October 6, 2003 - The Mayor and Common Council adopted Resolution No. 2003-277, a
Resolution of the City of San Bernardino approving a Side Letter to Resolution No. 2001-94,
establishing a Compensation and Benefits Plan for the Management/Confidential and
Unclassified Employees, amending Section I, PERS, Safety Employees, Subsection 5, for Police

SUBJECT
Resolution of the City of San Bernardino approving a side letter to Resolution 2003-329,
establishing a compensation and benefits plan for the Management/Confidential and Unclassified
employees, clarifying language in Section I, PERS, Safety Employees, for Police Safety
Management employees.
BACKGROUND
The attached side letter clarifies the language in Resolution No. 2003-329, Section I, PERS,
Safety Employees, for Police Safety Management employees.
On October 6, 2003, the Mayor and Common Council adopted Resolution No. 2003-277, a
Resolution of the City of San Bernardino approving a Side Letter to Resolution No. 2001-94,
establishing a Compensation and Benefits Plan for the Management/Confidential and
Unclassified Employees, amending Section I, PERS, Safety Employees, Subsection 5, for Police
Safety Management. The side letter added the following language to Section I, PERS, Safety
Employees:
"Effective as soon as possible following adoption of this side letter, the City will
establish a tax-qualified defined benefit plan to provide supplemental retirement
benefits based on the difference between CaIPERS' 3% @ 55 Plan and 3% @ 50
Plan for Police Safety Management employees with 20 or more years of service
effective January I, 2004. This side letter shall be in effect until December 31,
2005. Until that time, the costs associated with this plan will be paid by the City.
Police Safety Management employees' share of ongoing costs after December 31,
2005, wfll be subject to future discussions."

SIDE LETTER TO RESOLUTION NO. 2003-329
FOR POLICE SAFETY MANAGEMENT EMPLOYEES
The following sets forth a Side Letter to Resolution No. 2003-329, for full-time, regular
active Police Safety Management Employees. This Side Letter clarifies the language in
Section 2, I, PERS, Safety Employees, of the Management and Confidential
Employee Compensation and Benefits Plan, effective January 1, 2003 to December
31,2005.
Section 2. I. PERS. Safety Emplovees:

To qualify for supplemental retirement benefits based on the difference between
CalPERS 3% @ 55 Plan and 3% @ 50 Plan, employees must meet all of the following
qualifications between January I, 2004 and prior to December 31,2005. The benefit will
be effective January 1,2004.
. Must be 50 years of age;
. Have 20 or more years of service with the City of San Bernardino; and
· Be eligible for retirement and concurrently retire with PERS; or
· Meets the eligibility requirements for an industrial disability retirement with the
City of San Bernardino
When retiring, employees must retire from the City of San Bernardino.
