Streets. Likewise, our board has
taken no position concerning reported proposals for the use of
the property at the southwest corner of Mt. Vernon Avenue and
Onion Street. Our board has not authorized any person to
represent that the Home has taken any position on any of these
matters. Please consider any communication from any person
connected with the Home, expressing views on any of these
matters, to be personal views, and not official positions of the
Home. We regret the confusion that has resulted from such
communications and the press reports concerning them.
As you know, the Home is located directly across Mt. Vernon
Avenue from the property that is the subject of the current
proposals. As a service to our community, the Home wishes to
make its meeting hall available for a public forum on the issues.
We want to conduct this community meeting prior to the Planning
Commission's consideration of the proposed Development Code
amendment. We seek your cooperation in making one or more
members of your staff available to present the issues in context
and to respond to questions. We understand that the proposals
may implicate provisions of the City's general plan, the
redevelopment plan for the Mt. Vernon corridor and a specific
plan for the immediate area. If a full understanding of those
matters requires a presentation from the City's redevelopment
staff, we also request that they be present. We will invite'
representatives of those who advocate and oppose the proposals to
present their positions. and to make themselves available to

This is a petition against changing urgency ordinance located on
a lot abutting the west side of Mt. Vernon between 8th and 9th
Street.
We, the residents, also oppose the proposed rehabilitation
project in our area for the following reasons:
1. Mt. Vernon Elementary School is only one city block away.
2. The Home of Neighborly Service across the street provides
classes for homeless children. .
3. School buses to middle and high schools service our students
at 9th and Mt. Vernon Street.
FOR THE SAKE OF OUR CHILDREN, WE FEEL THAT A

City Council wouldn't.approve an
urgency ordinance this week
changing the zoning on buildings
that former Councilwoman Vale-
rie Pope-Ludlam wants to con-
vert to drug-free apartments.
, But the council did approve a
regular ordinance forcing the
project through the normal re-
view process, which could allow
the Planning Commission and
council to dump it later.
; "I don't. have any problem
wi.th the rehab center," said
Councilwoman Norine Miller,
"but this looks. . . very much like
special interest to me."

"Good projects get lost by bad
politics, There wasn't any reason
not to approve it." said the for-

Services Inc. signed petitions and
wrote letters supporting the ven-
ture. '
The buildings were ordered
closed and boarded up by the city
in November 1994 because of
health and safety concerns. The
owner quickly abandoned the
property, Pope-Ludlam bought it
from the bank that reclaimed it.
Although the neighborhood
was zoned for commercial uses,
the bUildings were allowed to
continue as apartments. A city
rule requires the buildings lose
that special status afler sitting
vaean t for more than a year.
A Sept. 12 letter from the
city's prinCipal planner, Valerie
Ross, recommended the council
not support the drug-free,housing
proposal.
''The apartments arc in de-
plorable condition and should be
demolished," Ross wrote. "Sub-

In April, 1990, the Project Area Committee, mayor and city council
approved The Paseo Las Placitas Specific Plan, an ambitious and
progressive architectural and urban plan to establish commercial and

ordinance to reinstate the nonconforming status and allow the reuse
of a structure on the corner of Mt. Vernon Avenue and Union Street.
Members of the Project Area Committee and I, as chairperson, are
strongly opposed to the approval of this ordinance.
I submit the following facts for your consideration in opposing the
request for adoption:
-The structure in question should have have been demolished as a
nuisance to the area in 1995.
-The proposed project, "Sober Living Community" submitted by the
San Bernardino West Side Community Development
Corporation is not subject to certification or monitoring by state or
county regulatory agencies, or regulatory review regarding
management requirements.
-The proposed project is vehemently opposed by residents,
businesses and community-based organizations In the area.
-Contrary to public statements made, the San Bernardino School
District and the Home of Neighborly Services have not supported this
project.
-The Planning Commission, on December 17, 1996, unanamously
rejected the proposed amendment.

-The proposed amendment would, in effect, be in direct
nonconformance and a deterrent to The Paseo Las Placitas Specific
Project's intent and would directly discourage investments in an area
that would not be conducive to a business and commercial climate.
-The Paseo Las Placitas Specific Plan, as a redevelopment project,
will contribute to future tax revenue base. Tax exempt organizations
are not contributors to the city tax base.
In summary, a drug and alcohol free facility is beneficial in the
rehabilitation of individuals in our community. It is also important
that these facilities be regulated in order that it will also be
beneficial to the total community.
I strongly recommends that the mayor and council unanimously
reject the proposed amendment to development code 19.62.030.
