title report indicates that the current owners have owned the property since
October 15, 1962. This property has a history of housing code and property
maintenance violations. Currently, all previously noted violations regarding this
case remain.

Complaint received from SBPD. Property was inspected and posted for code and
housing violations.
A letter was sent (via Certified and Regular mail) to the property owner(s)
mailing address regarding the existing violations on the property.
A re-inspection was conducted with no evidence of rehabilitation and compliance.
Notice of Hearing of the Board of Building Commissioners Hearing was mailed
to the property owners via certified mail. Certified mail was returned unclaimed.
Case presented to the Board of Building Commissioners. The property owners
were not present for the hearing. The BBC adopted staff recommendations and
BBC Resolution Order #4039 was issued.
BBC Order #4039 was posted on property and copy sent to owner via certified
mail. A certified mail receipt was received from property owner.
Fees assessed on property {$502.20} have not been paid to date.
Inspections have not been conducted by Planning and Building Department staff
on building permit issued to owner (#99113 and B9700231).
Case reheard for incorrect assessment of fees. Fees assessed should be $338.60.
BBC adopted staff recommendations and BBC Order 4186 dated June 16, 1997
was issued.
City of San Bernardino Planning & Building Department notified owner that
permit has expired.
No permit activity to date.
APPELLANT'S STATED GROUNDS OF APPEAL
Property owner has obtained a building permit issued to him on 02/04/97 to bring property into
compliance.
Owner states that in his letter of appeal to the city clerk's office that the property was boarded
and fenced, the lawn is mowed, and the landscaping is being maintained.
APPELLANT'S ACTION SOUGHT FROM MAYOR/COMMON COUNCIL
An opportunity to complete the rehabilitation of the property without interference from the Code
Compliance Division.
STAFF ANALYSIS
Mr. and Mrs. Cain have been aware of these violations and have failed to correct them. Several
certified mailings from this division have been returned unclaimed. Building permits were
issued on two separate occasions with no visible signs of rehabilitation and compliance. The
property is now open and vacant with substandard conditions still existing on this property.
STAFF RECOMMENDATION
That the Mayor and Common Council deny the appeal and uphold the BBC Order #4039 issued
dated 3/6/97 and BBC Order #4186 dated 6/16/97 and confirm the direct costs of {$338.60}
from the City of San Bernardino Code Enforcement actions. To allow Code Compliance.
Department to initiate action to demolish structure and abate the nuisance.

On February 4, 1997 I paid $94.50 to Planning and Bullding Services for a
Bullding Permit for the property on Santa Fe Street at the above address.
The PermIt Number Is B97000231. This Is a renewal because previously I
was workIng out of town. Then, I had to have surgery and due to Illness, I
have not been able to began constructIon on the bulldlng as I had planned
smce last month when I received the permIt. I have had the property
boarded up and I have cleaned up the property and mowed and maintatned the
lawn. The property ts also fenced.
I am appealing the complaint that was flIed on March 14, 1997 because of
what I have stated above to bring my property up to code.
I am seeking action from the cIty to allow me the opportun1ty to complete
my Rehab project on my property wIthout further interference from the Code
Compl lance Division.

As requested, a pre-permit inspection was made at the above
referenced address. As a result of this inspection the following
violations or deficiencies were noted.
1. Remove all trash and debris from the interior of the structure
as well as the exterior of the structure. S.B.H.C. 15.24.040
2. Foundations supporting wood shall extend at least 6 inches
above the adjacent finish grade. UBC 2907 .
3. The exterior doors have deteriorated because they have not
been constructed with materials approved for exterior use.
Replace the doors with an approved product.
4. The roof covering is leaking and must be either repaired or
replaced.
5. Repair or replace all damaged interior and exterior wall
coverings.
6. Replace sagging water damaged and termite damaged rafters in
the family room and bedroom. Provide a complete termite report
and make all necessary repairs that may be noted on the
report.
7. Replace the missing plumbing fixtures in the kitchen and one
bathroom.
8. Replace 8 missing light fixtures.
9. Provide a gas line air test for all gas line piping. UPC 1206
10. Provide the missing water heater.
11. Remove the substandard storage buildings on the exterior of
the dwelling. SBMC 15.24.040
12. Repair or replace all missing or damaged windows.
13. Repair or replace the damaged electrical service
panel, electrical receptacles, switches and their covers.
14. Replace the two inoperable wall heaters.
15. Provide smoke detectors in all sleeping rooms and in rooms
providing access to such sleeping rooms. UBC 1210
16. All vehicles must be parked on an approved hard service. SBMC

