Subject:
Resolution awarding contract to David T. Wasden, Inc. for 9th Street Storm Drain Improvements
from Waterman Avenue to East Twin Creek (Warm Creek) Channel per Plan No. 10676.
Background:
In response to numerous complaints of flooding from property owners on the east side of Waterman
Avenue between 6th Street and 9th Street, the Mayor and Common Council allocated $375,000 in the
FY 2003/04 Capital Improvement Program (CIP) budget for construction of an interim storm drain
in 9th Street extending from Waterman Avenue to East Twin Creek Channel.
This storm drain is designed to intercept drainage that has historically flowed from 9th Street onto
private properties located south of 9th Street and east of Waterman Avenue. This storm drain is an
interim improvement and is designed to intercept flows from small to moderate storms and convey
the flows to East Twin Creek Channel.
A master plan storm drain know as Comprehensive Storm Drain Project (CSDP) No. 7-A2 is
planned in 9th Street as protection for major storm events. Unfortunately, the cost of this master plan
storm drain is estimated to be $3,400,000 and there is no source of funds available for major storm
drain construction.
Plan and specifications for 9th Street Storm Drain Improvements from Waterman Avenue to East
Twin Creek Channel have been approved. Bids have been received and the construction project is
ready to be awarded.
This project was advertised locally in the San Bernardino County Sun Newspaper, Construction
Trend Newspaper, the City's web site, and with the San Bernardino Area Chamber of Commerce;

368-5504-7429 "9th Street Storm Drain, Waterman Avenue to Warm Creek" (SD04-12).
Recommendation:
Adopt Resolution.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION I. David T. Wasden, Inc., 1240 San Cristobal Drive, Riverside, CA
8 92506 is the lowest responsible bidder for construction of 9th Street Storm Drain

Improvements from Waterman Avenue to East Twin Creek Channel per Plan No. 10676. A
contract is awarded accordingly to said bidder in a total amount of $273,040.00, with a

set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not
take effect or become operative until fully signed and executed by the parties and no party
shall be obligated hereunder until the time of such full execution. No oral agreements,
amendments, modifications or waivers are intended or authorized and shall not be implied
from any act or course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute
it within sixty (60) days of passage of the resolution.
