Synopsis of Previous Council Action:
July 2002 The Mayor and Common Council adopted the FY 2002/2003 CIP allocating $428,000 for
Street Improvements/Safety Improvements -- Citywide.
08/04/03 Resolution No. 2003- 217 adopted awarding a contract to Guzman Construction Company
for Street Improvements on Terrace Road between 61h Street and Maple Street and on 9'"
Street between Pennsylvania Avenue and Flores Street and Sidewalk and ADA Access at
Higbland Avenue and Ramona Avenue per Plan No. 10620 and 10618.
Recommended Motion:
Tbat the Mayor and Common Council authorize the Director of Development Services to execute Change
Order No. One in the amount of $17,421.81 to contract with Guzman Construction Company for Street
Improvements on Terrace Road between 61h Street and Maple Street and on 9'" Street between

Authorization for the Director of Development Services to execute Change Order No. One to
contract with Guzman Construction Company for Street Improvements on Terrace Road between
6th Street and Maple Street and on 9th Street between Pennsylvania A venue and Flores Street
and Sidewalk and ADA Access at Highland Avenue and Ramona Avenue per Plan No. 10620
and 10618.
Background:
As part of the proposed 2003/04 Capital Improvement Program (CIP), the Mayor and Common
Council allocated a total of $428,000 from the 1/2 cent sales tax fund for Street
Improvement/Safety Improvement-Citywide in Account No. 129-367-5504-7156. This account
is intended to provide flexible funds for use in solving drainage and safety problems that are
reported to us by City officials and the public.
On August 4, 2003, the Mayor and Common Council awarded a contract in the amount of
$185,922.40 to Guzman Construction for street and safety improvements on Terrace Road
between 6th street and Maple Street and on 9th Street between Pennsylvania Avenue and Flores
street and sidewalk and ADA access at Highland Avenue and Ramona Avenue.
During construction certain changes were necessary to provide a complete and functional
finished project. These changes are described in the attached Contract Change Order No. One.
Financial Impact:
Sufficient funds to cover the cost of this change order are available in Account No. 129-367-
5504-7156 "Street Improvements/Safety Improvements-Citywide".
Recommendation:
That the Mayor and Common Council authorize the Director of Development Services to
execute Change Order No. One in the amount of $17,421.81 to contract with Guzman
Construction Company for Street Improvements on Terrace Road between 6th Street and Maple
Street and on 9th Street between Pennsylvania Avenue and Flores Street and Sidewalk and ADA
Access at Highland Avenue and Ramona Avenue per Plan No. 10620 and 10618.

JUSTIFICATION:
During construction, it was determined that the existing guard rail at the curve on
Terrace Road at 6th Street was previously damaged and in need of replacement for

public safety. This damage may have occurred subsequent to the receipt of bids for
this project. See attached quote from Contractor dated November 20, 2003.
During construction, it was determined that three large trees which were not identified
B I_Ion plans needed to be removed to facilitate the installation of the curb, gutter and
sidewalk. The extra work included stump removal, hole filling and security fencing.
See attached quote from Contractor dated November 20, 2003.
An accessible rantp was determined to be needed at the northwest and northeast
comers of Flores Street and 9th Street to comply with ADA standards and to complete
BI-2
the construction of the new sidewalk improvements. See attached quote from
Contractor dated November 20,2003.
It was necessary to remove 3 additional smaller trees of 6" diameter to facilitate the
BI-3 installation of the sidewalk, curb and gutter and the grading behind the sidewalk. See
attached quote from Contractor dated November 20, 2003.
The Standard Specifications allow the contractor to recover his cost for increased bond
B 1-4 due to contract change orders which increase the total contract amount. See attached
quote from Contractor dated November 20, 2003.

Enclosing revised price breakdown of removal of 3 each 48. diameter trees on 9th Street
that are not shown on the plan. Also enclosing Time and Material sheet for 3 each 6"
.diameter trees removed on lO-1 0-03.
Per my guard rail contractor, the guard rail on Terrace Rd. that has any damage, bends or
breaks, can not be used with regards to them installing new guard rail, it is a safety issue
and also warranty would be a factor.
Also, Revising Access Ramps price located at NIW and N/E corners of91h Street and
Flores, due to square footage of new style to be used APWA Std. No.III-2, case C.
The fuUowingpages will sftowa breakdowll of costs and total dollar amount fur the
additional work required on the above projects.
Guzman Construction anticipates the work will take approximately eight (8) days to
complete the tree removal, back filling and compaction. Please note; until the change
order is approved for the extra guardrail (per plan), we cannot complete Terrace Road.