6 WHEREAS, pursuant to the San Bernardino Municipal Code, Title
7 15, Chapter 15.28, the Building Official has posted a building(s)
8 located at 685 Santa Fe, San Bernardino, California, with a "Notice
9 to Abate Nuisance" and has notified the person(s) having an
10 interest in said property that the said building(s) or premises
11 constitute a public nuisance;
12 WHEREAS, pursuant to San Bernardino Municipal Code, the
13 Building Official has served a "Notice of Hearing Before the Board
14 of Building Commissioners of the City of San Bernardino", relating
15 to abatement proceeding, to the person (s) having an interest in the
16 above property, and has prepared a declaration of mailing of the
17 notice, a copy of which is on file in these proceedings; and;
18 WHEREAS, a hearing was held to receive and consider all
19 relevant evidence, objections or protests on March 6. 1997, and;
20 WHEREAS, there was not an appearance by any person(s) having
21 an interest in the above property.

3 SECTION 1.. Based upon the evidence was submitted, it was
4 found and determined that the building(s) and or premises located
5 at 685 Santa Fe, San Bernardino, California constituted a public
6 nuisance.
7 SECTION 2. The Board of Building Commissioners accepted
8 staff's recommendations. The property owner(s) are hereby directed
9 to comply with the following requirements. Within ten (1.0) days
10 from the date of this order, owner(s) of record shall obtain the
11 required permits to rehabilitate or demolish the structure(s) with
12 rehabilitation or demolition to be completed within thirty (30)
13 days from the date of this order. Owner(s) shall install and
14 maintain the landscaping to include regular irrigation and pruning
15 and shall remove all weeds, dry brush, overgrown vegetation, trash,
16 debris, abandoned vehicles, vehicle parts oL.other items causing an
17 unsightly appearance. The property shall meet all applicable codes
18 adopted by the City of San Bernardino.
19 SECTION 3. Upon the owner(s) of record failure to comply with
20 the order of the Board of Building Commissioners, the Code
21 Compliance Division shall proceed to initiate abatement action by
22 obtaining an Inspection/Abatement warrant to abate violations
23 noted.

3 SECTION 4. It was determined that the City was required to
4 initiate abatement proceedings upon which the City incurred costs
5 in the amount of $502.20. These costs and future related abatement
6 costs shall be the personal obligation of the owner(s) and shall be
7 placed as a lien on the above property.
8 SECTION 5. Upon receipt of an application from the person
9 required to conform to the order and by agreement of such person to
10 comply with the order if allowed additional time, the Supervising
11 Building Official may grant an extension of time, not to exceed an
12 additional 120 days, within which to complete said repair,
13 rehabilitation or demolition, if the Supervising Building Official
14 determines that such an extension of time will not create or
15 perpetuate a situation imminently dangerous to life or property.
16 The Supervising Building Official's authority to extend time is
17 limited to the physical repair, rehabilitation or demolition of the
18 premises and will not in any way affect or extend the time to
19 appeal the notice and order.
20 SECTION 6. Any person aggrieved by this order, may appeal to
21 the Mayor and Common Council by filing a written statement with the
22 Ci ty Clerk.
The statement must include the order appeal, the
23 specific grounds of your appeal, and the relief or action sought.
24 This appeal must be received within fifteen (15) days from the date
25 of this notice dated March 14. 1997.
