Synopsis of Previous Council Action:
On April 21, 2003, the Mayor and Common Council adopted Resolution No. 2003-86, a
Resolution amending Resolution No. 6413, Sections Twelve and Fourteen, which
establishes the salaries for the ManagemenUConfidential and Unclassified employees.
Recommended Motion:

Staff Report
Subiect:
A Resolution amending Resolution 6413, Sections Twelve and Fourteen, establishing a Basic
Compensation Plan, and amending Resolution 2001-94, Management, Confidential and
Unclassified Employee Compensation and Benefits Plan.
Backl!round:
The City Administrator and the Advisory Committee of the San Bernardino Confidential
Management Association (SBCMA) have met and discussed various proposals for the SBCMA
employees. SBCMA has accepted a proposal subject to ratification by the Mayor and Common
Council. This agreement will cover a two-year period from January 1, 2004, to December 31,
2005, and contains the following items:
A. Resolution No. 6413. Sections Twelve and Fourteen: A ten percent (10%) salary range
adjustment that moves the entire pay scale upward by 10%, effective January 1,2004;
salary increases would be based on merit.
B. Resolution No. 2003-41. Section 2. L; Administrative Leave: Provide increase in
administrative leave for FLSA exempt employees, from 56 hours to 80 hours and shift
FLSA exempt employees from 84 hours to 120 hours, effective January 1, 2004.
Range adjustments to the Management/Confidential and Unclassified Employees are necessary
due to compaction issues with the Mid-Management Unit. Mid-Management Unit employees
received a four percent (4%) COLA on September 1, 2002, and another four percent (4%) COLA
on October 1, 2003, for a total of eight percent (8%). The Management/Confidential and
Unclassified Employees last received a COLA of two percent (2%) on July 1,2002.
As a result of the increases received by the Mid-Management Unit, Management/Confidential
and Unclassified Employees have fallen behind by six percent (6%). For recruitment and
retention issues a range adjustment is necessary.
Financial ImDact:
Estimated implementation cost to bring seven (7) employees up to new Step 1 salary following
implementation of ten percent (10%) salary range adjustment, effective January 1, 2004, is
$15,800. The sixty-four (64) employees at the top step will be eligible to receive a 0% to 5% step
increase on their anniversary date. *

Cost to increase administrative leave is a soft cost because employees are not paid for
administrative leave not used.
Total cost: $15,800.
*This excludes Safety Management employees since they fall under Charter 186.

AMENDMENT TO RESOLUTION NO. 2001-94
FOR MANAGEMENT, CONFIDENTIAL
AND UNCLASSIFIED EMPLOYEES
Resolution No. 2001-94. Section 2. Subsection L:
(Amend)
L. Administrative Leave
Effective January 1,2004, all forty (40) hour/week FLSA exempt employees will receive
an additional twelve (12) hours of administrative leave and shift FLSA exempt employees shall
receive an additional thirty-six (36) hours. Effective July I, 2004, all forty (40) hour/week FLSA
exempt employees in lieu of monetary compensation shall be assigned eighty (80) hours of
Administrative Leave and shift FLSA exempt employees shall be assigned one hundred twenty
(120) hours of such leave each July 1. Administrative Leave shall not be carried beyond the end
of any fiscal year and shall not be paid for at any time.
