Staff Report
Subject:
Resolution awarding contract to Bonadiman-McCain, Inc. for Timber Creek improvements from
East Twin Creek to 4,016.93' east per Plan No. 10069.
Background:
The existing Timber Creek channel is an unimproved dirt channel that drains into the San Bernardino
County Flood Control District's East Twin Creek channel. The majority of the tributary drainage
area is from the San Bernardino International Airport site. In order to accommodate future airport
development and to increase drainage capacity, Timber Creek channel is proposed to be upgraded to
a concrete lined trapezoidal channel.
This project was initially approved in the FY 98/99 Budget and considered part of a comprehensive
infrastructure improvement "plan" in the area of the City surrounding the San Bernardino
International Airport. A number of street and drainage improvements were included in the "plan"
such as the Orange Show Road, Mill Street, Tippecanoe Avenue and Timber Creek projects. These
projects are being completed as funding becomes available.
A project to concrete line Timber Creek from Twin Creek to Lena Road was bid in October of 2000.
Unfortunately, due to change in policy of the Santa Ana Regional Water Quality Control Board, we
were unable to obtain a Water Quality Certification Waiver for the project. The Board contended
that significant water quality impacts would result from concrete lining Timber Creek from Lena
Road to East Twin Creek and insisted that the City commit to creating a riparian area upstream of
the Lena Road to replace the impacted area between Lena Road and East Twin Creek. This riparian
creation area consists of a graded trapezoidal natural dirt channel, "turf reinforcement" material
installed so as to limit erosion, an irrigation system, tree and shrub species maintained for 3 years
and native weeds and grasses seeded as directed by the project biologist.
Plan and specifications for Timber Creek have been approved, as revised. Bids have been received
and the revised project is ready to be awarded.
This project was advertised locally in the San Bernardino County Sun Newspaper, Construction
Trend Newspaper, the City's web site, and with the San Bernardino Area Chamber of Commerce;
the following companies responded:

Based on the review of proposals, three firms were selected whose proposal best meets the
need of the City. They are:

Three firms were chosen to have a greater degree of availability when services are needed.
Staff proposes to use Converse Consultants as much as possible and the other two may be used
if Converse Consultants is not readily available to perform the requested work. The City has
made no guarantee to any of the consultants regarding the amount and/or the dollar value of
the work they may receive.
Attached to each Agreement is a proposed fee sheet for the respective Consultant.
Financial Impact:
Funds for professional construction material testing services are available through each
individual project and cost of services is charged back to that particular Capital Improvement
Project's budget through the work order number. Therefore, for the majority of services
rendered, the Development Services Department budget will not be impacted. However, staff
may occasionally need expert review and analysis pursuant to a request from the City
Attorney's office regarding a claim. Funds are allocated in the Development Services
Department budget in the Professional/Contractual Services Account Nos. 001-183-5502 and
001-185-5502 ($2,000) for these types ofrequests.
Recommendation:
Staff recommends that the Mayor and Common Council authorize the Purchasing Manager to
issue annual purchase orders totaling $90,000 in aggregate to AMEC Earth & Environmental,
Inc., Converse Consultants, and Kleinfelder, Inc. with provisions for two one-year renewals.

Attached is a copy of the staff report which provides additional background information on this
project that was developed by the City of San Bernardino on October 18, 2002. It is anticipated
that the engineers' consauction estimate for the entire project will be S4OO,OOO with the lVDA
portion being somewhere between 5200,000 to 5250,000.
Staff reco=ends that tbe Board concur with the City of San Bernardino to reject all bids for
Timber Creek improvements between Lena Road and Twin Creek; approve a set-aside of
5300,000 for the Inland Valley Development Agency's portion of the channel between
Tippecanoe and Twin Creek; and authorize the IVDA staff to invoice Hillwood upon completion
of this project.

On ","ovember 13. 2002. the rvOA Board approved a set-aside of 5300.000 for the rVOA's!
portion of the Timber Creek Channel project between Tippecanoe and Twin Creek. Attached is a'
copy of that staff report. Since that action took place, the City of San Bernardino re-bid this I
project and are recommending an award of contract to the lowest bidder. who was Bondimani
McCain at a cost not to exceed 5940,577,50. Attached is the letter from the City of Sanl
Bernardino dated August 26. 2003. requesting the additional 5440.000 in order to award this,
project. This amount will help cover construction, construction management, contract
administration. surveying and inspection and budget contingencies. On September 20, 2003, the
IVDA Finance Committee reviewed and recommended approval of this action.
Staif recommends the Board approve the above recommended action.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AWARDING A CONTRACT TO BONADIMAN-MCCAIN, INC. FOR
TIMBER CREEK IMPROVEMENTS FROM EAST TWIN CREEK TO 4,016.93' EAST
PER PLAN NO. 10069.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Bonadirnan-McCain, Inc., 280 S. Lena Road, San Bernardino, CA
92408 is the lowest responsible bidder for construction of Timber Creek improvements from
East Twin Creek to 4,016.93' east per Plan No. 10069. A contract is awarded accordingly to
said bidder in a total amount of $940,577.50, with a contingency amount of $50,000.00, but
such award shall be effective only upon being fully executed by both parties. All other bids,
therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said
contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk
and incorporated herein by reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not
take effect or become operative until fully signed and executed by the parties and no party
shall be obligated hereunder until the time of such full execution. No oral agreements,
amendments, modifications or waivers are intended or authorized and shall not be implied
from any act or course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute
it within sixty (60) days of passage of the resolution.
